By memo dated June 1, 2009 (attached), Cyndi Karoly - NCDENR-DWQ - 401
Oversight and Express Permitting Unit, requested that the Ecosystem Enhancement Program
(EEP) determine the amount(s) of Riparian Buffer Mitigation and/or Nutrient Offset Credit that
would be available from the subject site. As noted in the memo, the site was originally designed
to produce wetland mitigation, and had not previously been shown as providing any Riparian
Buffer Mitigation or Nutrient Offset Credit.
Based on a review of the file, all drainage ditches within the project boundaries have been
filled/plugged to restore wetland hydrology to the site. Since filled/plugged ditches are not
considered surface water conveyances, no Nutrient Offset Credit can be generated from this
project.
Based on this information, no Riparian Buffer Mitigation or Nutrient Offset Credit
will be listed on the Debit Ledger for this site.

The Daniels Farm 92 site was visited to evaluate the wetland restoration and enhancement. No indication was given that
buffer restoration was done on this site, and no indication of buffer restoration was noted in the Year 3 monitoring report.
The site is not listed as having a buffer component in the 4/13/09 version of the EEP on-line sites database. However, the site
is shown on a map of NCEEP buffer sites.
The stream on the site is a UT to the Tar River. This stream flows through an area consisting of mature woods; it is unclear if
any buffer credit is available within 200 feet of the stream.
The monitoring report states that the overall vegetation density was 418 trees per acre; however, it si not clear if any of the
monitoring plots are located within 200 feet of the stream. Trees on the site in general were small but appeared to be health.
The conservation easement was not marked at the site of the site visit,
ITEMS TO ADDRESS: In order to justify the 0.84 acres of buffer credit shown on the June 3, 2009 ledger, please
provide a total amount of buffer credit to be generated on the site. This will require verification of the easement
widths and planted area widths. Areas where existing woods are present cannot generate buffer credit.
