Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 112 x 11 white paper. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are'provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) Any violation of these terms maybe subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile finfish populations, no excavation or filling will be permitted between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries and the Wildlife Resources Commission. l 2) Excavation shall not occur below normal water level. 3) A silt fence will be installed between any area to be excavated, graded or filled and any stream or wetland. 4) The riprap material used must be free from loose dirt or any other pollutant. The North Carolina Department of Transportation proposes to replace Bridge 8 over New Begun Creek on NC 34 near Weeksville in pasquotank County. The proposed action will involve replacing the existing bridge structure with a 105' bridge. This bridge replacement will take place on existing alignment, and local traffic will be detoured along existing roadways. The new structure will span from bank to bank. In order to facilitate a slightly longer bridge structure, NCDOT proposes that a small amount of material (75 cubic yards) be excavated from behind the present bridge abutments (see Permit Sheet 4 of 5). The new shoreline will be stabilized with class II rip rap. The proposed action will not lead to new encroachment into New Begun Creek. In replacing coastal bridges, consideration must be given for constructability, durability, future inspections and maintenance of these bridges. One criterion for bridge construction is that the bottoms of the reinforced concrete pile caps be a minimum of one foot above the mean high tide elevation. This enables contractors to pour concrete in dry conditions which provide for better quality control. It also will ensure that the caps will remain dry most of the time An Equal Opportunity I Affirmative Action Employer ,," .. - .)" following construction, thus reducing the rate of corrosion of the concrete and steel. A second construction consideration is that there be a minimum of three to four feet of underclearance to allow for access for inspections and maintenance repairs. With these criteria in mind, NCDOT is proposing to raise the elevation of the new bridge approximately 3 feet over the centerline elevation of the existing bridge. To facilitate the raised bridge, the roadway approaches must also ~e raised. The increased sideslopes associated with the raised roadbed will lead to the filling of 0.17 acres of wetlands on the northeast side of the bridge (see Sheets 2 of 5, 3 of 5 and 5 of 5). Most of the impacted wetlands occur in roadside ditches, although a slight encroachment into swamp wetlands will take place in the quadrant northeast of NC 34. No ditching is proposed outside of the toe of fill line. NCDOT has consulted with Division of Coastal Management (DCM) personnel in an effort to determine reasonable mitigation options, and there does not appear to be any feasible on-site or near-site mitigation options available. Therefore, to mitigate for the wetland impacts, NCDOT proposes debiting the Company Swamp Mitigation Bank using a 3:1 mitigation ratio (0.17 acre x 3 = 0.51 acres). DCM did request that every effort be made to minimize damages to a small area of herbaceous wetland vegetation adjacent to the proposed concrete sheet pile wall north of NC 34. With this request in mind, NCDOT will require that the construction contractor contact DCM personnel prior to initiation of construction to discuss how to minimize damage to this area. The proposed bridge replacement will benefit the public in several ways. First, a safer bridge crossing will be provided by replacing a inadequate bridge with a new one. Second, the higher underclearance of the proposed bridge will allow for easier passage by boating traffic. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. By copy of this letter, we are also requesting issuance of a 401 Water Quality Certification from the N.C. Upon completion of any work authorized by this general permit, all temporary fills will be completely removed and the area reestablished as a wetland. In such instances, a restoration plan will be submitted to the Wilmington District Engineer for approval. Information in the restoration plan will be in accordance with special condition i. below. g. All fills, temporary and permanent, must be stabilized to prevent erosion of fill material into adjacent waters or wetlands. h. In cases where new, permanent fill is to be established and an older fill (approaches, causeways, etc.) is no longer to be maintained as a roadway, the older fill shall be removed and the area reestablished as a wetland. In such instances, a restoration plan will be submitted to the Wilmington District Engineer for approval. Information in the restoration plan will be in accordance with special condition i. be;6w. / i. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site. In reviewing an activity, the Wilmington District Engineer will first determine whether the activity will result in more than minimal adverse environmental effects. For activities that are determined to have more than minimal impacts, compensatory mitigation will likely be required. To expedite the process, it is recommended that the applicant provide a mitigation plan with the request for authorization. Creation and restoration proposals will include, but are not necessarily limited to, a description of work, schedule of work, and monitoring plan, and be in accordance with currently approved District and/or Corps-wide mitigation guidelines. Mitigation banking may, in some situations, be considered acceptable compensation. j. If an easement to cross a state bottom is required by the North Carolina Department of Administration, State Property Office, such an easement will be obtained prior to proceeding with the work authorized by this general permit. k. Activities in all mountain trout waters must comply with all pH, temperature, and turbidity criteria established for such waters by the North Carolina Wildlife Resources Commission and/or the North Carolina Division of Environmental Management. Work that may result in the sedimentation of trout waters will generally be prohibited from November 1 to April 15 to avoid impacts to trout spawning. 1. Before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters (listed below), the applicant will obtain a letter of approval from the North Carolina Wildlife Resources Commission and furnish that letter to the Wilmington District Engineer. -5- 2. General Conditions. a. All activities authorized by thi~general permit that will involve the discharge of dredged or fill material into waters of the United States will be consistent with applicable water quality standards, effluent limitations, and standards of performance, prohibitions, pre-treatment standards, and management practices established pursuant to the Clean Water Act (33 U.S.C. 1413), and pursuant to applicable State and local law. Activities that will involve the discharge of dredged or fill material into waters of the United States will require that an applicant apply for and obtain a Water Quality Certification from the North Carolina Division of Environmental Management in accordance with Section 401 of the Clean Water Act before any work is authorized by this general permit. b. There will be no unreasonable interf~rence with navigation or the right of the public to riparian access by the existence or use of the activities authorized by this general permit. c. A permittee, upon receipt of writ~~n notice from the Wilmington District Engineer of failure to comply with the terms and conditions of this general permit, shall, within 60 days, without expense to the U.S. Government, and in such manner as the Wilmington District Engineer may direct, effect compliance with the terms and conditions or return the worksite to a pre-work condition. d. The permittee must make every reasonable effort to perform the authorized work in a manner so as to minimize any adverse impact on fish, wildlife, and natural environmental values. e. The permittee must perform the authorized work in a manner so as to minimize any degradation of water quality. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. f. The permittee will permit the Wilmington District Engineer, or his representative, to make periodic inspections at any time deemed necessary in order to assure that the activity is being performed in strict accordance with the Special and General Conditions of this general permit. g. This general permit does not convey any rights, either in real estate or material, or any exclusive privileges; and it does not authorize any injury to property or invasion of rights or any infringement of Federal, state, or local laws or regulations, nor does it obviate the requirement to obtain state or local assent required by law for the activity authorized herein.
