Dear Mr. Vick:
On April 2, 1997, you applied to the N.C. Division of Water Quality (DWQ) for a 401 Water Quality
Certification to impact 1.27 acres of wetlands or waters for your project 1-85 from US 29-601 to SR 1500
in Rowan County. Your project has been forwarded to Mr. Mike Parker 704-663-1699 of DWQ
Mooresville Regional Office for review. This review will likely require an on-site inspection prior to the
approval, modification or denial of your project site. If you have sent additional infonnation to the U.S.
Army Corps of Engineers conceming this project. please be certain that our staff have copies of this
material so we can use it in our process in making a decision.
According to our preliminary, in-house review since you propose to disturb greater than one acre of
wetlands, it is likely that compensatory mitigation will be required by DWQ for this project as described in
15A NCAC 2H .0506 (h) unless work can be completed by December 13, 1998, under your existing pennit
issued for this project on August 30, 1994. Our Regional Office staff can make this decision during their
site visit. If adequate mitigation is required but not provided, this project will likely have to be denied.
Also if a mitigation plan is required, we will place this project on hold until its receipt in our Central
Office. Please call me at 919-733-1786 to discuss these matters if necessary. Until a mitigation plan is
provided, this application is considered to be incomplete and our processing time will not start.
We recommend that you not impact any wetlands or waters on your project site until a 401 Water
Quality Certification has been issued from Raleigh, The issuance of a Corps of Engineers 404 Penn it does
not mean that your project can proceed. According to the Clean Water Act. the 404 Pennit is not valid
until a 401 Certification is also issued. If DWQ staff observe impacts which are not allowable, you will be
required to remove the fill and restore the site to its original condition. I can be reached at 919-733-1786 if
you have any questions about the 401 Certification process.

OEM Project No. 94540.
The North Carolina Department of Transportation (NCOOT) proposes to widen
existing 1-85 from US 29-601 to just north ofSR 2120 in Rowan County, and is
preparing to begin construction of this project. The Corps of Engineers authorized this
project under the provisions of Nationwide Permit No. 26 on September 30, 1994 (COE
Action 10 No. 199404006). The N.C. Division of Water Quality (formerly the Division
of Environmental Management) authorized this project using General Water Quali~y
Certification No. 2671 on June 15, 1994 (DEM Project No. 94540).
Recently, there have been significant changes in both the Nationwide Permit and
General Certification programs, especially regarding Nationwide Permit No. 26. The
NCOOT requests reauthorization of this project pursuant to these changes. Enclosed you
will tind a copy of the original permit application dated June 6, 1994 which describes the
project impacts and includes drawings of the two impact sites. Please review this project
for authorization under Regional General Permit No. 31.

Additional auxiliary lanes are proposed at various locations.
The interchanges and service roads along the project will be
revised to accommodate the proposed widening. Inadequate
structures along the project will be replaced to conform to
current design standards.

section of 1-35 between CS 29-601 and SR 1500. lhis section
of the roadway will have a 70-foot median to allow for the
future widening mentioned above. The proposed improvements
will involve wetland impacts at twO sites along the project
which require notification to your agency.

The first site is located at the intersection of Mt.
Hope Church Road (SR 1505) with 1-35. The impact at this
location is necessary because Delta Street (SR 2637) will be
relocat~d to accommodate the widening of 1-85 (See sheet 2).
The impact involves filling wetlands and extending a 10' x
10' concrete culvert. This will affect a total of 0.60 acres
of ,wetlands.

The second site is north of the first site. where 1-85
crosses a tributary of Town Creek (Sheet 5). The exist~ng
culverts will be extended at this site. Fill will also be
placed in wetlands adjacent to the existing roadway fill. to
accommodate the widened fill slope. This will affect 0.67
acres of wetlands.
