SOUTHEAST REGION

Mr. John Dorney
Department of Environment,
Health and Natural Resources
Division of Water Quality
4401 Reedy Creek Road
Raleigh, NC 27607
Dear Mr. Dorney:
G -
?Z.41
Chambers Waste Systems of North Carolina, a subsidiary of Allied Waste Industries,
received your letter dated December 2, 1997, regarding the proposed landfill construction
project near Brown and Pinch Gut Creek in Anson County. In response to the
Departments request, the following table has been prepared which depicts the steam
impacts in terms of length. The segment numbers correspond to the attached plan, where
they are highlighted in red.
Segment number Length (feet)
1 530
2 990
1080
4 450
5 950
6 790
As I stated in our phone conversation, these streams are intermittent streams that flow
during precipitation events. They drain the upland areas to the low areas near Brown and
Pinch Gut Creeks. Allied has not submitted a mitigation plan until such time that the site
can be visited by the Department to determine if a mitigation plan is necessary for these
areas. Should a plan be necessary, Allied would like to meet with the Department to
determine the best possible type of mitigation that will fit this area.

DWQ Project #970972
Anson County
On November 17, 1997 the Division of Water Quality (DWQ) was notified by receipt
of your application regarding your plan to fill wetlands for the purpose of constructing a
landfill at Brown and Finch Gut Creek in Anson County. Approval from DWQ is required
to disturb these wetlands. The application you sent did not tally the proposed stream
impacts on the site. Please prepare a table depicting stream impacts in terms of length. In
addition, impacts to wetlands greater than one (1) acre will require compensatory
mitigation. Until we receive a mitigation plan, this application will remain incomplete.
Please show these on maps of suitable scale (for instance 1"=100 feet) so we can begin to
determine your projects' compliance with 15A NCAC 2H.0500. Until we receive this
information, we will plane this project on hold.
Please call me at 919-733-1786 if you have any questions or would require copies of
our rules or procedural materials.

We represent Chambers in connection with the siting of the Anson
County Solid Waste Facility and the company's application for a 401
Water Quality Certification. I understand from Jim Coffey that you have
communicated with him and that DWQ and DWM are in agreement to
have only one hearing. I also understand from Brian Card and Steve
Roberts that following your site visit you thought the certification was
appropriate and that you planned to issue a letter regarding your
conclusions and what you would require in the way of mitigation. I
would like to talk with your regarding: (1) when we can expect a letter
from you regarding your conclusions about the site; (2) whether there
will need to be a DWQ presiding officer at the hearing; (3) the notice
requirements; and (4) logistics generally. Please give me a call so that
we can move this matter forward. Thank you for your assistance.

Proposed Anson County Landfill - Hearing
"Tommy Stevens" <tommy stevens0h2o.enr.state.nc.us> at

Internet
Bill,
Anson County is proposing a new landfill and I believe that Solid
Waste is proposing a public hearing. DWQ staff (regional office and
wetlands) have recently visited the site and there are WQ issues with the
site. They propose to culvert 1085 feet of perennial streams, 2700 feet
of intermittent steams and fill .49 acres of wetland. There appears to be
a need to hold a public hearing on the 401 cert. and one option would be
to hold that hearing along with the heating that Solid Waste is
proposing.
There are likely to be a number of issues that citizens opposted to
this project will bring up that are not associated with the landfill.
This is a project that Denise Lee will be very actively involved with.
Let me know what your thoughts are.

To follow up on our conversation earlier today, I appreciate you agreeing to send me a copy of
the report submitted by Chambers in response to you December 17, 1998 letter to Chambers. I
neglected to inquire as to whether a draft permit has yet been issued. If so, please send a copy to
me and John Runkle. If not, please let me know as soon as it is issued.
I understand that the staff report is not yet complete. Can you please let me know as soon as that
is available.
As you know, in order to effectively respond to DWQ and prepare for the upcoming hearing, Mr.
Runkle and I need copies of both the draft permit and the staff report regarding the draft permit
and/or application therefor.
Please let me know if there are any problems with this request. Thanks for your prompt and
courteous attention.
Sincerely,

Memorandum To: John Dorney
From: Todd St. John
Subject: Anson County Landfill
Stream Mitigation Plans
Anson County
The writer has reviewed the subject plans and obtained Eric Fleek's advice
regarding the stream mitigation plans dated March 11, 1999, proposed by Almes &
Associates, Inc. The following are my comments and proposed questions regarding these
plans.
A) Vegetation: The area of the stream bank labeled "Zone 1" has proposed vegetation
consisting of non-woody species. The writer recommends that woody species,
including a mixture of bushes and trees be planted along with the non-woody species
to ensure long-term stream bank stability and shading.
B) Hydraulics and steam bed design: The applicant submitted no data or calculations to
support the stream bed design. Also, there do not seem to be any provisions for pools,
riffles or other natural in-stream features. The sinuosity appears to be adequate;
however, no justification was provided for the sinuosity proposed in the plans. The
writer proposes that this Office request this information as well as information
regarding peaks and durations of flows expected from the 2 and 10 year storms (most
which will be routed through the proposed sediment basin).
It is important to note that the writer is not familiar enough with requested impacts to
determine if enough mitigation has been proposed.
undesirable or invasive. The restored stream reach should have a minimum of a 25 foot
forested buffer. A similar buffer is to be planted or maintained around the wetland to
minimize future impacts.
NCWRP wants to see a maintenance plan. Provisions are to be made for
maintaining channel patterns, bank stabilization, hydrology and vegetation. The plan
should be in effect during the 5 year monitoring period.
If you have any questions regarding NCWRP's comments on the stream and
wetland restoration plan for the Anson County Solid Waste Management Facility, please
call Larry L. Hobbs at (919) 733-5313.

