APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Alphin:
You have our approval, in accordance with the attached conditions, to dredge in 0.823 acre of Public Trust Area and Estuarine
Waters in order to excavate a channel through a shoal located at the mouth of the Yeopim River and the Albemarle Sound in
Perquimans/Chowan Counties, as described in your application received by the Division of Water Quality on May 20, 2003. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be
downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when
issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S.
Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

mouth of Yeopim River and the Albemarle Sound.

NARRATIVE DESCRIPTION
The project site is a shoal area located 1900 ft ESE from Drummond Point, Chowan County in the
mouth of Yeopim River and the Albemarle Sound. The site is located- near the approximate
boundary of Chowan and Perquimans counties. The bottom in the general area of the proposed
development is sandy with water depths ranging from -4 ft to -8 ft below normal water level
(NWL). The applicant has constructed a 212 slip marina upstream of the development site that is
capable of accommodating vessels up to 60 ft long.
The water depths at the marina range from -6 ft to -8 ft. Vessels that use the marina access
Albemarle Sound via a marked channel that crosses the shoal area. The waters of Yeopim River
in this area are classified as SC and are closed to shellfish taking. The waters of Albemarle Sound
in this area are classified as SB and are open to shellfish taking.
DEVELOPMENT PROPOSAL
In order to provide safe navigation passage for vessels that use the existing marina, the applicant
proposes to excavate the shoal area that crosses the existing marked channel from Albemarle
Sound to Yeopim River. The applicant proposes to dig a channel through the shoal area to a water
depth of -7 ft below NWL.
The proposed channel will be approximately 747 ft long and 48 ft wide at the top of the channel
bottom and 30 ft wide at the bottom. The bottom material will be excavated from a barge by a
crane and the spoil will be placed in a scow and transported to a marine contractor's docking
facility adjacent to the Chowan River Bridge, US 17, Chowan County. The spoil will be off
loaded to dump trucks and transported to an upland disposal site known as the Waff Contracting
Mine Site, NCDENR DLQ Mining Permit #16-1, in Chowan County west of SR 1204.
ANTICIPATED IMPACTS
The development proposal will disturb approximately 35,856 sq ft of Public Trust Area and
Estuarine Water Areas of Environmental Concern. Approximately 2,374 cubic yards of bottom
material will be removed and placed at the upland disposal site.
Negative environmental impacts appear to be largely temporary in nature, and this project should
mitigate the frequent increase in water turbidity associated with transit of vessels with minimal
bottom clearance.
An environmental assessment has been completed and a finding of no significant impact was issued
on May 11, 2003 for this project.

Providing a defined channel will concentrate boat

water habitat from prop-wash. After construction this

material will be transported by barge to Waff
contacting shop, offloaded and then trasported to an
off-site disposal site in Chowan County (see attached
maps). The spoil will be de-watered on a barge at the
dredging site prior to transport.

Albemarle Plantation - Excavation of Channel"Within Yeopim River/Albemarle Sound
Perquimans County
The following is a Finding of No Significant Impact (FONSI) for the proposed Excavation of
Channel Within Yeopim River/Albemarle Sound by Albemarle PIantation in Perquimans County.
The proposed. development, as outlined in the Environmental Assessment (EA), includes dredging a
new channel within the Yeopim River to access the Albemarle Sound. The project need is to allow
for safe passage of water vessels accessing the Albemarle Sound. The proposed channel dimensions
include a 30-foot wide bottom, 48-foot wide top, with a depth of 7-feet below normal water level
(NWL). The new channel will extend along a 747-foot long area approximately 1,900 feet off of
Drummond Point, beyond the NWL, and would be oriented in a north-south direction; more
specifically, 303 feet from the existing navigation green daybeacon # 3, extending 444 feet north of
the same daybeacon. Dredge spoil disposal will be placed on an approved high ground area.
. This EA/FONSI are prerequisites for the processing of a Coastal Area Management Act
(CAMA) Major permit application by the Division of Coastal Management.
It is concluded that the proposed project will not result in significant impacts to the
environment provided that it can be permitted and subsequently developed consistent with the State
guidelines in the Rules of the Coastal Resources Commission and the avoidance/mitigation measures
contained in the EA. An Environmental Impact Statement (EIS) will not be prepared for this project.
