On the down stream side of the culvert the channel takes an immediate right angle (south) and flows along the road until it converges with what appears to be the original channel. November 1998. Attachment A - Figure 1 shows the site location. This project will provide for the reconstruction of the current roadway system within the northeast quadrant of the grade- separated intersection of Billy Graham Parkway (Route 4/US 521) and Wilkinson Boulevard (US • 29/74), located in Charlotte, North Carolina. The City of Charlotte is proposing to extend Westport Road to Mulberry Church Road, and to - relocate the intersection of Mulberry Church Road and Wilkinson Boulevard west of its current - position. The primary purpose of this project is to improve connectivity between Wilkinson Boulevard and Billy Graham Parkway without loss of access to adjacent properties. - The project is located in the Lower Catawba River Basin (Hydrologic Unit No. 03050103) and contains Taggart Creek, unnamed perennial tributaries to Taggart Creek, and an intermittent tributary to Taggart Creek. On behalf of the City of Charlotte, Kinley-Horn and Associates (KHA) is submitting a Pre-Construction Notification application (PCN) in accordance with Nationwide Permit General Condition No. 13 and Water Quality Certification Nos. 3404 and 3376. Pre-Construction Notification Applications and accompanying permit drawings pursuant to Nationwide Permit Nos. 14 and 3 are included as Attachment B. A "Request for Jurisdictional - Determination" has been included with this submittal (Attachment C). The project area was reviewed by U.S. Army Corps of Engineer representative Steve Chapin on December 9, 1999. A copy of the meeting minutes from this review is included as Attachment D. - Due to the linear nature of the road project, stream impacts are unavoidable; however, an effort has been made to reduce impacts by crossing the channels as close to perpendicular as feasible. Attachment E (Project Drawing 1 of 12) shows the locations of the proposed stream crossings for . the project. Proposed unavoidable impacts from the project include: . ¦ A 130-linear feet (If) culvert crossing of an unnamed tributary to Taggart Creek for the proposed Westport Road extension (Site A) ¦ A 265-1f culvert crossing of another unnamed tributary to Taggart Creek for the realignment of Mulberry Church Road (Site B) ¦ A 135-1f piping of an intermittent, unimportant aquatic function channel (Site C) ¦ 130-1f of inlet/outlet protection along the western bank of Taggart Creek associated with the . interchange improvements at Wilkinson Blvd. (Site D) Total project impacts consist of approximately 395 if of perennial stream enclosure, 130 If of . perennial stream inlet/outlet protection, and approximately 135 if of intermittent, unimportant aquatic function channel enclosure. As compensatory mitigation for these unavoidable impacts, the City of Charlotte proposes on-site mitigation in conjunction with utilizing mitigation credits from the Hope Park Branch Stream Restoration project (USACE Action ID No. 200130492). For on-site mitigation, the City of Charlotte will remove existing dual 96-inch culverts located on the section of existing Mulberry . Church Road that will be abandoned with the proposed road relocation and conduct 65 if of . stream restoration at this reach of Taggart Creek. At a proposed 1:1 mitigation ratio, this will allow for 65 if of stream restoration credits. -1- W - The City of Charlotte proposes to mitigate for the balance of the impacts (330 If) through the Hope Park Branch Stream Restoration project. This project is located in the same hydrologic unit as the channels being impacted as a result of the Billy Graham Parkway/Wilkinson Boulevard - Improvement project. The Hope Park Branch Stream restoration plan was approved by the USACE on March 13, 2001 and was implemented in the summer of 2002. The City has previously utilized 1,760 if of Hope Park's available 3,661 if of credit on separate City projects. • At a 2:1 mitigation ratio, this project will utilize 660 if of mitigation credits from the Hope Park - Branch project leaving a balance of 1,241 if of available credit. 2.0 Jurisdictional Stream Determinations Taggart Creek (Site D) and the unnamed tributaries to Taggart Creek (Sites A and B) were . determined to be perennial based on the presence of channel flow, stream substrate, and . macrobenthos (Attachment F). Taggart Creek at Site D scored a 40 out of a possible 71 points on the NCDWQ Stream Classification form and has a drainage area of approximately 524-acres. The tributary to Taggart Creek at Site B also scored a 40 on the stream classification form. The - other referenced tributary to Taggart Creek at Site A scored a 28 on the stream classification form. This tributary has a drainage area of approximately 154-acres. Photographs of these stream segments are included in Attachment H - Photos 2, 5 and 6. A secondary unnamed tributary to Taggart Creek, Site C, was determined to be an intermittent, unimportant channel due to its lack of macrobenthos, fish, amphibians, and other aquatic life. . This channel scored a 13 on the NCDWQ Stream Classification form. Photographs of this stream segment are included in Attachment H - Photos 3 and 4. 