You have our approval, in accordance with the attached conditions, to place fill material in 1.03 acres of
wetlands or waters for the purpose of constructing a sewer line for the I-40 Industrial Park at I-40/SR 2547, as you
described in your application dated 26 March 1997. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3101. This Certification allows you to use General
Permit Number 049 when it is issued by the Corps of Engineers. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

Maybe I misunderstood your e-mail. I have not in fact scheduled a new
site visit to inspect the wet detention pond. Partially based on a
conversation with Pete yesterday we decided that I probably don't
need to make a special trip out there to look at the pond. I did see
it on Monday and it seemed to look (in my judgement at least) on the
size order of a 33,000 square foot pond. If you want me out there
again to do a more precise inspection-let me know. Also, this
morning I had lenghty discussions with John Holley. He had some
concerns regarding the Bob Barker (Wake Co., Fuquay-Varina)
commercial project in regards to some of our stormwater conditions.
Furthermore, and (more importantly in his estimation) he was
concnerned about the potential for overlap between some of our
stormwater conditions and sediment and erosion control requirements.
He has humbly requested that you give him a call to discuss the
project and some of his concerns. If you have questions, you know my

Re: Compliance Inspection and 401 Water Quality Certification Request for I-40 East Industrial Park
Dear Mr. Ball:
On February 21, 1995-you were issued General Water Quality Certification Nos. 2671 and 2732
authorizing 0.81 acres of wetland or water impacts needed to develop the I-40 East Industrial Park
located off Jones Sausage Road near Garner, NC. This certification was issued only for the impacts
shown in your original application. The certification also carried the additional condition that a
stormwater plan, including a wet detention pond, he approved by the Division before construction
begins or lots are sold. The approved stormwater plan called for a 32,000 square foot wet detention
pond for the project. On April 1, 1997 we received an application requesting 401 Water Qpality
Certification for 1.03 acres of wetland impacts for a proposed sewer outfall for the I-40 East Industrial
Park.
On April 25, 1997, Eric Fleek with the Division's Raleigh Regional Office made a site visit to
the I-40 East Industrial Park to look at the impacts associated with sewer outfall request and to monitor
the project for compliance with the certification issued un 1995. Mr. Fleek found only a 625 square foot
pond to handle the stormwater for the site. In order to bring your project into compliance with the
1995 Water Quality Certification you will need to complete the approved stormwater plan as soon as
possible. Please provide us with a schedule for its completion along with a signed operation and
maintenance plan. If this matter is not promptly resolved, we will be required to issue an Individual
certification for the sewer line which ill require public notice and State agency review. In this case
approval of your Certification request will likely not he prompt. Until this matter is resolved, your
application for the sewer line (##970280) will he on hold and our processing time will not restart.

Construction on the site will require: excavation of 1.03 acres of wetlands and one
perpendicular channel crossing.

-Total requested impacts are 1.03 acres. This project seems to_
demonstrate good avoidance as the sewer line is placed at a
-adequate distance from the stream and that the line is being_
constructed as close to the toe slope as possible. The RRO
_ recommends that this certificate be issued ASSUMING that the wet
detention pond observed by RRO staff was built as required by DWQ,
and assuming it was in place prior to construction and/or lot sales-
as was required by a previous 401 dated 2/21/95 (#95039).
