Suite 102 Greensboro, NC 27455 Dear Mr. Westmoreland: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.91 acres of wetlands or waters for the purpose of developing a residential subdivision at Riverbrook subdivision at Rock Quarry road and Jones Sausage Road, as you described in your application dated March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103, 3106 and 3108. These certifications allow you to use Nationwide Permit Numbers 14, 18 and 26 when they issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions or conservation easements shall be added to all deeds with jurisdictional wetlands to prevent future fill. Stormwater from this development shall be directed to sheet flow at non-erosive velocities across the remaining wetlands along Big Branch. Stormwater shall not be directly discharged into stream channels. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Approximately 0.486 ac. of NW 26 in this proposal are not within 50 feet of surface waters (as per 401 Certification guidelines). The following wetland impact (which I numbered on the attached map) are greater than 50 feet from surface waters. 1) 0.27 (I determined a portion of this wetland to be ponded surface waters, which discharges into a grassed waterway/drain. However, the remaining portion of this wetland is greater than 50' from surface waters. This acreage plus the 0.09 ac. tract downstream from the large pond totals less than .33 acres within 50' to surface waters) 2) 0.04 not Win 50' 3) 0.10 not Win 50' 4) 0.07 not Win 50' 5) 0.006 not Win 50' The waters that flow from the wetland (#1 -.27ac.) continues through a grassy water way (fescue and Juncus -largely). This drainage is waters of the State (as per general statute). This drain is interment, carrying episodic stormwater and is intermittently inundated during cool weather (during periods of low transpiration rates). However, it should be noted that these vegetated drains have significant function with regard both P and N removal - particularly in pasture setting like observed on this tract - The remaining 0.19 ac of NW26 is below the threshold acreage for minimization review. Accordingly, this tract with a total impact of 0.901 acres needs no application, no review, and no mitigation. Also, please note the .08 acres of NW18 (circled on map). This wetland is to be filled due to the requirement of the City of Raleigh to provide an open space. The applicant did not want to lose lots and so is filling this wetland to provide .08 acres of additional recreational open space. The project which is owned by Rhien Interests is located near Raleigh, NC (Wake County) at the intersection of Rock Quarry Road and Jones Sausage Road (see vicinity map). The wetland delineation has been reviewed in the field and approved by Eric Alsmeyer of the U.S. Army Corps of Engineers. Mr. Alsmeyer made a field determination that all areas east of the main north - south road are vegetated wetlands; he further determined that neither of the ponds on-site are jurisdictional. The large floodplain south of the property has been determined to be below headwaters. The construction of road crossings will result in impacts totaling 0.08; a total of 195 if of intermittent channel impacts will result from road crossings (see site plan). In order to minimize impact, the orientation of the road crossing will be perpendicular to the channel. Grading for lot placement totals 0.776 acres; of which 0.676 is under Nationwide Permit 26. Impacts to the large floodplain associated with the property have been minimized. Please call if you have questions or require further information.
