Klimek, P.E., Director Division of Water Quality May 27, 2003 Marshall Carlson 4009 Amyington Drive Charlotte, NC 28226 DWQ Project No. 03-0486 County: Catawba Page 1 of 2 Subject Property: Lot 97, Legrand Dr., Sherrills Ford, NC Lake Norman (03-08-32; 11-(75); WS-IV (Water Supply) B & CA (Critical Area)] APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Catawba River Buffer Protection Rules (15A NCAC 213 .0243) with ADDITIONAL CONDITIONS Dear Mr. Carlson: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact approximately 0.01 acres of waters and 165 square feet (fe) of protected riparian buffers for the purpose of installing the proposed rip-rap (River Rock) to stabilize approximately 165 feet of shoreline as described within your application dated March 26, 2003 except as modified below. After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3373 (GC3373). The Certification(s) allows you to use Regional General Permit No. 198200030 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Duke Power regulations and permits. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. No impacts (e.g., tree removal, grading, fill, etc.) shall occur to Zone 1 except for exempt activities and those directly required for the installation of the river rock and replanting of vegetation as described within your application. 2. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 213 .0243(5). No direct piping of stormwater runoff to the lake is allowed. 3. Grading (i.e., "slope and shape") of the shoreline within the approved impact areas shall be minimized to the greatest extent practicable. The lot appears to already have a gentle slope. Therefore, the DWQ does not see the need for grading along this section of the shoreline. Installation of the "matting and River Rock" is approved for this area. However, no grading shall occur within this area unless specifically approved by the DWQ. Michael F. Easley Governor William G. No fill (including but not limited to "back filling"), except for the approved river rock, shall be placed within Zone 1 of the protected buffers (unless otherwise approved by the DWQ). 5. Groundcover (e.g., mulch, pine straw, etc.) shall be placed on any disturbed land until such time that vegetation can be established. 6. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1508. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Catawba riparian buffer protection rule as described within 15A NCAC 2B .0243. After reviewing your application, we have determined that the water impacts are covered by the Division of Water Quality (DWQ) General Water Quality Certification Number 3373, This Certification allows you to use the Regional Permit No. 198200030 when issued by the US Army Corps of Engineers (USAGE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers as required under the Catawba River Buffer Protection Rules (15A NCAC 2B.0243). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) water supply regulations and Catawba Buffer Rules (15A NCAC 2R.0243). Also, this approval will expire when the accompanying 404 permit expiras unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application and additional information except as modified below. If you change your project, you must notify us and you may be required to send us a new application.• If the property is sold, the new owner must be given a copy of this Certification and is thereby responsible for complying with all conditions. No impacts (e.g., tree removal, grading, fill, etc.) shall occur to Zone 1 except for exempt activities and those directly required for the installation of she river rock and replanting of vegetation as described within your application. 2. Ali stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate-before discharging into the stream as identified within 15A NCAC 28.0243(5). No direct piping of stormwater runoff to the lake is allowed. 3. Grading (i.e., "slope and :shape") of the shoreline within the approved impact areas shall be minimized to the greatest extent practicable. Specifically, the middle lot appears to already have a gentle slope. Therefore, the DWQ does not see the need for grading along this section of the shoreline. Installation of the "matting and River Rock" is approved for this area. However, no grading shall occur within this area unless specifically approved by the DWQ. Additional grading as described within your application may occur_along the•steeper shorelines associated with the outer two properties. Impacts to any stream length in the Neuse, Tar-Pamlico, Randleman and Catawba River Basins (or any other river basins with Riparian Area Protection Rules (Buffer Rules] in effect at the time of application) requires written concurrence from DWQ in accordance with 15A NCAC 26.0200. Activities Iistod as "exempt" from these rules do not need to apply for written concurrence under this Certification. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the N®use, Tar-Pamlico, Randleman and Catawba River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B.0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best.management practices; 1 6. ' For sites.with buffer rules in effect at the time of application, forested vegetation removed from buffer areas for construction access purposes shall be re-established within the next growing season following construction of the project; 7. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 8. Rip-rap shall be installed waterward of bulkheads installed in freshwater lakes to ensure protection of aquatic habitat. Construction over wetlands shall be elevated at least three feet above any wetiands'and floating structures shall not rest periodically on the bottom; 9. 'Ali sediment Find erosion oontrol measures placed-in wetlands or waters sha(I ire removed and the- original grade restored after the Division of Land Resources has released the project; 10. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSi) or Record of Decision (ROD) is issued by the State Clearinghouse; 11. Piers and boat houses shall be constructed to provide for storage and removal of sewage rather than allowing raw waste or other sewage to be disposed directly into surface waters; 12. Additional site-specific conditions may be added to projects proposed with fill under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 13. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Regional Permit 198200030 or 198200079, whichever is sooner; 14. When written concurrence is required, the applicant is required to use the most recent version of the Certification of Completion form to notify DWO when all work included in the 401 Certification has been completed.
