Preston Howard, Jr., P.E., Director 199 January, 21997-- Wilkes County WQC 401 Project #971110 APPROVAL of 401 Water Quality Certification Mr. Clifton Hutchinson 6501 Traphill Road Traphill, NC 28685 Dear Mr. Hutchinson: You have our approval, in accordance with the attached conditions, to place fill material in 0.3 acres of wetlands or waters for the purpose of stabilizing a streambank at your lot off of SR 1002, as you described in your application dated December 15, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This Certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply. Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us. and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North. Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Mickey, Jr. Western Piedmont Region Coordinator Habitat Conservation Program prglnal signed by DATE: December 12, 1997 j08 Mickey SUBJECT: Review of an application by Clifton Hutchison to restore eroding stream banks and exclude livestock from the riparian zone along an unnamed tributary to East Prong Roaring River, Wilkes County. Mr. Clifton Hutchison, 6501 Traphill Road, Traphill, North Carolina 28658, in cooperation with Wilkes Soil and Water Conservation District (WSWCD), is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and site visit was conducted with Mr. Hutchison and Mr. Barry Greer with WSWCD on 21 August 1997. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The purpose of the project is to remove livestock from the stream's riparian zone, restore severely eroding stream banks and restore the stream channel to a more natural condition. The unnamed tributary flows into the East Prong Roaring River below the section managed as Designated Public Mountain Trout Water by the NCWRC. We are pleased that Mr. Hutchison and the WSWCD are working together to restore this section of badly degraded stream channel damaged by livestock. This project should help improve water quality and reduce sedimentation in this tributary. Therefore, we have no objection to the project as proposed.
