Box 25201 Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval, in accordance with the attached conditions, to place temporary fill in 0.05 acres of waters for the purpose of consuucting bridge No. 39 over French Broad River on US 276, as you described in your application dated 19 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3114. This Certification allows you to use Nationwide Pennit Number 33 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland f1l1s for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local pennits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stonnwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA penn it expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are fmal and binding unless you ask for a hearing. The Corps of Engineers ( E) has uthorized the replacement of the referenced bridge under a Section 404 Natio wide":) permit (COE Action 10 199404617). Since issuance of the permit for the proJ ,changes in the project construction plans have been made. The proposed project is scheduled to be let to construction in May 1997. Present construction plans not only include those documented in the Categorical Exclusion for the subject project but also now involve the construction of a temporalY causewa~ in the French Broad River. The temporary causeway is necessary in order to construct the new bridge crossing of the French Broad River. Temporary impacts to the surface waters from the temporary causeway total 0.05 acre. Construction plans detailing the proposed causeway are depicted in the attached drawing. It is anticipated that th ov mentioned activities will be authorized under a Section 404 Nationwide Per It 33 ( emporary Construction Access and Dewatering). The DOT is therefore reques 1 1 issuance of a nationwide permit authorizing the construction of the causeway. Along with a copy of this letter, a copy of the Categorical Exclusion is being provided to the US Fish and Wildlife Service (FWS). The CE addresses the issue of tcderally-protectcd species occurring in Transylvania County. Since completion of the @ 2 CE, no new species have been added to the Transylvania listing although the status of two species has been upgraded. The DOT has therefore contacted the FWS and fultilled Section 7 of the Endangered Species Act. Enclosed is a project site map, construction drawings, as well as a completed preconstruction notification form for a Nationwide Permit 33 and General 401 Water Quality Certification. Since this project occurs in a designated trout county, the DOT is also requesting that the NC Wildlife Resources Commission (WRC) provide comments to the COE in regard to this permit application. Based on earlier comments from the WRC on previously applied for Nationwide Permits 6 and 23 applications, the DOT commits to in-stream construction work from July 1 to November 1 (see attached letters from the WRC). By copy of this letter, the DOT also asks that the appropriate General 401 Water Quality Certification be issued by the Division of Water Quality for this construction work. On October 13, 1992, Robin Stancil of our staff met with North Carolina Department of Transportation (NCDOTl staff for a meeting of the minds concerning the above project. We reported our available information on historic architectural and archaeological surveys and resources along with our recommendations. NCDOT provided project area photographs and aerial photographs at the meeting and for our use afterwards. Based upon our review of the photographs and the information discussed at the meeting, we offer our preliminary comments regarding this project. 3C: We feel that Bridge No..J.?'6uthe only structure over fifty years of age in the area of potential effectuis not eligible for listing in the National Register since it is a type of concrete bridge prevaltnt throughout the state. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources should be assessed prior to the initiation of construction activities. Having provided this information, we look forward to receipt of either a Categorical Exclusion or Environmental Assessment which indicates how NCDOT addressed our concerns. I have'reviewed information provided by the applicant, and I am familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.l and the ?~sh and Wildlife Coordination Act:. (48 Stat. 401. as amended; 16 U.S.C. 661-667d). The applicant:. propcses to condu~': foundation test:. borings in the subject stream bed, requiring the operation of testing equipment and/or vehicles in s~rfac~ wacers. We are concerned about potential sedimentation impacts to trout and other aquatic resources in this drainage, and instream phases of actual bridge construction on this project:. should be scheduled between July 1 and November 1 to avoid impacts on gamefish reproduction. However. we do not object to issuance of a 404 permit for the proposed test borings, provided that the following conditions be placed on the subject permit: 1. All mechanized equipment operated in or near surface waters should be regularly inspected and maintained to prevent contaminating of stream waters from fuels, lubricants, or other materials. 2. Stringent erosion control measures should be implemented and maintained throughout construction. In particular, care should be taken to quickly re-vegetate any streambank areas disturbed by NCDOT B-2641 permit Page 2 December 12, 1994 equipment accessing the stream bed.
