Dear Mr. Wilson:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.1 acres of wetlands or waters for the purpose of improving NC 197, as you described in your
application dated 18 July 1997. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Numbers 3108 or 3100. These certifications allow you to use
Nationwide Permit Number'26 or General Permit 031 when they are issued by the Corps of Engineers. In
addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us a
new application. If total wetland fills for this project (now or in tlte future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (b) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds
(T 15A:04B .0024). DOT shall follow guidance provided by DWQ in our 27 May 1997 letter for
minimizing damage to aquatic resources until a fmal policy is developed in conjunction with DOT.
If you do not accept any of the conditions of this. certification. you may ask for an adjudicatory
hearing. You must act within 60 days of the date lhat ~you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of.the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Baker:
We are providing a package of design sketches concerning wetlands that
will be impacted by this project. We have enclosed a completed N.C D.E.M.
application for your use.
We are planning on replacing or extending several pipes in unnamed
tributaries flowing across project into Elk Fork Creek which is a designated trout
stream. We will be working within the twenty five foot buffer zone of this stream
but will not be encroaching past the existing shoulder of roadway except for
ripraping roadway side of stream where stream is eroding roadway.
By copy of this letter we are seeking comments from N.C Wildlife
Resources Commission and Area Roadside Environmental Engineer concerning
this project.

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE
FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 26
(HEADWATERS AND ISOLATED WETLANDS)
This General Certification is issued in conformity with the
requirements of Section 401, Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of Water
Quality Regula:ions in 15A NCAC 2H, Section .0500 and 15A NCAC 2B
.0200 for the discharge of fill material to waters and adjacent
wetland areas which are above the headwaters or to wetland areas that
are not a part of the surface tributary system to interstate waters or
navigable waters of the United States (i.e., isolated wetlands) as
described in 33 CFR 330 Appendix A (B) (26) of the Corps of Engineers
regulations (i.e., Nationwide Permit No. 26). This Certification
replaces Water Quality Certification Number 2671 issued on January 21,
1992. This WQC is rescinded when the Corps of Engineers reauthorizes
Nationwide 26 or when deemed appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category
0: activity v:ill not violate applicable portions of Sections 301, 302,
303/ 306 and 3C~ of the Public Laws 92-500 and 95-217 if conducted in
a:cordance with the conditions hereinafter set forth.

Conditions of Certification:
1.
Pro~osed fill or substantial modification of greater than
one-third acre (0.135 ha) of wetlands. or waters for a
project requires a wyitten concurrence from the Division of
Water Quality;
Propcsed fill or substantial modification of equal to or
less than one-third acre (0.135 ha) of wetlands for a
project does not require written concurrence from the
Div:sicn of Water Quality as long as the project is in
compliance with all conditions of this General
Certification;
Proposed fill or substantial modification of any amount of
wetlands classified in accordance with 15A NCAC 2B
.0101 e) (7) as Unique Wetlands (UWL) shall require written
concu~rence from the Division of Water Quality in accordance
with :SA NCAC 2H .0506(e);
Proposed fill or substantial modification of greater than
150 linear feet (45.7 m) of streams for a project requires a
written concurrence with the Division of Water Quality. For
the purpose of this Certification, streams are defined as
blue or purple lines for permanent or intermittent streams
as shewTI on the most recent version of the USGS 1:24,000
topographic map or other site-specific data;
Proposed fill or substantial modification of less than or
equal to 150 linear feet (45.7 m) of streams for a project
does not require a written concurrence from the Division of
Water Quality as long as the project is in compliance with
all conditions of this General Certification. For the
purpose of this Certification, streams are defined as blue
or purple lines for permanent or intermittent streams as
showTI on the most recent version of the USGS 1:24,000
topographic map or other site-specific data;
That appropriate sediment and erosion control practices
which equal or exceed those outlined in the most recent
edition cf the "North Carolina Sediment and Erosion Control

Planning and Design Manual" or the NNorth Carolina Surface
Mining Manual" (available from the Division of Land
Resources in the DEHNR Regional or Central Offices) must be
utilized to prevent exceedances of the appropriate turbidity
water quality standard (50 NTUs in streams and rivers not
designated as trout waters by DWQ; 25 NTUs in all saltwater
classes, and all lakes and reservoirs; 10 NTUs in trout
waters);
7. All sediment and erosion control measures placed in wetlands
and waters shall be removed and the natural grade restored
after the Division of Land Resources has released the
project;
8. Additional site-specific conditions may be added to projects
with greater than one-third acre impact to wetlands or 150
linear feet of streams which are proposed under this
Certification in order to ensure compliance with all
applicable water quality and effluent standards;
9. Measures shall be taken to prevent live or fresh concrete
from coming into contact with waters of the state until the
concrete has hardened;
10. If an environmental document is required, this Certification
is not valid until a FONSI or ROD is issued by the State
Clearinghouse;
11. Concurrence from DWQ that this Certification applies to an
individual project shall expire en l3 December 1998 to
coincide with the expiration date of Nationwide Permit 26.
Non-compliance with or violation of the conditions herein set
ror:h by a specific fill project shall result in revocation of this
Certification for the project and may also result in criminal and/or
civil penalties.

The Director of the North Carolina Division of Water Quality may
require submission of a formal application for individual
certification for any project in this category of activity, if it is
determined that the project is likely to have a significant adverse
effect upon water quality or degrade the waters so that existing uses
of the wetland or downstream waters are precluded.
Public hearings may be held for specif:c applications or group of
applications prior to a Certification decision if deemed in the
public'S best interest by the Director of the North Carolina Division
of Environmental Management.

8. Concurrence from DWQ that this Certification applies to
an individual project shall expire three years from the
date of the cover letter from DWQ.
Non-compliance with or violation of the conditions herein set
forth by a specific fill project shall result in revocation of
this Certification for the project and may result in criminal and/or
civil penalties.
The Director of the North Carolina Division of Water Quality may
require submission of a formal application for individual
certification for any project in this category of activity, if it is
determined that the project is likely to have a significant adverse
effect upon water quality or degrade the waters so that existing uses
of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or
g~oup of applications prior to a Cercification decision if deemed

Dear Mr. Tolar:
You have our approval, in accordance with the attached conditions, to place nn material in 0.Q1 acres of
wetlands or waters for the purpose of improving NC 197, as you described in your application dated 26
February 1997. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3100 or 3108. This Certification allows you to use General Permit Number
031 or Nationwide Permit 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project. you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Offlce of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certincation and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

along NC. 197 in order to eliminate erosion of roadway in this area. This project
is located within the twenty five foot buffer zone of Elk Fork Creek which is a
