Please find enclosed an original Deed Notification which was requested by NCDENR with
respect to the stream buffers with the Runway 22 Safety Area and RPZ Improvements project
area (see your DWQ reference number, above), as well as a copy of the recording receipt
documenting that the instrument has been recorded in Book 2864, at Page 134, Craven County
registry.

COMPLIANCE WITH WETLAND & BUFFER REGULATIONS
CRAVEN COUNTY
In accordance with Title 15 A NCAC 2H .0500 as required by the North Carolina Department of
Environment and Natural Resources Division of Water Quality, the following DEED
NOTIFICATION shall be recorded in the Craven County Registry prior to the conveyance of the
property designated as "Protected Buffer Zone 1" and as "Protected Buffer Zone 2" on that
attached Schedule A, which said Schedule is specifically incorporated herein by reference for a
more perfect description of said buffer zones. Said Deed Notification shall apply to those
wetland & stream buffers in Craven County, North Carolina, as shown on said plans titled R/W
22 - Protected Buffers (the "Project") prepared by The LPA Group of North Carolina, P.A.,
dated August 2009 and attached hereto as Schedule A, which said buffers are located on property
known by the Craven County Tax Office as tax parcels # 7-103-092 (Deed Book 1129, Page 6,
Craven County Registry) and # 7-107-073 (Deed Book 1536, Page 118, Craven County
Registry).
DEED NOTIFICATION:
"A portion of this Project has been determined to meet the requirements for designation as a
wetland, stream, or protected stream buffer. Any subsequent fill or alteration of this area shall
conform to the requirements of the state rules, adopted by the State of North Carolina, in force at
the time of the proposed alteration. The intent of this provision is to prevent additional wetland,
stream or buffer filling or draining, to the property owner should not assume that a future
application for filling or draining would be approved The property owner shall report the R/W
22 Protected Buffers in any application pertaining to said rules. This covenant is intended to
ensure continued compliance with all rules adopted by the State of North Carolina and therefore
the State of North Carolina may enforce benefits. This covenant is to run with the land and shall
be binding on all parties and all persons claiming under them."
IN TESTIMONY WHEREOF, the County of Craven caused this instrument to be
executed as its act and deed by the chairman of its Board of Commissioners, attested by its
Clerk, and its seal to be hereunto affixed, all by the authority by its Board of Commissioners, as
of the day of October, 2009.
