Sullins, Deputy Director Division of Water Quality :o3---4 o -}o June 26, 2003 DWQ # 03-0764 Wake County Page 1 of 2 Beatriz Sotomayor 105 Kensbury Circle Cary, NC 27513 Subject Property: Lot 13 & 14, Royal Ridge SD, 114 Prince William Lane, Cary, NC MacGregor Downs Lake [03-04-02, 27-43-2.2, WS-III (water supply) NSW (nutrient sensitive)] On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B.0233) Dear Ms. Sotomayor: On June 23, 2003, at your request I conducted an on-site determination to review two streams located on the subject properties for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The features are labeled on the attached map initialed by me on June 24, 2003 as "A" and "B Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (RRO) had previously conducted an on-site determination of the streams. In your letter to the Director dated April 29, 2003, you requested an appeal of their determination as provided within 15A NCAC 02B.0233(3)(a). At your request, I conducted an appeal of their determination as stated above. During my review I evaluated the streams using the DWQ Stream Classification Form. I calculated the score for Stream "A" to be 22.25 points and Stream "B" to be 32.25 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". During my evaluation I observed a large amount of sediment within the streams located on the subject properties. The streams are aggrading due to the amount of sediment entering the properties from upstream sources. One potential source of this sediment could be coming from degraded, incised stream channels upstream of the subject properties. Based on my evaluation, the DWQ has determined that the streams labeled as "A" and "B" on the attached map are at least "Intermittent" and are subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the Regional Office. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the property. During my evaluation I observed potential hydrophytic plants, hydric soils and water that indicate potential wetlands and waters subject to Section 404 of the Clean Water Act on the property in addition to the two streams. You should contact the U.S. Army Corps of Engineers (USACE).Raleigh Regulatory Field Office at (919) 976-8441 to ensure compliance with wetland regulations. A search of the Wake County GIS database indicated that you have held the deeds on the properties since June 23, 1992. A search of the DWQ Wetlands/401 Unit's database did not result in any certifications or authorizations issued for the properties. Based on this information, the DWQ has determined that you have the option to apply for a variance from the buffer rule as per 15A NCAC 02B .0233(9) to develop your properties. It appears that a home could be built on Lot 13 without impacting the protected buffers or only impacting Zone 2 of the protected buffers with the a DWQ approved Minor Variance. It may be difficult to construct a home on Lot 14 without a Major Variance approved by the Water Quality Committee of the N.C. Environmental Management Commission. In addition, it appears that both lots contain wetlands subject to Section 401 and 404 of the Clean Water Act implemented by the DWQ and USACE. It appears that you may be able to construct a home on Lot 13 without impacting or with only minimal impacts to the wetlands. It may be difficult to construct a home on Lot 14 without impacting the wetlands. The DWQ, also, recommends that you identify the location of the streams and buffers located on the properties. You may choose to use a professional environmental consultant and surveyor. Once the boundaries of the streams, buffers and wetlands are identified on the properties you should be able to decide on what option works best to develop your properties. You may decide that combining the two lots into one lot will make it possible to construct a home on the newly combined lot without requiring DWQ or USACE authorization.
