River Buffer Protection Rules (15A NCAC 213.0259) with ADDITIONAL CONDITIONS
Dear Mr. Tripp:
You have our approval, in accordance with the attached conditions, to place fill material within or otherwise impact 0.049
acres of waters to construct a boat ramp and pier and to impact approximately 2,200 square feet of protected riparian
buffers to install an gravel road with a turn-around as described in your application received by the Division of Water
Quality (DWQ) Wetlands/401 Unit on May 19, 2003. After reviewing your application, we have determined that the water
impacts are covered by the Division of Water Quality (DWQ) General Water Quality Certification Number 3351. This
Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE).
This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A
NCAC 2B .0259. In addition, you should get or otherwise comply with any other federal, state and local requirements
before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA.
Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below.
Conditions:
1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and
any subsequent modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
2. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the
protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A
NCAC 2B.0259(5).
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3351.

4. Buffer Mitigation Plan
You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to
compensate for impacts to the protected riparian buffers was calculated to be 4,500 square feet (sf) as required
under this Authorization Certificate and 15A NCAC 2B .0260(3). You shall submit a mitigation plan as required
under 15A NCAC 02B .0260. The mitigation plan shall be approved by the DWQ before any of the impacts
approved under this Authorization Certificate occur. Mitigation plans typically proposed include Buffer Restoration
or Enhancement [15A NCAC 02B .0259(9)] or Payment into the Riparian Buffer Restoration Fund [15A NCAC
02B .0259(7)].
(Please note that the mitigation is only being required for the buffer impacts associated with the proposed road
and turn-around area that are proposed within the protected buffers (within 50 feet of the normal water line
(NWL)). DWQ staff calculated this area to be approximately 800 sf of impacts to Zone 1 (30 feet from the NWL)
and 1,400 sf of impacts to Zone 2 (30 to 50 feet from the NWL). If these areas are not correct, then please
provide proof in writing of the correct areas of impact and the DWQ will adjust the amount of mitigation required
as necessary.)
If you do not accept any of the conditions of this Certification (associated with the approved water impacts), you may ask
for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Tar-
Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0259. If you have any questions, please

Project Setting
The Tripp Farm property is located off SR 1192 adjacent to the downstream (east) end of
the Crystal Beach Subdivision on the Pamlico River near the Blount's Creek Community in
Beaufort County, North Carolina. A prospective buyer is looking to buy the ±102 acre tract from
the owner, Richard W. Tripp, Jr., and develop it in the future as a subdivision. Prior to closing
on the deal, the buyer is requiring Mr. Tripp to obtain a permit for a pier and boat ramp on the
site.
The majority of the property is old agriculture fields vegetated with various upland grasses.
Several hardwoods are present adjacent to the shoreline of the Pamlico River in this area. The
shoreline is an approximately 15' to 30' wide sandy beach that ends at a ±30' bluff. The beach
area is littered with downed trees and stumps from previous storms. The downstream portion of
the property is a wooded area vegetated with mixed hardwoods and pines with a heavy
undergrowth of vines and woody shrubs. A natural drain is present in the wooded area sloping
down to the beach and stopping at the ±10' elevation. This is typical of the ridge and swell
system present on the south side of the Pamlico River. The project site has ±468' of shoreline
and is over 2,000' deep.
The project area is bordered on the upstream (west) side by developed property with the
same bluff and vegetation. The downstream (east) side is bordered by an undeveloped wooded
area of mixed hardwoods and pines with a dense underbrush of vines and woody shrubs. The area
of the ramp access and turn around is ±2' above the normal water level (NWL).
A portion of the proposed project is within the Tar-Pamlico River basin jurisdiction. The
Pamlico River is classified as SA-NSW by the Environmental Management Commission. The
Pamlico River is not open to shell fishing in this area.
Project description
The applicant proposes to construct a pier, boat ramp and access adjacent to the Pamlico
River. The pier will be ±6' wide by ±200' long including a ± 18' wide by ± 16' long T-head
and two ±6' wide by ±24' long step down platforms. The existing water depth at the end of the
proposed pier is approximately -3' below NWL. The proposed boat ramp is located on the
downstream (east) side of the pier will be 10' wide and extend 20' into the water. The existing
water depth at the end of proposed boat ramp is -1' below the NWL and the finished depth will be
-1' below the NWL. The applicant proposes no excavation other than that required too establish
the proper slope for the ramp. An approximately 18' wide by ±664' long gravel access road is
proposed to slope down to the new boat ramp. A 70' diameter turn around is proposed at the
bottom of the access road adjacent to the ramp and a portion of the turn around is located within
the EMC Tar-Pamlico buffer. A 15 space gravel parking area (±136' by ±255') is proposed for
the boat ramp and it will be located ±200' from the shoreline in the existing wooded area. The
applicant proposes to clean up the beach by removing the downed trees and stumps in an area
±23,400 ft2.

Anticipated impacts
The project as proposed will result in filling of ±200 ft2 of river bottom associated with the
placement of the boat ramp. The construction of the pier will result in the shading of t 1,920 ft2 of
river bottom. The project as proposed will result in localized turbidity as a result of the
construction activities. The project as proposed will result in the disturbance of ±84,804 ft2 of
high ground. A portion of the proposed project is within the Tar-Pamlico River Basin Area.

Dear Sir:
II-TEK Wilderness Construction, 5490 NC Highway 118,Grifton, NC 28530, proposes to
purchase and develop ±102 acres of land in Beaufort County, NC. The property is referred to as the
Tripp Farm, and is located at the north end of NC State Road 1102. The property is east of and
adjoins Crystal Beach Subdivision and has ±468 feet of waterfront on the Pamlico River.
HI-TEK Wilderness Construction and Ralph Sheffield are authorized to act as agent for the
Owner by the attached letter. It has become necessary to obtain the pier and boatramp permits prior
to the purchase of the property. Land development plans will be made after the land purchase.
The proposed development at this time consist of a shallow water boat ramp, a pier, and an
access road to the beach. The boat ramp is proposed to be 10 feet wide and extend into the water on
grade no more than 20 feet beyond the high water line. A 10 foot by 10 foot section is to extend
above the high water line. This ramp will be for launching small boats only, because there is no plan
to deepen the water or create any channel to or from the boat ramp. The sections of the ramp will be
10'x 10' by 6", reinforced concrete. The sections will be formed and poured on the beach above the
high water line and pushed into the water by a track hoe. The river bottom is to be excavated no
more than 6 inches and smoothed to allow the sections to be placed. All excavated soil is to be placed
on the beach or used as a part of the road turn-a-round.
. The pier is to be of treated wood with timber piles. The pier will be no wider than 6' and no
longer than 200 ` from the high water line. A platform will be built at the northern end and two lower
platform sections will be placed on each side of the pier to accommodate the loading and un-loading
of boats.
The access road is proposed to follow the natural contour of the land as much as possible and
have an area at the head of the boat ramp and pier for vehicular turnaround. The road is to be built
with the minimum soil disturbance and be surfaced with crushed rock.
During construction HI-TEK Wilderness Construction proposes to remove the fallen trees,
trash and stumps from the beach area. The trash and wood will be disposed of on site and have the
absolute minimum of soil attached to it.
