Dear Mr. Rowe:
You have our approval, in accordance with the attached conditions and those listed below, to fill in 0.83 acres of
wetlands or waters for the purpose of Commercial Development at Highway 55 and Jenks Road as you described in
your application dated February 24 and modified on September 2Z 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108 This certification allows you to
use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control,.Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below.
If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H
.0506 (h) (6) and (n. For this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining
jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in
place within 30 days of the date of this letter or the issuance of the 404 Pemtit (whichever is later).
2. An additional condition is that a final, written stormwater plan including a wet detention basin must be approved
by DWQ before wetland (or stream) impacts occur. (cc: Ray Cox)
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.
27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality coder Section 401 of the Clean Water Act If you have

Please find the enclosed revision to the Pre-Construction Notification
Application, previously submitted by Barrett Kays & Associates on 2/24/97, for
the site located at the corner of Highway 55 and Jenks Road in Apex, NC. The
attached maps describe the revised impacts to jurisdictional wetlands associated
with planned site development consisting of retail space, parking areas,
stormwater detention basins, and residential apartment complexes. Impacts
have been reduced from 1.28 acres, as requested by the Corps and DWQ staff.
As shown on the plans, a total of 0.83 acres of impact are proposed for the 20.688
acre site under Nationwide permit 26. Based on site and office meetings with
DWQ, no stream mitigation will be required since the channel in question is not
"significant". Proposed DWQ required stormwater ponds are shown on the
plans as well. Please contact Ron Horvath at R.L. Horvath with any questions

for on an adjacent site under the same current ownership. The application for the adjacent
site was received by the Corps of Engineers on February 14, 1997.

Dear Mr. Rowe:
The Division of Water Quality has reviewed your plans for the discharge of fill material into
1.28 acres of waters and/or wetlands located at Hwy 55 and Jenks Road in Apex in Wake County
for commercial development. Based on this review, we have identified significant uses which
would be removed by this project. These uses are water storage, streambank stabilization and
aquatic life. Furthermore, insufficient evidence is present in our files to conclude that your project
must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506.
Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2H
.0507(e). Until we receive additional information, we are requesting (by copy of this letter) that
the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your
project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your commercial development by minimizing
wetland and stream fill? Also a permanent stormwater pond will be required if fill exceeds one-
third acre. Finally as stated in my 4 March 1997 letter, wetland mitigation will be required if
wetland fill exceeds be aware that if the Corps of Engineers considers this project to be part of the
fill proposed on the adjacent parcel, that these acreage thresholds will include the fill on the
adjacent parcel. As stated in my 4 March 1997 letter, our processing time will not start until these
questions we addressed in writing. Any documentation such as maps and narrative that you can
supply to address alternative designs for your project may be helpful in our review of your 401
Certification. Also this project will require compensatory mitigation as described in 15A NCAC
2H .0506(h). Please respond within two weeks of the date of this letter by sending a copy of this
information to me and one copy to Mr. Erik Fleek at the Raleigh Regional Office at 2800 Barrett
Drive, Raleigh, NC 27609. If we do not hear from you in two weeks, we will assume that you
no longer want to pursue this project and we will consider the project as withdrawn. I can be

Staff biologists with the North Carolina Wildlife Resources Commission have reviewed
the subject project- Our comments are provided in accordance with certain provisions of the Fish
and Wildlife Coordination Act (48 Stat. 401, as amended. 16 U.S.C. 661-667d) and Section
401(b) of the Clean Water Act of 1977 (as amended).
We have reviewed the application for certification to impact 1.28 acres of wetlands for a
comet ereial and residential development. The applicant is also applying to impact ,305 acres of
wetlands on an adjacent tract. There are a total of 1.33 acres of wetlands on the tract for which
certification is being applied for. However, there appears to be a farm pond that will be filled
that is not included in the impact total.
Water from this site flows to Jordan Lake, which is already impacted from excess
nutrients. Therefore, the loss of these wetlands and increase in storm water will exacerbate the
water quality problems in Lake Jordan and the Cape Fear River.
(lased can the information provided in the application, it appears that a pieecmeal
approach is being taken to this development. Considering development only on a portion of the
entire property may not provide the greatest minimization and avoidance of impacts to wetlands.
We have; the following recommendations and comments concerning this application:
1. Wetland impacts for the entire property and or development should be considered at once.
This will provide the greatest minimization and avoidance of wetland impact% and will
provide the most efficient and economical siting of stormwater detention ponds and
mitigation.
2. Place decd restrictions on the property to prevent any future impacts to wetlands or
wetland mitigation sites by current or future owners.

3. Require the applicant to maintain hydrology to the wetland areas by routing water from
the wet detention ponds to the remaining wetland areas. High energy water should not be
discharged directly to wetlands.
4. Require that the wet detention pond be sized to treat all stormwater on and off the site
that is currently being treated by the wetlands and farm pond.
5. Require the applicant to submit a mitigation plan to compensate far the lost forested
wetlands.

The current project (Atlantic Real Estate Corp.) is requesting 1.28 acres of wetland impact out of
a total of 1.33 acres. As such, there does not seem to be much minimization/avoidance associated
with this project. The wetlands on this site received a rating of 46 (Site 42) and 47 {Site #1). In
addition, the project located on the opposite side of N.C. 55 has been linked by the USCOE to the
current project as one contiguous entity. As a result, there are a total of 1.585 acres of impact
being requested. The requirement of mitigation was discussed with the applicant on site and the
issue of increased minimizatiinlavoidance needed for this site was also addressed. Consequently;
the RRO believes that-in lieu-cif an approved mitigation plan or increased minimization/avoidance,
this permit should not be issued.

In your letter dated 24 February 1997, you applied to the N.C. Division of Water Quality (DWQ) for a
401 Water Quality Certification to impact 1.28 acres of wetlands or waters for your project (55/Jenks Road
commercial site) located at Iiwy 55 and Jenks Road in Wake County. Your project has been forwarded to
Mr. Danny Smith [phone] of DWQ Raleigh Regional Office for review. This review will likely
require an on-site inspection prior to the approval, modification or denial of your project site. If you have
sent additional information to the U.S. Army Corps of Engineers concerning this project, please be certain
that our staff have copies of this material so we can use it in our process in making a decision.
According to our preliminary, in-house review since you propose to disturb greater than one acre of
wetlands, it is likely that compensatory mitigation will be required by DWQ for this project as described in
15A NCAC 2H .0506 (h). Our Regional Office staff can make this decision during their site visit If
adequate mitigation is required but not provided, this project will likely have to be denied. Also if a
mitigation plan is required, we will place this project on hold until its receipt in our Central Office.
Enclosed are materials describing compensatory mitigation requirements for this program. Please call me at
919-733-1786 to discuss these matters if necessary. Until a mitigation plan is provided, this application is
considered to be incomplete and our processing time will not start.
We recommend that you not impact any wetlands or waters on your project site until a 401 Water
Quality Certification has been issued from Raleigh, The issuance of a Corps of Engineers 404 Permit does
not mean that your project can proceed. According to the Clean Water Act, the 404 Permit is not valid
until a 401 Certification is also issued. If DWQ staff observe impacts which are not allowable, you will be
required to remove the fill and restore the site to its original condition. I can be reached at 919-733-1786 if
