pond on an. unnamed tributary to Three Mile Branch and the associated mitigation, the
City of Concord has elected to withdraw its application. for the approval of the pond

proposed pond. City staff members believe that the construction of the pond would

Enclosed is the application of the City of Concord for Department of the Army
authorization and a State Water Quality Certification to construct a 0.81-acre pond on an
unnamed tributary to Threemile Branch, in Concord, Cabarrus County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by June 27, 2003, the District Engineer will deem
that waiver has occurred.

Executive Summary
The Concord Greenway Trail Pond Project is located in Concord, North Carolina, approximately
2,000 feet south of the Branchview Drive (SR-136) - Cabarrus Avenue intersection. The City of
Concord is proposing to build an approximately 0.81-acre pond within the 1.7-Mile Concord
Greenway Trail park. The primary purpose of this project is to provide the proposed greenway
trail with an aesthetic and recreational pond. The pond is also intended to treat storm water
runoff coming from Concord's highly impervious downtown district before it enters Threemile
Branch. The City of Concord has retained Carolina Wetland Services, Inc. (CWS) to provide
wetland permitting services for this project.
The results of the on-site field investigation conducted by CWS indicate that there are two
jurisdictional stream channels (Streams A and B) and three jurisdictional wetland areas
(Wetlands AA-CC) located within the project limits. On behalf of the City of Concord, CWS is
submitting a Section 404 Individual Permit Application with attachments for the construction of
the 0.81-acre pond.
In an attempt to conduct the project under a Nationwide Permit (NWP) and minimize impacts to
waters of the U.S., an alternatives analysis was conducted to determine the least damaging plan
for the project while still achieving the project's goals. The Proposed Site Plan avoids impacting
Perennial Stream B and Wetland AA. The Site Plan will impact approximately 510 linear feet of
Perennial Stream A and 0.064 acre of wetlands. To mitigate for these impacts, stream restoration
will be performed on upstream portions of Perennial Stream A.

Existing Conditions
The Concord Greenway Trail Pond Project is located in Concord, North Carolina, approximately
2,000 feet south of the Branchview Drive (SR-136) - Cabarrus Avenue intersection
(Attachment A - Figures 1 and 2). The City of Concord is proposing to build an approximately
0.81-acre pond within the 1.7-Mile Concord Greenway Trail park. The City of Concord has
retained Carolina Wetland Services, Inc. (CWS) to provide wetland permitting services for this
project (Attachment B). On behalf of the City of Concord, CWS is submitting a Section 404
Individual Permit Application (Attachment C) with attachments for the construction of the 0.81-
acre pond. The following section describes the existing conditions of the site.
Current Land Use
The project area is generally comprised of mature woods and maintained sewer line right-of-way.
Dominant canopy vegetation includes black willow (Salix nigra), sycamore (Platanus occidentalis),
river birch (Betula nigra), sweetgum (Liquidambar styraciua), box elder (Ater negundo),
green ash (Fraxinus pennsylvanica), mimosa (Albizia julibrissin), red cedar (Juniperus virginiana),
cottonwood (Populus deltoides), and red elm (Ulmus rubra). Dominant understory vegetation
includes Japanese stilt grass (Microstegium vimineum), Chinese privet (Ligustrum sinense),
blackberry (Rubus argutus), soft rush (Juncus effusus), Kentucky bluegrass (Festuca arundinacea),
poison ivy (Toxicodendron radicans), grape vine (Vitis rotundifolia), goldenrod (Solidago sp.),
false nettle (Boehmeria cylindrica), stiff-leaved aster (Aster linariifolius), Pennsylvania smartweed
(Polygonum pennsylvanicum), and various sedges (Carex spp.). The current land use of the
surrounding area is mostly residential.
Jurisdictional Delineation and Verification
From July 23-29, 2002, CWS's Gregg Antemann, Isaac Hinson, and Matt Faircloth delineated on-
site jurisdictional waters of the U.S.I using the U.S. Army Corps of Engineers (USACE) - Routine
On-Site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands
Delineation Manual.2 Routine On-Site Data Forms representative of Wetlands AA-CC and
adjacent upland areas have been included as Attachment D. Jurisdictional waters of the U.S. were

classified according to recent North Carolina Division of Water Quality (NCDWQ)3 and USACE
guidance. NCDWQ Stream Classification Forms and USACE Intermittent Channel Evaluation
Forms for Streams A and B have been included as Attachments E and Attachment F.
The results of the on-site field investigation indicate that there are two jurisdictional stream
channels (Streams A and B) and three jurisdictional wetland areas (Wetlands AA-CC) located
within the project limits (Attachment A - Figure 3). On-Site jurisdictional stream channels are
unnamed tributaries to, and a portion of Threemile Branch. Threemile Branch is part of the Yadkin
River basin (HU# 03040105)4 and is classified as "Class C" waters by the NCDWQ. Table 1 is a
summary of on-site jurisdictional areas.

