Wayne County
On April. 4, 2003, the Division of Water Quality (DWQ) Wetlands/401 Unit received your notice that you would like to
withdraw your request for a Minor Variance from the Neuse Buffer Rules (15A NCAC 26.0233) for the subject property. As
requested, the DWQ by copy of this letter is notifying you that your variance request has been withdrawn.
In addition, you requested a letter from the DWQ stating that you will be able to use the existing driveway and that it is not a
violation of the Riparian Buffer. Your request was sent to the Washington Regional Office (WaRO) of the DWQ to confirm
that the existing driveway is not in violation of the Neuse Buffer Rule. The WaRO has confirmed that the existing driveway
is not in violation of the Neuse Buffer Rule. Therefore, the DWQ has determined that the existing driveway is "exempt"from
the Rule as an existing use and that you may use it to access your property.
You should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your
project. Your project must, also, comply with all other conditions of the Neuse Buffer Rule including (but not limited to) the
diffuse flow condition. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream
buffers and must not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5).
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse
riparian buffer protection rule as described within 15A NCAC 213 .0233. If you have any questions, please Bob Zarzecki at

Mr. Zarzecki,
Per the telephone conversation with Delta Engineering this lot has an existing driveway
that has been the entrance to this property since before blue-lines came into effect. There
is an existing driveway tile there. We understand that we have to stay in the footprint of
the existing driveway. We are withdrawing our minor variance request since we have
access to this lot. However, our Wayne County Planner will need a letter stating that we
will be able to use this driveway and it is not a violation of the Riparian Buffer. Please
forward this letter as soon as possible. This is the last piece of information needed in
order to get final approval.

required to prepare a "preliminary finding" P'finding of fact as to whether the variance request meets the requirements of
15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and
intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request. Therefore, unless
additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B
.0233 and will place this project on hold as incomplete until we receive this additional information.

Please provide additional information on the history of this lot and subdivision. Specifically, was the lot platted prior to

2. Buffer Clarification
Please explain what you mean by the statement, "Technically the driveway will be 50 feet from the blue-line ditch." By
scaling off the maps provided with the application, it appears that the edge of the driveway will be 53 feet from the
center-line of the "ditch". Please note that the buffers should be measured from the "top of bank" of the ditch (not

3. Buffer Mitigation
Buffer mitigation will most likely be required for the proposed impacts to Zone 2 of the protected buffers at a 1:1.5 ratio.
Please provide a mitigation plan of how you intend to satisfy this mitigation condition. If the existing buffer does not
currently contain woody vegetation, then the DWQ will accept a mitigation plan that proposes planting native woody
shrubs and trees within these areas. The number of plants should be such that there are at least 320 trees per acre at
