Box 5189 Horse Shoe, NC 28742 " f '{ 'i' Dear Mr. Swain: You have our approval, in accordance with the attached conditions, to place ml material in 0.01 acres of wetlands or waters for the purpose of paving SR 1203, as you described in your application dated 25 April 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Pennit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland mls for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local penn its before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stonnwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA pennit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which confonns to C~3pter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are fmal and binding unless you ask for a hearing. SR 1203 is a gravel road that we propose to clear, grub, grade, replace/extend pipes, and pave for a distance of 0,27 miles. Grading will be moderate. We are requesting permission to replace and extend pipes in live streams noted on plans at survey station 8+25. Pipes will be replaced using our standard method of pipe installation described in the erosion control plans, NCDOT "Best Management Practices for Protection of Surface Waters" and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion, By copy of this letter, we are asking Mr. Mark Davis, N.C. Wildlife Resources Commission, to comment directly to the Corps of Engineers concerning the Nationwide Permit request. Upon review for the Corps of Engineers we are requesting that Mr. Davis forward a copy to us (NCDOT) as well. By copy of this letter, we are also asking Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT), to comment directly to us on the above project. If SECTION 1042 RIP RAP MATERIALS 1042-1 PLAIN RIP RAP. Stone for plain rip rap shall consist of field stone or rough unhewn quany stone. The stone shall be sourid, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures Dr pavement is available, it may be used in place of stone provided that such use meets with the approval of ~e Engineer. However, the use, of broken concrete which contains reinforcing steel will not be pennitted. All sto~e shall meet the approval to the Engineer. While no specific gradation is required, the various sizes of the' stone shall be equally distributed within the required size range. The size of an individual stone particle will be determined by measuring its long dimension. Stone or broken concrete for Rip Rap shall meet the requirements of Table 1042-1 for the cla~c; and size distribution. All pipes shall be laid in accordance with Section 300 of the North Carolina Department of Transportation "Standard Specifications for Roads and Structures", July, 1995. Pipes will be installed in the dry wherever possible. Pipes laid in streams large enough to support trout will be installed six (6) inches below the stream bed to allow the bottom of the pipe to silt over so that trout movement will be over a natural stream bed.