3.0 Agency Correspondence 3.1 Cultural Resources During the early planning phases of the project, a letter was submitted to the State Historic . Preservation Office (dated April 12, 1999) to determine the presence of any areas of architectural, . historic, or archaeological significance that may be affected by the proposed project. The North Carolina Department of Cultural Resources responded in a letter dated May 6, 1999, stating they had conducted a review of the project and found no properties of architectural, historic, or . archaeological significance that would be affected by the project and therefore had no comment on the proposed project. Correspondence from the North Carolina Department of Cultural Resources has been included in Attachment G. a a 3.2 Protected Species During the initial planning stages of the project, correspondence was forwarded to the North Carolina Department of Environment and Natural Resources - Natural Heritage Program to determine the presence of any federally protected species or critical habitats within the area of the . proposed project. Correspondence from the North Carolina Natural Heritage Program, dated April 28, 1999, stated that there were no records of rare species, high quality natural communities, or Significant Natural Heritage Areas (SNHAs) within a 1.0 mile radius of the . proposed project. Correspondence from the NC Natural Heritage Program has been included in Attachment G. . -2- 4.0 Proposed Impacts to Jurisdictional Waters Due to the linear nature of this project, the proposed Billy Graham Parkway/Wilkinson Boulevard Interchange Northeast Quadrant Improvements project will result in unavoidable impacts to jurisdictional waters of the U.S. Attachment E contains project drawings that detail each proposed impact and show a plan view, protection details, and a profile view of each stream crossing. No. 3 protection/ Rip-rap Perennial Existing Wilkinson Blvd. Each of the proposed culvert and pipe crossings will be buried one foot below the streambed to promote the safe passage of fish and other aquatic organisms and will convey all flow under normal stream conditions in accordance with the Wilmington District Regional Conditions. Field data collected at tributary to Taggart Creek in the vicinity of Site B indicates the bankfull measurements of the channel in the immediate upstream vicinity of the proposed culvert are as follows: 8' channel bottom width, 15' bankfull width, and an average stream depth 17. In accordance with the regional conditions, a 2-foot sill will be placed in one of the double 8'x 11' RCBCs proposed for Site B in order to maintain bank-full flows (or less) through the existing bank-full channel cross sectional area. The 2-foot sill (exclusive of the 1-foot embedment) would allow the second culvert to only receive flows exceeding bank-full. -3- . Field data collected at the UT to Taggart Creek in the vicinity of Site A indicates the bankfull measurements of the channel in the immediate upstream vicinity of the proposed culvert are as follows: 8' channel bottom width, 10' bankfull width, average channel depth 15 to 1.8'. . Hydraulic analysis was conducted on the proposed 8' x 6' RCBC and it was determined that this - design approximates the existing channel and will maintain existing bankfull flows as well as large storm event (the culvert was designed to accommodate the 50-year design flow). Consideration of twin 24" equalization pipes was evaluated as specified in the regional . conditions, but it was determined that these additional pipes provided no hydraulic benefit and would have a high potential for obstruction by floating storm debris and could become a future maintenance issue. r-_1 a 5.0 Compensatory Mitigation As compensatory mitigation for these unavoidable impacts, the City of Charlotte proposes on-site mitigation in conjunction with utilizing mitigation credits from the Hope Park Branch Stream . Restoration project (USAGE Action ID No. 200130492). For on-site mitigation, the City of . Charlotte will remove existing dual 96-inch culverts located on the section of existing Mulberry Church Road that will be abandoned with the proposed road relocation and conduct 65 if of stream restoration at this reach of Taggart Creek (Attachment E -Project drawing 1 of 12). At a . proposed 1:1 mitigation ratio, this will allow for 651f of stream restoration credits. The City of Charlotte proposes to mitigate for the balance of the impacts (330 If) through the Hope Park Branch Stream Restoration project. This project is located in the same hydrologic unit . as the channels being impacted as a result of the Billy Graham Parkway/Wilkinson Boulevard Improvement project. The Hope Park Branch stream restoration plan was approved by the USACE on March 13, 2001 and was implemented in the summer of 2002. The City has . previously utilized 1,760 if of Hope Park's available 3,661 if of credit on separate City projects. At a 2:1 mitigation ratio, this project will utilize 6601f of mitigation credits from the Hope Park Branch project leaving a balance of 1,241 if of available credit. 0 6.0 Cumulative Impacts 9 . The 401 Water Quality Certification Program (15A NCAC 2H. 0506(b)(4) and (c)(4) and the Isolated Wetland Permit Program (15A NCAC 2H..1300) require that the North Carolina Department of Environment and Natural Resources (NCDENR) - Division of Water Quality (DWQ) determine that a project "does not result in cumulative impacts, based upon past or . reasonably anticipated future impacts that cause or will cause a violation of downstream water quality standards." Cumulative impact is defined as those "environmental impacts resulting from incremental effects of an activity when added to other past, present, and reasonably foreseeable . future activities regardless of what entities undertake such other actions" (taken from 15A NCAC 1A which are the rules implementing the State Environmental Policy Act). Interchange improvement and relocation projects along existing roads in urban areas generally have a low potential for cumulative impacts since these facilities are already providing access to . properties, and in many cases these properties have already been developed or approved for development. Such is the case with the Billy Graham Parkway/Wilkinson Boulevard Interchange Northeast Quadrant Improvements project. Surrounding land uses in the study area are primarily -4- industrial and commercial. A majority of the undeveloped forested areas within the study area are located within the 100-year floodplain of Taggart Creek and its associated tributaries. Attachment A - Figure 2 contains a 2002 aerial base map of the study area showing the existing development in the area. A majority of the study area is currently zoned Light Industrial (I-1) with the remaining area zoned for Neighborhood Business (B-1) and Distributive Business (B-D). Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Stream crossings were as close to perpendicular as feasible. Culverts will be buried one foot below the bed of the streams. The minimal amount of rip-rap was utilized per compliance with erosion control design measures to protect and stabilize the inlet/outlet structures at Site D. In addition, the coring Page 7 of 13 technique used to add the second culvert avoids impacts to the stream channel versus the alternative of replacing the existing structure with a larger structure. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stn-ngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. As compensatory mitigation for these unavoidable impacts, the City proposes on-site mitigation in conjunction with utilizing mitigation credits from the Hope Park Branch Stream Restoration project (USACE Action ID No.200130492). For on-site mitigation, The City will remove existing 96-inch culverts located on the section of existing Mulberry Church Page 8 of 13 Road that will be abandoned with the proposed road relocation and conduct 65 If of stream restoration at this reach of Taggart Creek (Attachment E- project drawing 1 of 12). At a proposed 1:1 mitigation ratio, this will allow for 65 if of stream restoration credits. The City proposes to mitigate for the balance of the impacts (330 If) through the Hope Park Branch Stream Restoration project. This project is located in the same hydrologic unit as the channels being impacted as a result of the Billy Graham Parkway/Wilkinson Boulevard Improvement project. The Hope Park Branch stream restoration plan was approved by the USACE on March 13, 2001 and was implemented in the summer of 2002. The City has previously utilized 1,760 if of Hope Park's available 3,661 if of credit on separate City projects. At a 2:1 mitigation ratio, this project will utilize 660 if of mitigation credits from the Hope Park Branch project leaving a balance of 1,241 if of available credit. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Date: December 9, 1999 Location: On-site Purpose: Review US Army Corps of Engineers Permitting Requirements for Proposed Project Meeting Summary: A meeting with the US Army Corps of Engineers (Corps) was conducted at the site of the Wilkinson Boulevard/Billy Graham Parkway Interchange Improvements on December 9, 1999. The referenced meeting attendees were present. The meeting was held in the parking lot of the credit union located on Mulberry Church Road. The meeting began with an introduction of the project by Steve Blakley. The introduction included a discussion on status of design, corridor locations, project purpose and corridor design standards (number of lanes, limits of pavement, etc.). Preliminary concept plans that were prepared for public meetings were used to show specifics of the project. Subsequently, Jim Eisenhardt reviewed the findings of the Natural Resources/Water Resources Assessment of the corridor including a general discussion of the local ecosystems, areas of Section 404/401 jurisdiction and potential impacts based on the preliminary plans and corridors as shown. In summary, there are no wetlands in the subject corridor however there are two jurisdictional waters (streams) that cross the proposed corridor. The stream features include Taggart Creek and a tributary to Taggert Creek. The purpose of the meeting was twofold: 1. Obtain concurrence on the extent of Section 404 jurisdictional areas. 2. Obtain guidance from the Corps on permitting requirements. Regarding the concurrence on Section 404 jurisdictional areas, the Corps indicated that based on the information provided, they concur that there will be two crossings of jurisdictional waters. Since the corridor was not staked, the Corps did not want to field review the proposed crossing areas at this time. However, based on the photo graphs shown, the data presented and the Corps' familiarity with the area, Mr. Chapin believed Kimley-Hom's assessment was correct. Mr. Chapin indicated that he would provide written concurrence on the extent of jurisdiction once a formal request for jurisdictional determination was made to his office. He requested that the jurisdictional determination submission accompany any permit application that will be submitted. He also requested that a copy of the Natural Resources Assessment be attached to the application. At that time he may wish to review the specific crossings and final design. He would prefer to do this when the corridor location is staked in the field. Regarding permitting requirements, Mr. Chapin indicated that a Section 404/401 permit would be required for the two crossings. He agreed that the impacts would be located in an area above headwaters so that Nationwide Permit 26 would be available for this project. He also indicated that Nationwide Permit 14 would also be applicable. Mr. Chapin indicated that due to the limited impacts anticipated and the nature of the crossings, these nationwide permits would be applicable and likely approved. Once permit plans are prepared, final guidance on the applicable permit(s) can be provided. With respect to the Corps jurisdiction and permits, mitigation may not be required for this project if the impacts are minimized. The Corps could not provide guidance on North Carolina Department of Environment and Natural Resources (NCDENR) Section 401 conditions. It was recommended that once permit plans are prepared that NCDENR provide input as well. The information presented in this summary of meeting notes is accurate to the best of the preparer's knowledge.
