Winston and I met last Friday. We discussed his variance options for his property. He called this
morning and told me that he plans to request a Minor Variance for the property. Regarding the stream
and buffer violation, he plans to submit a restoration plan for Zone 1 with his variance request. He plans
to include replanting Zone 1 up to 320 trees/shrubs per acre (or more) and some minor grading to
stabilize the disturbed area, control post-construction stormwater and kick back the banks on the
channelized stream. He does not plan to propose a stream restoration plan for the channelization that
occured beyond the bank stabilization and buffer restoration. Given the size of the stream impacted and
the extent of channelization that occured. I recommend that the RRO does not require a stream
restoration plan beyond what I've stated above. I think that the stream will "heal" itself and trying to get
this single family home owner to work out a stream restoration plan may be too time consuming with
minimum benefits. Attached is a draft NOV. However, I'm guessing that he'll have his request and
restoration plan in before you'll be able to send it out.

Neuse River Buffer Rule (15A NCAC 02B .0233)

Dear Mr. & Mrs. Shade:
On September 4, 2003, Mr. Bob Zarzecki of the N.C. Division of Water Quality (DWQ) Wetlands/401 Unit
conducted an inspection of the subject property. The investigation revealed that protected riparian buffers,
perennial streams and wetlands had been impacted. The DWQ staff conducted a review of DWQ files for
compliance with DWQ regulations. As a result of the site inspection and file review, the following violations are
noted and merit your immediate attention:
1. Failure to obtain a variance from the Neuse Buffer Rule prior to conducting prohibited activities within the
protected riparian buffrers.
2. Failure to obtain a 401 Water Quality Certification prior to impacting a perennial stream and wetland.
3. Buffer, Stream and Wetland Impacts: clearing of vegetation and grading within approximately
0.16 acres of Zone 1 of the Neuse Riparian Buffers, channelization of approximately 120 feet of
perennial stream, and grading and minor filling of < 0.1 acres of wetlands
Neuse River Rlparlan Area Protection Rule & Violation
The impacted buffers are associated with surface waters within the Neuse River basin and are
classified by the DWQ as "C NSW (nutrient sensitive waters)". It was determined during the field
investigation that approximately 0.28 acres of buffers were disturbed, including 0.16 acres of disturbance
to Zone 1 of the protected riparian buffers. The buffers had been cleared of vegetation and graded for a
length of approximately 120 feet along the both sides of the stream.
The protected buffers are regulated under the Neuse River Basin: Nutrient Sensitive Waters
Management Strategy: Protection and Maintenance of Existing Riparian Buffers rules ("Neuse Buffer
Rule", 15A NCAC 02B .0233). These rules protect 50-foot riparian buffers along surface waters
(intermittent streams, perennial streams, lakes, ponds and estuaries) within the Neuse River Basin. The
50-foot buffer consists of two "zones". "Zone 1" is the inner 30 feet measured from the top of the stream
bank. Zone 1 is intended to be an "undisturbed" area. "Zone 2" is the outer 20 feet and is intended to be
a vegetated area with allowances for some vegetation management and grading. The stream located on
this property is shown as a stream on the Wake County Soil Survey map and is therefore subject to the
Neuse Buffer Rule. (You may obtain a copy of the Neuse Buffer Rule from our web site at
http://h2o.enr.state.nc.us/admin/rules/rbO40103.pdf or by calling this office.)
Clearing of vegetation and grading has occurred within Zone 1 of the protected riparian buffer.
Further, no record of a request for a no practical alternatives review, authorization certificate or variance
was received by the DWQ for these impacts to buffers. As such, the DWQ has determined that the
impacts that have occurred are in violation of 15A NCAC 02B .0233.
This Office requests that you respond, in writing, within ten (10) days of receipt of this Notice of
Violation. Your response must address the following items:

1. The disturbed areas must be stabilized as soon as possible (if you have not already done so) to
control streambank erosion and to prevent sediment from entering the stream. Please indicate how
you intend to stabilize or have stabilized the disturbed areas (e.g., install ground cover, seed,
sediment control devices, etc.).
2. Please discuss your efforts to abate impacts to riparian buffers.
3. Please discuss your plans to restore the riparian buffer. The plans should include at least replanting
Zone 1 (30 feet closest to the stream) at a density that will provide approximately 320 trees per acre
at maturity and should include at least two (2) different hardwood tree species. The plan should
include a map of the location of the proposed plantings and a planting schedule. You may wish to
review the Wetlands Restoration Program's "Guidelines for Riparian Buffer Restoration"
(http://h2o.enr.state.nc.us/wrp/pdf/buffers.pdf) prior to submitting this plan. In addition, you should
obtain or otherwise comply with any other required federal, state or local permits before you proceed
with the restoration including (but not limited to) Erosion and Sediment Control regulations
administered by the Division of Land Resources, Land Quality Section or delegated local government.
4. Finally, please explain why you did not secure the proper approvals for the impacts that have
occurred to the protected buffers.
The impacts associated with the driveway crossing (only) have been determined to be "exempt"
under the Neuse Buffer Rule and should comply with the conditions of General Water Quality Certification
No. 3402 and U.S. Army Corps of Engineers (USACE) Nationwide Permit No. 18 or 39. (Please contact
the USACE with any questions concerning compliance with these Nationwide Permits.)
401 Water Quality Certification / Stream & Wetland Violations
The disturbed stream is an unnamed tributary to Middle Creek (03-04-03, 27-43-15-(1)) and is
classified as "C NSW (nutrient sensitive water)". Mr. Zarzecki evaluated the stream just above the
disturbed area using the DWQ Stream Classification Form and calculated a score of 31 points. Crayfish,
small tadpoles and macrobenthic organisms where found to existing within the stream. Based on this
evaluation the DWQ had determined that the stream is a perennial stream. Any impacts to this stream
must comply with "Fresh Water Quality Standards for Class C Waters" (15A NCAC 02B .0212), all
applicable regulations within the "Neuse River Basin - Nutrient Sensitive Waters Management Strategy:
Basin Nutrient Reduction Goal" (15A NCAC 02B .0232), and DWQ 401 Water Quality Certification
regulations (15A NCAC 02H .0500).
Channelization of approximately 120 feet of perennial stream has occurred. Further, no record of a
request for a 401 Water Quality Certification was received by the DWQ for these impacts. As such, the
DWQ has determined that the impacts that have occurred are in violation of 15A NCAC 02B.0212 and
15A NCAC 02H.0500.
The disturbed wetlands are classified as "WL" (wetlands). Any impacts to them must comply with
"Wetland Standards" (15A NCAC 02B .0231) and DWQ 401 Water Quality Certification regulations (15A
NCAC 02H .0500). Grading and minor filling has occurred to these areas.
This Office requests that you respond, in writing, within ten (10) days of receipt of this Notice of
Violation. Your response must address the following items:
1. Please explain why the Division of Water Quality was not notified of impacts to the stream and wetlands.
2. Please explain why you failed to obtain the proper approvals for this activity.
3. Please explain how you intend to restore these resources and come back into compliance with DWQ
regulations.

The Raleigh Regional Office (RRO) of the DWQ has the option of sending a recommendation for
enforcement action to the Director of the DWQ. Please be aware that if the RRO chooses to act on this
option that you may be subject to an enforcement action with the possible assessment of civil penalties of
up to $25,000.00 per day, per violation. Please be advised that nothing in this letter should be taken as
absolving you of the responsibility and liability for any past or future violations.
