ADDITIONAL CONDITIONS
You have our approval, in accordance with the attached conditions and those listed below, to
place fill in 0.08 acres of wetlands or waters for the purpose of developing a residential subdivision
at Barton Creek Bluffs 4, as you described in your application dated September 10, 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Numbers 3101, 3103 & 3108. These certifications allows you to use Nationwide Permit
Numbers 12, 14 & 26 when they are issued by the Corps of Engineers. In addition, you should get
any other federal, state or local permits before you go ahead with your project inching (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be required
to send us a new application. If total wetland fills for this project (now or in the future) exceed one
acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact.. All lots
with portions within 50 feet of a stream shall also have deed restriction conservation easement or
slar mechanism referencing the Neuse buffer rules (i5A NCAC 2B .0233) in order that land
owners aze awaze of the restrictions. These mechanisms shall be put in place within 30 days of the
date of this letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The impacts proposed on this project under Nation wide 26 is below the threshold 0.33 acres.
The NW 12 impact is a perpendicular stream crossing and is compliant with the General
Conditions of NW 12. The linear stream footage for the project totals 222. The section totaling
140' represents a lotic community type that warrants mitigation. However, the section totaling,
82' is not representative of a stream community where mitigation would be required (as per the
RRO's current understanding of DWQ's mitigation policy).
Neuse Basin Rules: A lot configuration plot map was not attached to the 401 Certification
package. In the field, a copy of the map was available for review. It appears that a buffer
indicating the "'100 year flood zone" matches the 50 foot riparian buffer requirements. Although,
it is clear that construction is not proposed in this area it was not clear that a forested buffer
would be maintained. I explained the requirements to the consultant (Mr. Wndell Overby of
S&EC) and stated that a written communication will be required indicating the maintenance of the
riparian forested buffer (in order to receive the 401 Certification)
The RRO recommends the he 401 Certification be issued with the stipulation that the riparian
buffer be maintained pursuant to the Neuse Rules (requiring a written conformation from the
applicant).. Also, deed restriction language should be included in the 40 1 Certification.

Dear Mr. Domey and Mr. Alsmeyer:
The purpose of this letter is to request Nationwide Permits 12, 14, and 26, and a Section 401
Water Quality Certification for the project to be known as Bartons Creek Bluffs 4. The property is
located approximately %2 mile southeast of the Durham County line on Hickory Church Road (S.R.
1840) in Wake County.
The U.S. Army Corps of Engineers (Corps) approved wetland delineation is provided on the
enclosed map. Mr. Eric Alsmeyer with the Corps has approved the delineation of impact areas.
Impacts to wetlands will be necessary to construct roadways, utility lines, and lot fills.
Specifically, 0.08 acres of wetland impacts are planned. The following. table provides a list of the
.proposed impacts'by size and requested Nationwide Permit (NW).'

Proposed impact #1 involves a 20' wide sewerline construction corridor crossing a 4' wide bank to
bank channel. The second impact (#2) is proposed for a road crossing of the same channel. This
impact calls for placement of pipe 82' in length across a 3' wide bank to bank channel. Similarly,
the third proposed impact is for a road crossing involving 140' of pipe on a 4' wide section of
channel. Impact #3 crosses a different tributary than impact #2. The remaining proposed impacts
involve filling of two wetlands occurring on lots 59 and 60 (see map). Numbers corresponding to
the proposed impacts are provided on the enclosed larger scale site map.
