In response to the Departments request, the following table has been prepared which depicts the steam impacts in terms of length. The segment numbers correspond to the attached plan, where they are highlighted in red. They drain the upland areas to the low areas near Brown and Pinch Gut Creeks. Allied has not submitted a mitigation plan until such time that the site can be visited by the Department to determine if a mitigation plan is necessary for these areas. Approval from DWQ is required to disturb these wetlands. The application you sent did not tally the proposed stream impacts on the site. Please prepare a table depicting stream impacts in terms of length. In addition, impacts to wetlands greater than one (1) acre will require compensatory mitigation. I understand from Jim Coffey that you have communicated with him and that DWQ and DWM are in agreement to have only one hearing. I also understand from Brian Card and Steve Roberts that following your site visit you thought the certification was appropriate and that you planned to issue a letter regarding your conclusions and what you would require in the way of mitigation. I would like to talk with your regarding: (1) when we can expect a letter from you regarding your conclusions about the site; (2) whether there will need to be a DWQ presiding officer at the hearing; (3) the notice requirements; and (4) logistics generally. Subject Author: Date: Reply Separator Proposed Anson County Landfill - Hearing "Tommy Stevens" <tommy stevens0h2o.enr.state.nc.us> at 2123199 8:41 AM Internet Bill, Anson County is proposing a new landfill and I believe that Solid Waste is proposing a public hearing. DWQ staff (regional office and wetlands) have recently visited the site and there are WQ issues with the site. They propose to culvert 1085 feet of perennial streams, 2700 feet of intermittent steams and fill .49 acres of wetland. There appears to be a need to hold a public hearing on the 401 cert. and one option would be to hold that hearing along with the heating that Solid Waste is proposing. There are likely to be a number of issues that citizens opposted to this project will bring up that are not associated with the landfill. The following are my comments and proposed questions regarding these plans. A) Vegetation: The area of the stream bank labeled "Zone 1" has proposed vegetation consisting of non-woody species. The writer recommends that woody species, including a mixture of bushes and trees be planted along with the non-woody species to ensure long-term stream bank stability and shading. B) Hydraulics and steam bed design: The applicant submitted no data or calculations to support the stream bed design. Also, there do not seem to be any provisions for pools, riffles or other natural in-stream features. The sinuosity appears to be adequate; however, no justification was provided for the sinuosity proposed in the plans. The writer proposes that this Office request this information as well as information regarding peaks and durations of flows expected from the 2 and 10 year storms (most which will be routed through the proposed sediment basin). It is important to note that the writer is not familiar enough with requested impacts to determine if enough mitigation has been proposed. undesirable or invasive. The restored stream reach should have a minimum of a 25 foot forested buffer. A similar buffer is to be planted or maintained around the wetland to minimize future impacts. NCWRP wants to see a maintenance plan. Provisions are to be made for maintaining channel patterns, bank stabilization, hydrology and vegetation. The plan should be in effect during the 5 year monitoring period. Please be aware that DWQ will not make any decisions with respect to approval, conditional approval or denial of this certification until the Public Hearing is held and comments are received and addressed from the public. However I understand that a listing of preliminary concerns may be useful in your permitting process. Again, this list should not be considered as comprehensive until after the hearing. 1. Mitigation plan- The revised wetland and stream mitigation plan is an improvement over the previous proposal but additional design monitoring details will be needed. 2. Stormwater Management - A plan for handling stormwater from the site will need to be examined. 3. Wastewater management - Issues related to this matter have been raised by the public. Our Hearing Officer will need to determine whether and (if so) how to address these concerns in the 401 certification. 4. Cumulative impacts- These will need to be addressed by the applicant. I would think that both the applicant and the folks who are objecting to the project would also prefer this approach. It will even allow us to have the joint hearing that we had hoped for with the landfill folks. I will let Dexter know of our plan. Please continue to work with his folks to arrange the joint hearing. If for some reason you have any problems with his folks that can not be resolved, please let me know and I will be glad to do what I can to get Dexter of whoever involved to help resolve it. Our Draft letter to Dexter indicates that we still have may concerns and questions about the project. Please work with the applicant to resolve these concerns and question. Then we we get to the point of either recommending issuance or denial, we and the landfill folks can go hand in hand (as you had proposed) to Anson County for a joint hearing for issuance or denial. I know we have too much to do, but please have someone do our review and try to work out the issues with the applicant. We have to do this either now or after the hearing and it just seems logical to do it before we hold the hearing. Record, which is the only local paper and is published only once per week (on Wednesday), must receive the copy for the public notice by tomorrow in order to have the notice in next week's paper. In order to have a hearing on June 1 or June 2, the public notice must appear in next Wednesday's paper -- the following week would be too late.