Stream Classifications
Stream A is approximately 2,500 linear feet in length and generally flows east across the
greenway trail site to its confluence with Stream B (Attachment A - Figure 3). This stream
channel has a continuous bed and bank, substrate consisting of coarse sand to boulders, and a
four-foot average ordinary high water width (Attachments E and F - SCP 1). Stream A was
evaluated to be Perennial and scored 30.5 out of a possible 71 points on the NCDWQ Stream
Classification Form. A photograph of Stream A is included as Attachment G - Photograph A.
Stream B was evaluated to be Perennial and is a portion of Threemile Branch. Approximately
1.2 mile of Stream B flows southeast adjacent to the proposed greenway trail
(Attachment A - Figure 3). This stream exhibits a 25-foot average ordinary high water width,
channel substrate consisting of coarse sand to boulders, and a strong presence of small fish

(Attachments E and F - SCP2). Stream B scored 42.5 out of a possible 71 points on the
NCDWQ Stream Classification Form. A photograph of Perennial Stream B has been included as
Attachment G - Photograph B.
Wetlands
Wetlands AA and BB are approximately 0.086 and 0.040 acre in size, respectively. Both are
located within the sewer line right-of-way that parallels Stream A. Dominant vegetation includes
black willow (Salix nigra), soft rush (Juncus effusus), sycamore (Platanus occidentalis), box
elder (Acer negundo), and wool grass (Scirpus cyperinus). These wetlands also exhibit drainage
patterns and low-chroma soils (Attachment D - DPI). Photographs of Wetlands AA and BB
have been included as Attachment G - Photographs C and D.
Wetland CC is approximately 0.024 acre in size and is located adjacent to the confluence of
Streams A and B (Attachment A - Figure 3). Dominant vegetation includes Pennsylvania
smartweed (Polygonum pennsylvanicum), black willow (Salix nigra), soft rush (Juncus effuses),
and false nettle (Boehmeria cylindrica). Wetland CC also exhibits wetland hydrology and hydric
soil indicators (Attachment D - DP2).
Agency Correspondence
Cultural Resources
A letter was forwarded to the State Historic Preservation Office (SHPO) on November 25, 2002,
to determine the presence of any areas of architectural, historic, of archaeological significance
that would be affected by the project. In a letter dated February 13, 2003, SHPO stated that they
" ... are aware of no historic resources which would be affected by the project, and therefore,
have no comment on the undertaking as proposed" (Attachment H).
Protected Species
Letters were forwarded to the North Carolina Natural Heritage Program (NCNHP) and U.S. Fish
and Wildlife Service (USFWS) on November 25, 2002 to determine the presence of any
federally-listed or candidate endangered or threatened species or critical habitat located within
the project area. In letters dated December 2 and 3, 2002, the NCNHP and USFWS indicated
that they have no record of any federally-listed or candidate endangered or threatened species or

critical habitat located within the project area, and therefore have no comment on the proposed
project (Attachment H - Agency Correspondence).
Purpose and Need for the Project
The primary purpose of this project is to provide the proposed greenway trail with an aesthetic
and recreational pond. The Cannon Foundation has provided the City of Concord with a
$200,000 grant to help fund the $1.7 million Threemile Branch Greenway Trail project. This is
Concord's first greenway and was identified as a priority following public recommendations
from the Livable Community Blueprint. The Blueprint was a community driven process, which
identified park and recreation needs of the entire county. Many public comments included
requests for additional access to water for recreational opportunities. The City of Concord also
met with a representative from the North Carolina Division of Water Quality - Mooresville
office, and received preliminary approval for the pond
(Allen Scott, City of Concord, Pers. Comm.).
In addition to recreational uses, the pond is also intended to treat storm water runoff coming from
Concord's downtown district before it enters Threemile Branch, thereby providing a water
quality benefit to downstream waters. A lot of the area located upstream of the project was
largely developed prior to current storm water requirements. The drainage area upstream of the
proposed pond location consists of a large amount of impervious area from parking lots and other
structures, and does not currently include any online storm water treatment. The pond would
treat Stream A's 84-acre drainage area, which is comprised of approximately 45% impervious
cover (Attachment I - Figure 4). This project is representative of the city's efforts to combine
multiple public works projects in one area.
Avoidance and Minimization
Permitting
In an attempt to conduct the project under a Nationwide Permit (NWP), an alternatives analysis
was conducted to determine the least damaging plan for the project while still achieving the
project's goals. Several alternatives were considered during the planning stages for this project.

