Preston Howard, Jr., P.E., Director Z"-.- A&14 D E N R December 29, 1997 Wake County DWQ Project #970898 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Bruce Herbert Pulte Homes Corp. 401 Harrison Oaks Blvd. Cary, NC 27511 Dear Mr. Herbert: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.991 acres of wetlands or waters for the purpose of constructing roads and homes at Cardinal Grove, as you described in your application dated October 20, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101, 3103 and 3108. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and anv additional conditions listed below. 1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future wetland and/or water impact or impact within 50 feet of a stream. These mechanisms shall be put in place before fill of wetlands or waters occurs. Two copies of this easement shall be sent to DWQ Central office below. 2. Total permanent wetland fill for this development now totals 0.969 acres. Applicant is reminded that permanent fill of greater than one acre in this development will require mitigation. This includes lot fill at lot 84. 3. A 50 foot undisturbed buffer shall remain adjacent to all intermittent and permanent streams on the site to assure compliance with the Neuse buffer rules (15A NCAC 2B .0233). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. Road Crossing acreage should be under NW 26 not under NW14 as currently to r;o+. proposed (may be a big deal possibly affecting the ability to require mitigation if future phases are planned). That is, the road crossing is not a perpendicular crossing. (I recommend requiring minimization - note: crossing does not comply with general NW 14 conditions). Also, additional road crossing is proposed by the city of Raleigh at this location. This road crossing is not part of the proposed impacts in this application but Jo` is clearly being planned around by this subdivision. The road crossings as proposed are poorly planned please require the footprint of the road to avoid the wetland (see y' both Neuse Rules and 401 general conditions for road crossings) Neuse Rules: This project is located in the Neuse Basin and is accordingly subject to the rules. On the attached map I indicate the approximate location of where the intermittent stream begins. Also, the proposed lot fill is .02ac over the threshold of 1/3 of an acre. I have no comments pursuant to the 401 rules regarding the lot fill; however, the applicant must maintain the 50 vegetative buffer to streams. I did not go lot to lot to determine if this will be maintained. Please require this as a condition of the 401 Certification regardless of the proposed wetland impacts. The site was visited by Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers and myself on 5/14/97 for the purpose of wetland delineation verification. Mr. Alsmeyer has approved the delineation performed by S&EC. Fill in wetlands will be required to construct private residences, roads and utility lines as part of the infrastructure of a residential development., Prior impacts within the development (Phase 1, 2 & 3) include 0.073 acres. under NW26, 0.04 acres under NW 14, and 1.08 acres under NW 12. Proposed impacts (Phase 4 & 5) include 0.356 acres under NW26, 0.428 acres under NW 14, and 0.207 acres under NW 12. Total impacts (previous and proposed) equal 2.184 acres.
