After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAIMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicants propose to develop a 16-slip high ground marina by excavating into the shoreline along an existing basin. FIELD INVESTIGATION REPORT: ROBERT & JOHN DEATON/PAMLICO COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicants own two acres (two one-acre lots) of high ground off SR 1308, adjacent Shop Gut, at the foot of the high rise bridge near Oriental, in Pamlico County. Shop Gut is a tributary of Greens Creek near its confluence with the Neuse River. The tract is 264' in width and approximately 370' deep. The two back or southern corner markers of the property are located out in the basin of Shop Gut and abuts property owned by the Cox Family (a.k.a. Pecan Grove Marina). The upper reaches of Shop Gut has previously been excavated to create an approximate 400' X 100' boat basin (originally authorized by State Dredge & Fill Permit #25-76). The existing site conditions include a two-story residence with gravel driveway and a 45' X 35' high ground boat basin excavated back into the shoreline. A single uncovered boatlift is located within the smaller basin. The larger basin is proposed to be extended upstream, back into the Cox Family high ground (permitted by CRC Variance). The 104-slip Pecan Grove Marina is currently being developed with extensive excavation in progress. The current basin is approximately -4' below NWL, but the Pecan Grove Marina permit authorized the basin to be excavated to -T below NWL. The permit authorized the excavation to within 15' to 20' of the Deaton/Cox common property line located out in the basin. The Pecan Grove Marina group has also been authorized to maintain the access channel leading into the basin to a depth of -8' below NWL. The waters of Shop Gut are classified as SC NSW HQW. Shop Gut is a designated Primary Nursery Area and is closed to shellfishing. There are no jurisdictional wetlands on the property and no SAVs were noted during the field visit. Project Description The applicants propose to develop a 16-slip marina by using an excavator to cut back into their high ground property. The cut would extend approximately 40 to 45' into the property and would run the 264' width of the property. A 15' to 20' area between the permitted Pecan Grove Marina excavation project and the applicant's Project would need to be maintenance excavated to allow the applicant to connect the two projects. The bank would be stabilized by installation of a vinyl bulkhead along the entire property width. As proposed there would be sixteen 30' slips with four being 18' wide and twelve being 16' wide. Eight 4'-wide finger piers and 22 additional tie pilings would define the individual slips. A 6'-wide, 264'-long wooden dock/walkway is proposed landward of the bulkhead. FIELD INVESTIGATION REPORT: ROBERT & JOHN DEATON/PAMLICO COUNTY PAGE #3 Amenities to the marina would include a 24' X 32' two-story bath house and a 10- space parking lot. A gravel walkway would lead from the parking lot to both the bath house and dock. The existing septic system would be upgraded to a "pressure" type system. An Edson portable pumpout would be on site and the marina would enforce a closed head policy. No sewage discharge signs would be posted. Anticipated Impacts The project as proposed would directly affect approximately 6,855 fe of previously excavated estuarine waters within the Primary Nursery Area of Shop Gut. Such excavation would allow the applicant to connect his high ground marina to the area authorized to be excavated by the Pecan Grove Marina group.- Approximately 8,410ft2 of high ground would be removed as a result of the basin excavation. Approximately 760 yds3 of silt/sand type material would be removed below the NWL and approximately 3800 yds3 of material would be removed above the NWL. Approximately 15,000 fe of high ground located outside the Estuarine Shoreline AEC would be disturbed by construction of the "overburden & dredging spoil stockpile" site. Impervious area created by the construction of the gravel parking lot, walkways, and bath house would be approximately 4,338 fe. After project completion, the impervious percentage within the Estuarine Shoreline AEC would be less than 7%. The 260' long X 6' wide wooden walkway would be located landward of the proposed bulkhead on high ground. With the exception of the excavation activities, impacts to Public Trust Areas should be minimal. After project completion, only eight finger piers and 22 tie pilings would be located within the Public Trust Waters. The outer tie pilings would be located at or landward of the pre-project shoreline. Thus, impacts to navigation for traffic flowing into and out of the permitted Pecan Grove Marina should-be minimal. And I would expect that excavating into the bank some 40' for a length of 264' would have minimal if any negative impact to the flushing of Shop Gut. Likewise, it is difficult to say that adding 16 boats to an area permitted for 104 would make a significant impact to the water quality of Shop Gut. M.