Nationwide Permit Nos. 18 (Minor Discharges) and 43 (Stormwater Management Facilities)
were both considered for this project. NWP No. 18 regulates minor discharges of dredged or fill
material into waters of the U.S. The current threshold limit for NWP No. 18 is 25 cubic yards of
discharged fill material and/or excavation. Alternative designs were discussed to limit
excavation and fill. Based on the existing elevation of the floodplain, excavation is necessary to
design a permanently wet pond with this drainage area. An existing sewer line dictates the
location of the dam, which will only raise the current grade by two feet to reduce overall land
disturbance within the forested riparian area. The preferred alternative plan proposes to excavate
and fill approximately 113 cubic yards6 of Perennial Stream A below the ordinary high water
mark, and therefore does not fall within the impact thresholds of NWP No. 18.
NWP. No. 43 regulates the discharge of dredged or fill material into waters of the U.S. for the
construction and maintenance of storm water management facilities (i.e. water treatment pond).
Construction of the proposed pond will include filling approximately 0.064 acre of wetlands for
site grading and approximately 161 linear feet of Perennial Stream A for the construction of a
dam. NWP No. 43 is inappropriate for this project because of a Wilmington District Regional
Condition that prohibits discharges into wetlands and perennial streams.
Alternative I - Offline Pond
This alternative was considered to be impractical based on the existing topographic constraints
and would require significant grading and tree removal along the proposed trail. Figure 3
illustrates the existing topography and property line. The proposed trail was designed to preserve
the majority of trees and natural vegetation. An offline pond would require significant grade
changes within the forested floodplain of Threemile Branch and would provide significantly less
treatment during normal flow and small storm events. Furthermore, an offline design would
likely lead to two parallel ponds on either side of Stream A, require significant alteration to
Stream A's bank cross-sectional area, and would not meet the project's primary goals for
recreation and aesthetics.

Alternative II - Preferred Alternative
The preferred alternative for this project is an online pond that will provide recreation, aesthetics,
and storm water treatment. Topography, drainage area, existing utilities, and property lines have
dictated the location of the pond. The size of the proposed pond is the minimum amount
necessary to adequately treat the 84-acre drainage area.
The Proposed Site Plan avoids impacting Perennial Stream B and Wetland AA
(Attachment J - Figure 5). Wetland AA is 0.086 acre in size and represents approximately 53%
of the on-site jurisdictional wetland areas. Stream B is a portion of Threemile Branch and is
intended to receive water quality benefits from the proposed pond.
Proposed Impacts to jurisdictional Waters
The proposed pond will result in unavoidable impacts to approximately 510 linear feet of
Perennial Stream A, 0.040 acre of Wetland BB, and 0.024 acre of Wetland CC. These impacts
have been determined utilizing an overlay of the Wetland Boundary Survey and the Proposed
Site Plan as illustrated in Attachment J - Figure 5. Table 2 is a summary of impacts to on-site
jurisdictional areas.

Approximately 301 linear feet of the upstream portion of Perennial Stream A will be excavated
to construct the proposed pond. An additional 161 linear feet of Stream A will be piped and

Proposed Compensatory Mitigation
To mitigate for impacts to on-site jurisdictional areas, stream enhancement will be performed on
upstream portions of Perennial Stream A. CWS is currently working with Site Solutions to
develop a Compensatory Mitigation Plan for enhancement of Stream A. In addition to stream
enhancement, the pond will be designed with a shallow littoral shelf. This littoral shelf will be
planted with native wetland species that provide food and cover for wildlife.