Preliminary Water Quality review
Upon your request, the following are the initial concerns that the Water Quality
Section has for the proposed Anson County Landfill based on our review of the
application and site visit. Please be aware that DWQ will not make any decisions with
respect to approval, conditional approval or denial of this certification until the Public
Hearing is held and comments are received and addressed from the public. However I
understand that a listing of preliminary concerns may be useful in your permitting
process. Again, this list should not be considered as comprehensive until after the
hearing.
1. Mitigation plan- The revised wetland and stream mitigation plan is an
improvement over the previous proposal but additional design monitoring
details will be needed.
2. Stormwater Management - A plan for handling stormwater from the site
will need to be examined.
3. Wastewater management - Issues related to this matter have been raised by
the public. Our Hearing Officer will need to determine whether and (if so)
how to address these concerns in the 401 certification.
4. Cumulative impacts- These will need to be addressed by the applicant.
Please call me at 919-733-1786 if you have any questions.

John,
I spoke with Jim Coffey last week about the letter you plan to send
regarding the Anson site. Jim is concerned that if we don't get a
tentative approval or letter that is very specific as to what you
going to approve, then we may not be able to issue a draft solid waste
permit until your permit is final.
Could you send a draft of your letter so that we can look it over and
and maybe comment on it before its finalized?

I really think this is the best way even though it will take a little longer to get to the hearing. I
would think that both the applicant and the folks who are objecting to the project would also prefer
this approach. It will even allow us to have the joint hearing that we had hoped for with the landfill
folks.
I will let Dexter know of our plan. Please continue to work with his folks to arrange the joint
hearing. If for some reason you have any problems with his folks that can not be resolved,
please let me know and I will be glad to do what I can to get Dexter of whoever involved to help
resolve it.
As for future projects, I think we should always do them this same way.
Thanks for willingness to fast track the review.

it will take at least a week to develop the draft Certification as we
discussed yesterday given cyndi and my workload. this will delay the
hearing even longer given the weekly publication date in the local
newspaper. it will then take more time to arrange a meeting with the
applicant. therefore it is not likely that we would have draft
certification ready for notice and mailing before mid-May. i don't
necesarily object to this approach but it will take lots of time to get
ready. is it safe to assume that you want to take this approach with all
future public hearings?
cyndi - can we meet today at from 2:30 to 3:30 pm to begin to discuss?
you cannot meet at this time, what time next week is possible?

I talked to Dexter and we would still like to find a way to have a joint
hearing, As you pointed out earlier, the joint hearing is just a good
use of State Resources, makes it easier on the public, easier on the
applicant and minimizes the abuse the Department will have to take.
Our Draft letter to Dexter indicates that we still have may concerns and
questions about the project. Please work with the applicant to resolve
these concerns and question. Then we we get to the point of either
recommending issuance or denial, we and the landfill folks can go hand
in hand (as you had proposed) to Anson County for a joint hearing for
issuance or denial.
I know we have too much to do, but please have someone do our review and
try to work out the issues with the applicant. We have to do this
either now or after the hearing and it just seems logical to do it
before we hold the hearing.

so this should work). They (solid waste) are getting space in the court house (will hold 250 or so).
once they review the draft memo (just faxed to them) and i get address for court house, i will put
out public notice. then i will let cyndi carry the ball with roger (she is in training for public hearings
so some fool other than me knows how to do these things!). ! will be around and will attend
hearing but would like cyndi to carry as much of the process as she feels comfortable with.
arranging this joint hearing has been a royal pain - let's hope it's all worthwhile when done!

i have had a real hard time getting a return call from Solid Waste. after a
month of tring, they finally called me back. they need some sort of
"quasi-approval" from us so they can do draft permit for hearing. i said
that i could do memo listing issues we are aware of at this time, but could
not do quasi-approval until hearing. they were not sure if that would be
enough but wanted to review unsigned memo. i have done memo but need FRO
and Roger to review it before i send over. anyway, i will get memo to ken
averitte and roger early next week. the tentative date of May 27 will not
work for their hearing officer so i need to get up with roger regarding
other dates in early june.(trying to arrange a joint hearing is harder than
anticipated). if all goes well with these communications, we should be able
to schedule hearing for early june. please advise if you have other
thoughts.

the joint hearing. I have had multiple phone calls about this today

Thanks for your response regarding the date for the public hearing. We have talked
with Sherri Coghill several times this morning trying to straighten out the hearing date. She
just informed us that Solid Waste's hearing officer, Mike Kelly, is not going to be available
for a hearing on May 27. He is available on May 26, June 1 or June 2. Due to the 30-day
public notice requirement for D WQ, May 26 probably will not work (see below). Either
June 1 or June 2 is fine for Chambers, Sherri is going to contact you today to set the hearing
date,
Because of the 30-day public notice requirement, we need to get a hearing elate set
today. The Anson. Record, which is the only local paper and is published only once per week
(on Wednesday), must receive the copy for the public notice by tomorrow in order to have
the notice in next week's paper. In order to have a hearing on June 1 or June 2, the public
notice must appear in next Wednesday's paper -- the following week would be too late. We
would be happy to help you make arrangements with the Anson Record to get the notice
published.
