APPROVAL of 401 Water Quality Certification

Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to place fill material in acres of
wetlands or waters for the purpose of replacing Bridge 158 at Second Creek on SR 2370, as you described in
your application dated 23 November 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3114. This Certification allows you to use
Nationwide Permit Number 33 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project. you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local'
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal. Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

SUBJECT: Rowan County, Replacement of Bridge No. 158 over Second Creek on
SR 2370, Federal Aid Project No, BRZ-2370(1), State Project No,
8,2632601, T.I,P. No, B-2623, Action I.D, 199401101 for NWP 23 and
199702106 forNWP 33,
On December 5, 1994, the North Carolina Department of Transportation distributed a
Categorical Exclusion document for the subject project, requesting concurrence by the
Corps of Engineers for a Nationwide 23 permit status and the NCDEM for a Section 401
Water Quality Certification, The project was authorized by the Corps of Engineers on
March 6, 1995. The project is currently under construction. The contractor requested
permission to build a temporary construction bridge to provide access to both sides of the
creek during construction. The proposed temporary structure to be located approximately
20 feet downstream from the existing bridge is within the study corridor described in the
CE, No jurisdictional wetlands or federally protected species were found within the study
corridor.

This information and a sketch of the proposed structure was faxed to the Corps of
gl ers, Asheville office by the Department of Transportation Resident Engineer in
Salisb ry. Acting on that information the Corps of Engineers issued a Nationwide Permit
33 (A tion LD. 199702106) on November 13, 1996, We hereby request a 401 General
Ce fication be issued by the NC Division of Water Quality for the proposed temporary
onstruction access bridge,

The bridge will be a 21-inch steel beam structure 51 feet long and approximately 14 feet
wide with timber decking (sketch attached). The approaches will be 20 feet or less in
length on both ends and will be constructed with timber mats and rip-rap. The temporary
bridge will be in place until June 1997 and will be totally removed from the site when the
project is completed. All conditions of the Nationwide 33 pernlit will be met.
