The surface waters are labeled as "031161" on the map below and are depicted as a pond and intermittent stream on the Wake Forest, NC USGS Topographic Map and as an intermittent stream on the Wake County Soil Survey. The DWO has determined that no surface waters exist within the drainage south of Thornton Road (SR2043) circled and labeled as "031161" on the map above. We have determined that auras circled on the map from Mr. Bob 7arzccki dated March 30. 1998 are exempt from the Neuse River buffer rules (15A NCAC 2B .(1233). You are reminded that any stormwatcr from this site cannot be directly discharged through existing forest vegetation into intermittent or perennial streams. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed retnrlations. Also this approval will expire two year,.,, from this date or unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. Dear Sirs The purpose of this letter is to request written confirmation from the N.C. Division of Water Quality (DWQ) drat Elie Neuse River Nutrient Sensitive Waters Management Strategy Rules protecting existing riparian areas do not apply to the subject area as shown on the attached signed wetland delineation map. The site is located east of U. S. 1, northeast of Perry Creek Rd.. south of Thornton Rd. and west of the denoted property line along the breached dam (see attached site vicinity trap). The site contains jurisdictional wetlands within three drainage features and a breached pond. A pond and intermittent channel is shown on the USGS topo quad south of Thomton Rd. (SR 2043; see attached site vicinity map). This pond was drained prior to our original delineation perrormcd in 1996 and no wetlands or Waters of the U.S. were determined to axis( within the dminedpond and/or its adjoining drainage by Eric Alsmeyer of the US Army Corps of Engineers on 8/14/96. An intermittent stream is indicated on the Wake Forest. N.C. USGS topo quad within the GAO-flag series wetland (see attached site vicinity map). Mr. Smith determined through site specific evidence that this area does not contain an intermittent stream. Mr. Smith, also, stated that the wetland areas denoted by the 400 and 50W41ag series do not contain "intermittent" stream channels and therefore would not be subject to the 50-foot buffers. He also stated that the breached pond would not be subject to the rules if it was breached prior to the effective date of 7/22197. This pond was breached prior to our original delineation performed in 1996. S&EC. Inc. personnel do not believe that any intermittent and/or perennial stream channel& takes. ponds or estuaries oust within the subject area. Division of Water Quality (DWQ), and myself visited the property known as the Honeycutt Site located north of Perry Creck Rd. and east of US i to determine compliance with the Ncusc River Nutrient Sensitive Waters Management Strategy (NRNSW) rules protecting existing riparian areas. Mr. Smith stated to me that the wctland areas denoted by the 400, 500 and 600-flag series on the attached wetland delineation map do not contain "intermittent" stream channels and therefore would not be subject to the NRNSW 50-foot buffers. He also stated that the drained pond would not be subject to the rules if it was breached prior to the effective date of 7/22197. Any impacts to the wetlands shown on the attached wetland delineation map would still requite 401 and 404 Certifications from the Corps and DWQ. Please call if you have any questions or comments.
