Ross, Jr., Secretary Department of Environment and Natural Resources C Alan W. Klimek, P.E.; Director mow Division of Water. Quality 11111111110, April 15, 2003 Rich & Connie McGuinness 5005 Sunset Walk Lane Holly Springs, NC 27540-7823 DWQ Project No. 03-0269 County: Wake Page 1 of 2 Subject Property: McGuinness Property, Landscaping Project, Holly Springs, NC Sunset Lake (Middle Creek) [03-04-03, 27-43-15-(2), B NSW (nutrient sensitive)] APPROVAL of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0233(9)(b)] Dear Mr. & Mrs. Guinness: You have our approval, in accordance with the conditions listed below, to impact approximately 1,500 square feet (fe) of Zone 2 of the protected buffers to construct a retaining wall at the subject property as described within your application dated March 3, 2003 and additional information dated April 6, 2003. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition to this approval, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner(s) must be given a copy of this variance approval and are thereby responsible for complying with all conditions. For this approval to be valid, you must follow any conditions listed below. Conditions: No Zone 1 Impacts - No impacts (except for "exempt" uses as identified within 15A NCAC 213.0233) and the mitigation plantings shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. No impervious surfaces shall be added to Zone 1, unless otherwise approved by the DWQ. 3. Diffuse Flow - An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). No direct discharge of stormwater or piping through the buffer is allowed. 4. Buffer Mitigation / Additional Plantings - You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 2,250 square feet as required under this variance approval. The DWQ has determined that you may satisfy this mitigation requirement by planting at least sixteen (16) native woody trees within the retained portions of the protected buffers. You must ensure their survival for a period of a least five (5) years. You are required to replace any of these trees or shrubs that die within this five (5) year period. You are required to provide proof in writing that the trees and shrubs have been planted within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit and copied to the Washington Regional Office. If planting the required trees as described above is not feasible, then you may choose to propose a payment into the Riparian Buffer Restoration Fund administered by the Wetlands Restoration Program as per 15A NCAC 02B .0242(7) to satisfy the required mitigation area of 2,250 square feet. If you choose to North Carolina Division of Water Quality, WETLANDS / 401 UNIT 1650 Mail Service Center, Raleigh, NC 27699-1650 (Mailing Address) 2321 Crabtree Blvd., Raleigh, NC 27604-2260 (Location) 919-733-1786 (phone), 919-733-6893 (fax), http://h2o.enr.state.nc.us/ncwetiands/ Page 2 of 2 make this payment in lieu of the plantings, then send a written request (not payment) to the Wetlands/401 Unit and copy the Washington Regional Office. Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. As listed in the application, landscape plans for our property include restoring the riparian buffer on our property. All plantings for the buffer area have been selected from the approved plantings of the North Carolina Wetlands Restoration Program. There will be no changes to the creek/water way itself, or to the land in the 100-year flood plane. The landscape plan reflects only approved plantings to be planted in the designated areas. The landscape plan includes a wall to be built parallel to our home, and outside of the 100-year flood plane. The wall material will be treated timber, not to exceed 3 feet in height. The purpose of the wall is to control the erosion that has been occurring on our property. Please call if you should need additional information, 454-6537 (cell). Also, the proposed pond should be described here and illustrated on any maps included with this application. Pond to be created in (check all that apply): ? uplands ? stream ? wetlands Describe the method of construction (e.g., dam/embankment, excavation, installation of draw-down valve or spillway, etc.): Proposed use or purpose of pond (e.g., livestock watering, irrigation, aesthetic, trout pond, local stormwater requirement, etc.): Size of watershed draining to pond: Expected pond surface area: VII. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed.impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http•//h2o enr state nc us/ncwetlands/strmaide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreagellinear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Individually list all open water impacts (including lakes, ponds, estuaries, sounds, Atlantic Ocean and any other water of the U. S.) below: Open Water Impact Site Number (indicate on map) Type of Impact* Area of Impact (acres) (if Name applicable) Wate) Type of Waterbody (lake, pond, estuary, sound, bay, ocean, etc.) List each impact separately and identify temporary impacts. Impacts include, but are not limited to: fill, excavation, dredging, flooding, drainage, bulkheads, etc. Pond Creation If construction of a pond is proposed, associated wetland and stream impacts should be included above in the wetland and stream impact sections. Also, the proposed pond should be described here and illustrated on any maps included with this application. Pond to be created in (check all that apply): ? uplands ? stream ? wetlands Describe the method of construction (e.g., dam/embankment, excavation, installation of draw-down valve or spillway, etc.): Proposed use or purpose of pond (e.g., livestock watering, irrigation, aesthetic, trout pond, local stormwater requirement, etc.). Size of watershed draining to pond: Expected pond surface area: VII. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. We would like to repair the Riparian Buffer which has been washed out over the years In the process, we would like to construct a 3ft wall in zone 2 to level the grade somewhat Then we would be planting grass and native plants (in zones 1 & 2) to re establish the root subsystem and prevent the area from washing; out in the future We would partner with the Engineering Dept of Holly Springs to ensure that all aspects of the project would be environmentally `friendly' and ensure good engineering practices. Our house was built in 1996-97 and is within zone 2. The purpose of the improvements is to have some use of our property for walking and suitable landscaping. We are sensitive to the environment and will not enter the 100 year flood plane with this work. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us(wMlindex.htm. If use of the NCWRP is proposed, please check the appropriate box on page three and provide the following information: Amount of stream mitigation requested (linear feet): Amount of buffer mitigation requested (square feet): 2250 Amount of Riparian wetland mitigation requested (acres): Amount of Non-riparian wetland mitigation requested (acres): Amount of Coastal wetland mitigation requested (acres): IX.