In your letter dated November 25, 2002, you requested our comments with regard to the subject project.
The following comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act, as amended (16 U.S.C. 661-667e), and Section 7 of the Endangered Species Act of
1973, as amended (16 U.S.C. 1531-1543) (Act).
Endangered Species. According to our records and a review of the information you provided, no listed
species or their habitats occur on the site. We concur with your determination that the proposed project
will not affect endangered or threatened species and their habitats. Therefore, we believe the
requirements under Section 7 of the Act are fulfilled. However, obligations under Section 7 of the Act
must be reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered, (2) this action is subsequently
modified in a manner that was not considered in this review, or (3) a new species is listed or critical
habitat is determined that may be affected by the identified action.
Erosion Control. Given the proximity of the project to aquatic environments, we want to emphasize
that stringent sedimentation- and erosion-control measures should be implemented prior to ground
disturbance and should be maintained throughout project construction.

THE CITY OF CONCORD, ATTENTION: MR. W. BRIAN HIATT, POST OFFICE
BOX 308, CONCORD, NORTH CAROLINA 28025, has applied for a Department of the
Army (DA) permit TO CONSTRUCT A 0.81 ACRE POND ON AN UNNAMED
TRIBUTARY TO THREEMILE BRANCH, IN CONCORD, CABARRUS COUNTY,
NORTH CAROLINA.
The following description of the work is taken from data provided by the applicant and from
observations made during an onsite visit by a representative of the Corps of Engineers. Plans
submitted with the application show that the City of Concord is proposing to construct a 0.81-
acre pond on an unnamed tributary to Threemile Branch in association with the Concord
Greenway Trail Park. The project area is currently wooded and dominated with mature
hardwood tree species. The construction of the pond will require deposition of approximately
113 cubic yards of fill material for the dam, excavation of stream channel in the pool area, and
subsequent flooding of the pool area. The project will result in a total impact to 510 linear feet of
a perennial, unnamed tributary to Threemile Branch and 0.064 acre of wetlands as a result of dam
fill, excavation and inundation, and riprap outlet protection. To offset impacts to aquatic
resources, the applicant has submitted a Conceptual Mitigation Plan, which includes a proposal
to enhance approximately 2,000 linear feet of an unnamed tributary to Threemile Branch
upstream of the proposed pond. Enhancement efforts would include the following: installation
of in-stream habitat structures, stream bank stabilization using bioengineering techniques, and
removal of invasive plant species within the riparian corridor. In addition, the applicant proposes
to establish a shallow littoral shelf within the proposed pond and plant it with native wetland
species. The purpose of the project is to provide the greenway trail with an aesthetic and
recreational pond. The pond is also intended to treat storm water runoff originating from the City
of Concord's downtown district before it enters Threemile Branch. The pond would treat runoff
from an 84-acre drainage area, which is comprised of approximately 45% impervious cover.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine the need for the applicant
to obtain any required State authorization. No Department of the Army (DA) permit will be
issued until the coordinated State viewpoint on the proposal has been received and reviewed by
this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality
(NCDWQ) has determined the applicability of a Water Quality Certificate as required by PL 92-
500.
This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C.
1344). Any person may request, in writing within the comment period specified in the notice,
that a public hearing be held to consider this application. Requests for public hearing shall state,
with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of
Historic Places for the presence or absence of registered properties, or properties listed as being
eligible for inclusion therein, and this worksite is *not registered property or property listed as
being eligible for inclusion in the Register. Consultation of the National Register constitutes the
extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of
the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that the proposed activity will
affect species, or their critical habitat, designated as endangered or threatened pursuant to the
Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of the probable impacts,
including cumulative impacts, of the proposed activity and its intended use on the public interest.
Evaluation of the probable impacts which the proposed activity may have on the public interest
requires a careful weighing of all those factors which become relevant in each particular case.
The benefits which reasonably may be expected to accrue from the proposal must be balanced
against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and
if so the conditions under which it will be allowed to occur, are therefore determined by the
outcome of the general balancing process. That decision should reflect the national concern for
both protection and utilization of important resources. All factors which may be relevant to the
proposal must be considered including the cumulative effects thereof. Among those are
conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values,
fish and wildlife values, flood hazards and flood plain values (in accordance with Executive
Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and
conservation, water quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit would not comply
with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding
sentence and any other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies
and officials; Indian Tribes and other interested parties in order to consider and evaluate the
impacts of this proposed activity. Any comments received will be considered by the Corps of
Engineers to determine whether to issue, modify, condition or deny a permit for this proposal.
To make this decision, comments are used to assess impacts on endangered species, historic
properties, water quality, general environmental effects and the other public interest factors listed
above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act
(NEPA). Comments are also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army (DA) permit will not be
made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives
State certification required by Section 401 of the Clean Water Act. The NCDWQ considers
whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of the Army (DA)
permit serves as application to the NCDWQ for certification.
Additional information regarding the Clean Water Act certification may be reviewed at the
offices of the Environmental Operations Section, North Carolina Division of Water Quality
(NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Water Quality (NCDWQ) plans to take final action in the
issuance of the Clean Water Act certification on or after May 23, 2003.
All persons desiring to make comments regarding the application for Clean Water Act
certification should do so in writing delivered to the North Carolina Division of Water Quality

