After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new opplication. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future wetland and/or water impact. These mechanisms shall be put in place before fill of wetlands or waters occurs. Two copies of this easement shall be sent to DWQ Central office below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. During an on-site inter-agency meeting on Novem 7, several revisions to the submittal were suggested. Please find attached the r vised PC to impact 0.031 acres of waters of the U.S. for minor road crossings associated e Lake Adger Development, located along the south side of Lake Adger, near Columbus, Polk County, North Carolina. The following information is contained in the PCN: 1) Completed PCN form 2) Project location maps 3) Location of crossings on 7.5 minute quadrangle map (Mill Spring) 4) Plan view of Phase D showing crossings, with cross-sections & erosion control detail 1 The project consists of constructing five individual road crossings within the proposed Lake Adger development. The purpose of the work is to provide access for single family residential development. The five crossings will occur in Phase D of the proposed development -- the first three phases of the development (Phases A, B, and C) have been approved previously. The project area is approximately 250 acres. The impacts to waters for the individual crossings and their dimensions are listed in Table 1 below. Table 1. These stream crossings are generally well incised, small tributary streams ranging from two to six feet wide. Road crossing D1 crosses Ostin Creek, a moderate stream, averaging 20 feet wide and one foot deep. All road crossings are single crossings of separate waterbodys. Three of the five road crossings are located at the site of smaller, existing crossings. Only two of the three existing crossings will require additional impact. The only significant crossing is the crossing of Ostin Creek (D1). This crossing has been designed for the 100-year flood and will use two 10 ft. x 10 ft. box culverts. The culverts will be buried in the stream bed approximately one foot to allow natural stream bottom materials to become established in the culverts and to allow unrestricted passage of fish and invertebrates. We believe that the subject crossings are candidates for authorization under NWP 14 since they meet the following conditions: 1) The width of the fill is limited to the minimum necessary for the actual crossing... 2) The fill is limited to an area of no more than one-third of an acre, and no more than 200 linear feet of the fill will occur in a special aquatic site... 2 f 3) The crossings are culverted to prevent the restriction of, and to withstand, expected high flows, and to prevent the restriction of low flows and the movement of aquatic organisms... 4) The crossings and attendant features are part of a single and complete project for crossing a water of the U.S. Accordingly, we are seeking authorization for five individual road crossings under NWP 14.
