The project shall be constructed according to your application received February 3, 2003 and any conditions listed below. This approval shall act as your Authorization Certificate as required within the Neuse River Area Protection Rules (15A NCAC 2B .0233). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. This approval is only valid for the purpose and design that you described in your application received February 3, 2003. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. If you do not accept any of the conditions of this authorization, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This authorization and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the "No Practical Alternatives" determination required in 15A NCAC 2B .0233(8). Subject: City of Raleigh Roadway Improvement Project - Wilmington Street Rehabilitation from Rush Street to bridge over Norfolk- Southern Railway - Wake County, North Carolina Action Requested: Neuse River Buffer Rule only, written approval / exemption. Dear Mr. Dorney: The City of Raleigh proposes to rehabilitate Wilmington Street in Raleigh from Rush Street to just south of the bridge crossing of Norfolk - Southern Railway. Improvements to the existing four-lane divided roadway include rehabilitating / resurfacing the existing pavement, adding curb and gutter and pedestrian sidewalks. The proposed project is approximately 1.5 miles in length. The project crosses two streams subject to the Neuse River Riparian Buffer Rules. Wilmington Street crosses Walnut Creek at approximate -L- Station 67+40 and Rocky Branch at approximate -L- Station 74+15. Both stream crossings are conveyed by existing multiple barrel, reinforced concrete box culverts. The existing box culverts are not required to be extended by this project. Unrelated to the Wilmington Street Rehabilitation project, the City's old E.B. Bain water treatment plant property located west of Wilmington Street and north of Walnut Creek is in plans for redevelopment. Stewart Engineering is preparing the development plans for a project known as Waterworks. For compliance with the City's Neuse River Stormwater Management Rules for nutrient removal, Stewart Engineering is proposing an extended wet detention pond just northwest of the intersection of Wilmington Street (-L-) and Fayetteville Street (-Y10-). The existing 15-inch pipe under Fayetteville Street at approximately -Y10- 12+40, which outlets directly into zone 1 of the Walnut Creek buffer, is too small and at too high of an elevation to properly convey flow from the detention pond proposed by Stewart Engineering. To emphasize, the replacement of the existing 15-inch pipe under Fayetteville Street with the 24- inch pipe is not due to any increase in impervious area from the Wilmington Street Rehabilitation Project. The existing 15-inch pipe would adequately convey the drainage from the Wilmington Street Rehabilitation Project. Project History with the Division of Water Quality Bob Zarzecki and Steve Mitchell, of the Division of Water Quality, received a full set roadway plans for the proposed project on November 1, 2002 for a preliminary review. Upon later correspondence, Mr. Zarzecki and Mr. Mitchell indicated the project had Neuse River Buffer impacts at the Walnut Creek and Rocky Branch crossings as stated previously. TGS Engineers met with Mr. Zarzecki and Mr. Mitchell on January 9, 2003 to discuss the project further. At that meeting, Mr. Zarzecki indicated to TGS Engineers that this project would be exempt from the Neuse River Buffer Rules because the project was impacting the riparian buffer with less than 40 linear feet (measured parallel to the stream) of new impervious area. Mr. Zarzecki also indicated that the project was exempt from the Pre-Construction Notification (PCN) application requirements, but he recommended that we submit the PCN with copies of the plans to obtain written approval from the Division of Water Quality. Additionally, in the vicinity of the Walnut Creek crossing there are two areas of existing pavement located within the buffer zones that are proposed to be removed during construction of this project. Area 1 is located west of -L- (Wilmington Street) and just north of -Y9- (Buff Street). Area 2 is located west of -L- (Wilmington Street) and southwest of -Y10- (Fayetteville Street). Mr. Zarzecki recommended, but did not require, that the City of Raleigh consider buffer zone mitigation / enhancement in these two areas to improve the quality of the buffer zone. The City of Raleigh has agreed to plant these two areas at a density of at least 320 trees per acre with a minimum of two native hardwood species per the Division of Water Quality's requirement for buffer zone enhancement. These two areas are denoted on sheet 13 of the plan sheets included. Area I is approximately 1842 square feet (0.04 acres) and Area 2 is approximately 804 square feet (0.02 acres). We are submitting seven copies of the Pre-Construction Notification Application and relative plan sheets to you for your review. The plan sheets included have the existing and new proposed impervious areas denoted through the buffer zones. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 5 of 8 IX. Environmental Documentation (required by DWQ) Does the project involve an expenditure of public (federal/state) funds or the use of public USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.htm1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