The Division of Water Quality is requesting a letter of concurrence from the North
Carolina Wildlife Resources Commission (NCWRC) on the 401 Certification. These comments
are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et.
seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The proposed project is to build a 0.81 acre aesthetic pond on a perennial tributary of
Threemile Branch. Impacts will be 0.064 acres of wetlands and 510 linear feet of stream. The
applicant proposes to mitigate for these impacts through stream restoration activities in an
upstream channel. The pond is intended to also treat stormwater runoff coming from downtown
Concord.
The North Carolina Wildlife Resources Commission (NCWRC) continues to be
concerned about the fragmentation of aquatic streams and loss of forested areas as development
occurs in metropolitan areas. We appreciate the efforts to protect water quality by providing
stormwater detention and treatment. However, the NCWRC does not encourage the utilization of
existing waters or wetlands for wafer quality treatment facilities.
If stream impacts are necessary and unavoidable, we will not object to the project.
However, we prefer that Concord institute stormwater management using Low Impact
Development (LID) techniques instead of using waters of the United States for treatment
purposes. Information on LID techniques can be found at www.lowimp ictcievelopment_.org. We
prefer stream restoration instead of dams that fragment ecosystems. Stream restoration activities
should ensure a better greenway trail system providing that a natural undisturbed buffer is
provided. We routinely recommend 100' undisturbed forested buffers for perennial stream
ecosystems. Additionally, we do not believe that mitigation upstream of a pond provides
significant water quality or aquatic habitat values as the aquatic ecosystem is fragmented by a
dam which precludes aquatic migration.

If a 401 Certification is issued for the pond, we recommend that wet detention facilities
include vegetated littoral shelves for aquatic edge habitat as routinely required in 401
Certifications. In an effort to restore avian and terrestrial habitats as well as enhance
aquatic/detritus habitats in the detention facility, we recommend that the applicant provide for the
restoration of tree and shrub species similar to those currently found on the site. Native species
such as wild cherry, hickory and oak may be preferred due to structural concerns. Trees and
shrubs should be planted around and on the upper third of the detention structure, excluding the
dam. These will provide habitat benefits that offset those lost by partially restoring aquatic
habitats, reducing exposure of the water surface to sunlight (minimizing thermal pollution), and
providing summer and winter wildlife habitats. This practice should provide an aesthetically
pleasing green space. Essentially, these plantings could provide improved water quality and
habitat benefits within tile greenway.
Additionally, instead of using the typical fescue grasses, the upper interior and exterior of
the structure should be planted with the following mix:
Spring/Summer Mixture, May 1 - Sept. 15 Fall/Winter Mixture, Sept. 15 - April 30
Browntop millet 20 Ibs/a Rye grain 120 lbs/a
Kobe lespedeza* 20 Ibs/a Kobe lespedeza* 20 Ibs/a

Note: Mowing should be limited to early spring and should only occur as needed to prevent tree
growth on the dam or other areas. Mowing on a 2-3 year schedule should suffice. Lime and
fertilize as recommended by Natural Resources Conservation Service standards when planted.
Trees and shrubs (1 year bare root seedlings) should be planted randomly at a minimal
rate of 100 trees per acre on the top and upper portions of the structure and at a minimal rate of
150 per acre around the normal water elevation and littoral shelf area. The following list of tree
species may assist in providing habitat benefits:

15% of the reforestation. No more than 20% of the tree species will be of a single species. An 80%
success rate is acceptable over five years. Large or fast growing trees like Sycamore and Maple** may not
be appropriate around detention facilities.

The above recommendations should be considered for the multiple benefits that they can
provide to the community and to the environment. Initial costs should not be prohibitive and the
long-term maintenance costs should be reduced in naturalized areas.

and 31 can be moved or reconfigured to avoid the impacts to the stream during discharge.
Please revise the plans to avoid the impacts. Are they already existing?

