According to our rules (15A NCAC 2B .0259(8)), if final action is not taken within sixty (60) days, the Tar-Pamlico Buffer Authorization Certificate is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement of written authorization for the buffer rules for your plans to impact approximately 0.3 acres of Zone 2 of the protected riparian buffers to install the proposed sewer system as described in your request. As such, the buffer impacts are approved. However, please be aware that you must follow the plans as described within your request dated July 7, 2003 and all other conditions of the Tar-Pamlico River Buffer Rules, including but not limited to diffuse flow per 15A NCAC 2B .0259(5). You must also obtain or otherwise comply with all other required State, Federal and Local regulations, including but not limited to DWQ Standards (15A NCAC 02B .0100 and .0200). In the future, please complete and submit the DWQ Pre-Construction Notification (PCN) Application Form for buffer impacts associated with uses designated as "allowable" or "allowable w/ mitigation" within the Buffer Rule such as the activity that you proposed. The use of the form is the standard procedure when submitting for Authorization Certificates and may be submitted along with a 401 Water Quality Certification request. You may obtain a copy of this form from our website at the following address; http://h2o.enr.state.nc.us/ncwetlands/pcn.htmI . Please note that if additional impacts occur within the development beyond those requested within your application, this waiver is no longer valid and a new Authorization Certificate will be required. Also, please note that the DWQ reserves the right to conduct a compliance review of your protect to ensure compliance with the wetland and buffer rules. Also maps showing the delineated areas as referenced in the cover letter, and the original topo map prepared in 1991 for Area B showing the sewer easement as pre-existing. Exhibit 1 R: Steve Mitchell's original response letter dated June 10, 2003, explaining the calls on Areas A, B, and C. Per Steve's request before this letter was issued, we located the top bank of Stony Creek just to see exactly what zone we were impacting by the sewer line installation with either vested rights or if we had to permit. The result of the survey generated Exhibit 2. Exhibit 2: Cover letter and proposed sewer easement profile and top bank location per Steve Mitchell's request on Area B. Based on the attached information, Steve Mitchell has responded to Exhibit 2 by telling us our proposed sewer line encroachment in the pre-existing sewer easement dated prior 1991, which encroaches only in zone 2 is allowable as shown. We are to provide 3 copies of the information sent to him and forward to you for review. I have also attached the USGS quad map as well as the NRCS soil survey showing the property located on it. We have 3 areas I would like you to look at and make a call on whether the Tar-Pamlico Riparian Buffers exists in these areas. I have broken it out as follows; Area A: The entire tract of property labeled as the Autumn Ridge Site. This parcel of land contains 52-acres +/- and is bordered on the north by Hunter Hill Road, and bordered on the west by English Road. No blue line streams show up on either the USGS quad maps or the NRCS soils survey maps, which are attached. I am requesting a letter stating this 52-acre +/- tract has no Tar-Pamlico Riparian Buffers. Area B: This area extends from the end of an existing sewer manhole down a recorded sewer easement reserved for future extensions on our side of the creek. The easement crosses a parcel of land noted as parcel 5495 containing 6.45 acres. Our client wishes to extend the sewer up the creek along the original existing easement. It is my understanding if a project is located within a Tar-Pam buffer encroachment and was designed and approved/recorded before the rules came into affect it was exempt. This property belongs, I understand to the now defunct Enron Corporation and obtaining a new easement would be very difficult if not impossible at this time. Please review this and let me know if the existing easement is exempt from the Tar-Pamlico Buffers Rules. I have also included a topo map performed in 1991 of this area showing the 20' sewer easement, which was planned for extension to the North. The easement is recorded in DB 1319, Pg 450 of the Nash County Registry. Area C: This portion is comprised of parcel 8557, which contains 7.33 acres. From the soils and quad maps, this area contains a Tar-Pam Buffer only along Stony Creek. All other areas on this parcel appears to be exempt. Subject: Tar Pamlico River Basin Riparian Buffer Rules Y1?IER NBR 03-120 QUALITYSECVON Autumn Ridge Subdivision Hunter Hill Road, Rocky Mount Nash County Dear Mr. Joyner: I have reviewed the informatidn submitted for the project referenced by the Raleigh Regional Office as NBR 03-120. An evaluation of the stream features present on the property was completed to determine whether or not the site would require compliance with the Tar Pamlico River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code 15A:2B.0259. The features represented on the Nash County Soils and the Rocky Mount USGS topographic maps were evaluated. This parcel is a subdivision project and is separated into three parcels. This evaluation will address each one individually. Parcel A contains the bulk of the property (52+/- acres). It was determined that there are no features depicted on either the County Soil or the USGS maps and therefore, according the Rule, this portion of the property does not contain any streams that are subject to buffer protection and is not subject to the Buffer Rule. Parcel B contains 6.45 acres and may be subject to vesting. In order to obtain a vested rights opinion determination from the Attorney General's Office, you will need to submit materials to meet the following common law vested rights criteria: 1. Substantial expenditures or contractual obligations incidental to the project incurred prior to the change in the law; 2. Expenditures or obligations incurred in good faith; 3. Expenditures or obligations made in reasonable reliance upon governmental permits or approvals; and, 4. Detriment as a result of the amendment to the law. Parcel C, consisting of 7.33 acres, is bordered by Stony Creek and is subject to protection under the Buffer Rule. This letter addresses only those issues involving the delineation of the riparian area.
