APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Messrs.:
You have our approval, in accordance with the attached conditions, to shade 0.0084 acre of vegetated wetlands
and estuarine waters and to fill 0.007 acre of estuarine shoreline in order to construct a pier with gazebo deck along the
shoreline of your commercial lot on- Currituck Sound in Duck, Dare County, as described in your application received by the
Division of Water Quality on November 17, 2003. After reviewing your application, we have determined that this fill is
covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed,
Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
1508 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

8. PROJECT SUMMARY: This project involves the construction of a 120-ft long by 6-ft
wide pier with a gazebo deck along the shoreline of a commercial lot located along the
Currituck Sound in the Town of Duck, in Dare County.

Proiect Setting
The application site is a 1.1-acre commercial tract located between the west side of Duck Road
(NC 12) and the Currituck Sound in the Town of Duck, Dare County. This site is being
developed for a `Wings' retail shop with a 13,400 square feet (approximate) parking area
adjacent to NC 12. Construction is presently underway.
The site elevation ranges from NWL to over 8 feet above NWL. The shoreline of this lot is
stabilized with a retaining wall that is an average of 10 feet landward of the shoreline. The
shoreline of this tract is over 200 feet in length, and is vegetated with an irregular shaped,
predominately coastal wetland fringe of Juncus roemerianus and Spartina cynosuroides with
some freshwater wetlands plant species.
The adjacent property to the north is developed with two small commercial strip shops and the
closest pier is located approximately 600 feet to the south. This structure extends approximately
200 feet into the Currituck Sound. The water depths of the Currituck Sound are typically
shallow. Water depths at this location, 100 feet offshore, are less than 2 feet deep. The water
bottom consists of predominately sand. Some areas of submerged aquatic vegetation were
observed near the shoreline and offshore during the application site visit. The NC Division of
Water Quality classifies the waters of the Currituck Sound as `SC' waters. The NC Marine
Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as
Estuarine Waters. The Coastal Resources Commission has designated these waters as Public
Trust Area and Estuarine Waters.
Proiect Description
The applicant proposes to construct a 120 feet long by 6 feet wide walkway and pier structure
with a 280 square feet eight-side platform at the end of the pier structure. The pier will
commence at the rear of the north side of the commercial building and extend across high ground
in a southwestern direction. Approximately one-half of the structure will be over high ground,
landward of the existing retaining wall. The pier' portion of the structure will extend
approximately 60 feet landward, and will cross over a small irregular area of coastal wetlands
(approximately 50 square feet). The pier will be utilized by employees and customers visiting
the retail store. The applicant has made no plan to provide any actual step-down access to the
waters of the Currituck Sound. The pier will be used only for observation. The structure will be
greater than 15 feet from any adjacent riparian neighbor and will not impact any adjacent
riparian access or public trust navigation. This proposal does not include any boat moorings or
slips. All additional development for the site was authorized by a CAMA Minor permit issued
by Dare County on December 22, 2002.

Anticipated Impacts
The proposed project will result in the shading of approximately 50 square feet of wetlands and
50 square feet of Public Trust Area of the Currituck Sound. The proposed structures would not
interfere with navigation or adjacent riparian access. The proposed structure does not include any
boat moorings or slips. So long as the pier structure is elevated at least 3 feet above any existing
vegetated wetland substrate, shaded wetland areas will experience little adverse impact from the
structure.
Some temporary increase in turbidity levels in the immediate vicinity of the proposed structure
will be experienced during piling installation.

This permit, issued on 12-23-02 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
PERMIT TO CONSTRUCT A RETAIL BUILDING
WITH MANAGERS APARTMENT ABOVE
PERMIT REQUIREMENTS
1. All proposed development and associated construction must
be done in accordance with the permitted work plat drawing as
originally submitted.
2. All construction must conform to N.C. Building Code requirements and
all other local, state and federal regulations.
3. Any change or changes in the plans for development, construction,
or land use activities will require a re-evaluation and modification of
this permit.
4. The amount of impervious surface areas shall not exceed 30%
of the lot area within the 75 ft. Area of Environmental Concern.
5. The 30 ft. buffer rule must be adhered to; reference 15A NCAC 7H.0209.
6. This permit does not authorize development in wetlands.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31, December 31, 2005
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

DUCK, NC
IG Holdings, LLC intends to construct a pier to a + 280 square foot gazebo at the
Duck, NC address referenced above. Construction of the pier and gazebo will
begin at the landward side of the existing bulkhead as shown on the site plan.
The pilings for the pier and gazebo will be water jetted in and the cross members
will be attached to the pilings to create the framework for the pier and gazebo.
The floor for the pier and gazebo will then be placed onto the framework.
Construction will be finalized, via foot traffic across the pier and gazebo, creating
a roof over the gazebo.