Executive Summary
The Concord Greenway Trail Pond Project is located in Concord, North Carolina, approximately
2,000 feet south of the Branchview Drive (SR-136) - Cabarrus Avenue intersection. The City of
Concord is proposing to build an approximately 0.81-acre pond within the 1.7-Mile Concord
Greenway Trail park. The primary purpose of this project is to provide the proposed greenway
trail with an aesthetic and recreational pond. The pond is also intended to treat storm water
runoff coming from Concord's highly impervious downtown district before it enters Threemile
Branch. The City of Concord has retained Carolina Wetland Services, Inc. (CWS) to provide
wetland permitting services for this project.
The results of the on-site field investigation conducted by CWS indicate that there are two
jurisdictional stream channels (Streams A and B) and three jurisdictional wetland areas
(Wetlands AA-CC) located within the project limits. On behalf of the City of Concord, CWS is
submitting a Section 404 Individual Permit Application with attachments for the construction of
the 0.81-acre pond.
In an attempt to conduct the project under a Nationwide Permit (NWP) and minimize impacts to
waters of the U.S., an alternatives analysis was conducted to determine the least damaging plan
for the project while still achieving the project's goals. The Proposed Site Plan avoids impacting
Perennial Stream B and Wetland AA. The Site Plan will impact approximately 510 linear feet of
Perennial Stream A and 0.064 acre of wetlands. To mitigate for these impacts, stream restoration
will be performed on upstream portions of Perennial Stream A.

Existing Conditions
The Concord Greenway Trail Pond Project is located in Concord, North Carolina, approximately
2,000 feet south of the Branchview Drive (SR-136) - Cabarrus Avenue intersection
(Attachment A - Figures 1 and 2). The City of Concord is proposing to build an approximately
0.81-acre pond within the 1.7-Mile Concord Greenway Trail park. The City of Concord has
retained Carolina Wetland Services, Inc. (CWS) to provide wetland permitting services for this
project (Attachment B). On behalf of the City of Concord, CWS is submitting a Section 404
Individual Permit Application (Attachment C) with attachments for the construction of the 0.81-
acre pond. The following section describes the existing conditions of the site.
Current Land Use
The project area is generally comprised of mature woods and maintained sewer line right-of-way.
Dominant canopy vegetation includes black willow (Salix nigra), sycamore (Platanus occidentalis),
river birch (Betula nigra), sweetgum (Liquidambar styraciua), box elder (Acer negundo),
green ash (Fraxinus pennsylvanica), mimosa (Albizia julibrissin), red cedar (Junipertts virginiana),
cottonwood (Populus deltoides), and red elm (Uknus rubra). Dominant understory vegetation
includes Japanese stilt grass (Microstegium vin ineum), Chinese privet (Ligustrum sinense),
blackberry (Rubes argutus), soft rush (Juncus eff tsus), Kentucky bluegrass (Festuca arwndinacea),
poison ivy (Toxicodendron radicans), grape vine (Vitis rotundifolia), goldenrod (Solidago sp.),
false nettle (Boehmeria cylindrica), stiff-leaved aster (Aster llnarlifolius), Pennsylvania smartweed
(Polygonum petuisylvanicum), and various sedges (Carex spp.). The current land use of the
surrounding area is mostly residential.
Jurisdictional Delineation and Verification
From July 23-29, 2002, CWS's Gregg Antemann, Isaac Hinson, and Matt Faircloth delineated on-
site jurisdictional waters of the U.S.' using the U.S. Army Corps of Engineers (USACE) - Routine
On-Site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands
Delineation Manual.' Routine On-Site Data Forms representative of Wetlands AA-CC and
adjacent upland areas have been included as Attachment D. Jurisdictional waters of the U.S. were

classified according to recent North Carolina Division of Water Quality (NCDWQ)3 and USACE
guidance. NCDWQ Stream Classification Forms and USACE Intermittent Channel Evaluation
Forms for Streams A and B have been included as Attachments E and Attachment F.
The results of the on-site field investigation indicate that there are two jurisdictional stream
channels (Streams A and B) and three jurisdictional wetland areas (Wetlands AA-CC) located
within the project limits (Attachment A - Figure 3). On-Site jurisdictional stream channels are
unnamed tributaries to, and a portion of Threemile Branch. Threemile Branch is part of the Yadkin
River basin (HU# 03040105)4 and is classified as "Class C" waters by the NCDWQ. Table 1 is a
summary of on-site jurisdictional areas.

Stream A is approximately 2,500 linear feet in length and generally flows east across the
greenway trail site to its confluence with Stream B (Attachment A - Figure 3). This stream
channel has a continuous bed and bank, substrate consisting of coarse sand to boulders, and a
four-foot average ordinary high water width (Attachments E and F - SCPI). Stream A was
evaluated to be Perennial and scored 30.5 out of a possible 71 points on the NCDWQ Stream
Classification Form. A photograph of Stream A is included as Attachment G - Photograph A.
Stream B was evaluated to be Perennial and is a portion of Threemile Branch. Approximately
1.2 mile of Stream B flows southeast adjacent to the proposed greenway trail
(Attachment A - Figure 3). This stream exhibits a 25-foot average ordinary high water width,
channel substrate consisting of coarse sand to boulders, and a strong presence of small fish

Wetlands
Wetlands AA and BB are approximately 0.086 and 0.040 acre in size, respectively. Both are
located within the sewer line right-of-way that parallels Stream A. Dominant vegetation includes
black willow (Salix nigra), soft rush (Juncos effusus), sycamore (Platanus occidentalis), box
elder (Ater negundo), and wool grass (Scirpus cyperinus). These wetlands also exhibit drainage
patterns and low-chroma soils (Attachment D - DPI). Photographs of Wetlands AA and BB
have been included as Attachment G - Photographs C and D.
Wetland CC is approximately 0.024 acre in size and is located adjacent to the confluence of
Streams A and B (Attachment A - Figure 3). Dominant vegetation includes Pennsylvania
smartweed (Polygonom pennsylvanicum), black willow (Salix nigra), soft rush (Juncus effusus),
and false nettle (Boehmeria cylindrica). Wetland CC also exhibits wetland hydrology and hydric
soil indicators (Attachment D - DP2).
Agency Correspondence
Cultural Resources
A letter was forwarded to the State Historic Preservation Office (SHPO) on November 25, 2002,
to determine the presence of any areas of architectural, historic, of archaeological significance
that would be affected by the project. In a letter dated February 13, 2003, SHPO stated that they
" ... are aware of no historic resources which would be affected by the project, and therefore,
have no comment on the undertaking as proposed" (Attachment H).
Protected Species
Letters were forwarded to the North Carolina Natural Heritage Program (NCNHP) and U.S. Fish
and Wildlife Service (USFWS) on November 25, 2002 to determine the presence of any
federally-listed or candidate endangered or threatened species or critical habitat located within
the project area. In letters dated December 2 and 3, 2002, the NCNHP and USFWS indicated
that they have no record of any federally-listed or candidate endangered or threatened species or

-9 critical habitat located within the project area, and therefore have no comment on the proposed
project (Attachment H - Agency Correspondence).
Purpose and Need for the Project
The primary purpose of this project is to provide the proposed greenway trail with an aesthetic
and recreational pond. The Cannon Foundation has provided the City of Concord with a
$200,000 grant to help fund the $1.7 million Threemile Branch Greenway Trail project. This is
Concord's first greenway and was identified as a priority following public recommendations
from the Livable Community Blueprint. The Blueprint was a community driven process, which
identified park and recreation needs of the entire county. Many public comments included
requests for additional access to water for recreational opportunities. The City of Concord also
met with a representative from the North Carolina Division of Water Quality - Mooresville
office, and received preliminary approval for the pond
(Allen Scott, City of Concord, Pers. Comm.).
In addition to recreational uses, the pond is also intended to treat storm water runoff coming from
Concord's downtown district before it enters Threemile Branch, thereby providing a water
quality benefit to downstream waters. A lot of the area located upstream of the project was
largely developed prior to current storm water requirements. The drainage area upstream of the
proposed pond location consists of a large amount of impervious area from parking lots and other
structures, and does not currently include any online storm water treatment. The pond would
treat Stream A's 84-acre drainage area, which is comprised of approximately 45% impervious
cover (Attachment I - Figure 4). This project is representative of the city's efforts to combine
multiple public works projects in one area.
11 Avoidance and Minimization
Permitting
In an attempt to conduct the project under a Nationwide Permit (NWP), an alternatives analysis
was conducted to determine the least damaging plan for the project while still achieving the
project's goals. Several alternatives were considered during the planning stages for this project.

Permit Nos. 18 Minor Discharges) and 43 (Stormwater Management Facilities
Nationwide ( )
were both considered for this project. NWP No. 18 regulates minor discharges of dredged or fill
material into waters of the U.S. The current threshold limit for NWP No. 18 is 25 cubic yards of
discharged fill material and/or excavation. Alternative designs were discussed to limit
excavation and fill. Based on the existing elevation of the floodplain, excavation is necessary to
design a permanently wet pond with this drainage area. An existing sewer line dictates the
location of the dam, which will only raise the current grade by two feet to reduce overall land
disturbance within the forested riparian area. The preferred alternative plan proposes to excavate
and fill approximately 113 cubic yards6 of Perennial Stream A below the ordinary high water
mark, and therefore does not fall within the impact thresholds of NWP No. 18.
NWP. No. 43 regulates the discharge of dredged or fill material into waters of the U.S. for the
construction and maintenance of storm water management facilities (i.e. water treatment pond).
Construction of the proposed pond will include filling approximately 0.064 acre of wetlands for
site grading and approximately 161 linear feet of Perennial Stream A for the construction of a
dam. NWP No. 43 is inappropriate for this project because of a Wilmington District Regional
Condition that prohibits discharges into wetlands and perennial streams.
Alternative I - Offline Pond
This alternative was considered to be impractical based on the existing topographic constraints
and would require significant grading and tree removal along the proposed trail. Figure 3
illustrates the existing topography and property line. The proposed trail was designed to preserve
the majority of trees and natural vegetation. An offline pond would require significant grade
changes within the forested floodplain of Threemile Branch and would provide significantly less
treatment during normal flow and small storm events. Furthermore, an offline design would
likely lead to two parallel ponds on either side of Stream A, require significant alteration to
Stream A's bank cross-sectional area, and would not meet the project's primary goals for
recreation and aesthetics.

Alternative II - Preferred Alternative
The preferred alternative for this project is an online pond that will provide recreation, aesthetics,
and storm water treatment. Topography, drainage area, existing utilities, and property lines have
dictated the location of the pond. The size of the proposed pond is the minimum amount
necessary to adequately treat the 84-acre drainage area.
The Proposed Site Plan avoids impacting Perennial Stream B and Wetland AA
(Attachment J - Figure 5). Wetland AA is 0.086 acre in size and represents approximately 53%
of the on-site jurisdictional wetland areas. Stream B is a portion of Threemile Branch and is
intended to receive water quality benefits from the proposed pond.
Proposed Impacts to jurisdictional Waters
The proposed pond will result in unavoidable impacts to approximately 510 linear feet of
Perennial Stream A, 0.040 acre of Wetland BB, and 0.024 acre of Wetland CC. These impacts
have been determined utilizing an overlay of the Wetland Boundary Survey and the Proposed
Site Plan as illustrated in Attachment J - Figure 5. Table 2 is a summary of impacts to on-site
jurisdictional areas.

Approximately 301 linear feet of the upstream portion of Perennial Stream A will be excavated

Proposed Compensatory Mitigation
To mitigate for impacts to on-site jurisdictional areas, stream enhancement will be performed on
upstream portions of Perennial Stream A. CWS is currently working with Site Solutions to
develop a Compensatory Mitigation Plan for enhancement of Stream A. In addition to stream
enhancement, the pond will be designed with a shallow littoral shelf. This littoral shelf will be
planted with native wetland species that provide food and cover for wildlife.

The Natural Heritage Program has no record of rare species, significant natural communities, or
priority natural areas at the site nor within a mile of the site. Although our maps do not show
records of such natural heritage elements in the project area, it does not necessarily mean that
they are not present. It may simply mean that the area has not been surveyed. The use of Natural
Heritage Program data should not be substituted for actual field surveys, particularly if the
project area contains suitable habitat for rare species, significant natural communities, or priority
natural areas.

In your letter dated November 25, 2002, you requested our comments with regard to the subject project.
The following comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act, as amended (16 U.S.C. 661-667e), and Section 7 of the Endangered Species Act of
1973, as amended (16 U.S.C. 1531-1543) (Act).
Endangered Species. According to our records and a review of the information you provided, no listed
species or their habitats occur on the site. We concur with your determination that the proposed project
will not affect endangered or threatened species and their habitats. Therefore, we believe the
requirements under Section 7 of the Act are fulfilled. However, obligations under Section 7 of the Act
must be reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered, (2) this action is subsequently
modified in a manner that was not considered in this review, or (3) a new species is listed or critical
habitat is determined that may be affected by the identified action.
Erosion Control. Given the proximity of the project to aquatic environments, we want to emphasize
that stringent sedimentation- and erosion-control measures should be implemented prior to ground
disturbance and should be maintained throughout project construction.
