APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material in 032 acres of wetlands or waters for the purpose of constructing another
segment of Tom Short Road at end of Tom Short Road, as you described in your application
dated September 29, 1997. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3103. This certification allows you to use
Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Watershed regulations. This approval will expire when the accompanying 404
or CAMA permit expires unless otherwise specked in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be
required to send us a new application. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed notices, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever is later).
2. Applicant should be aware that total wetland fill for Tom short Road is now 0.71 acres.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask
for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the

Biologists on the Wildlife Resources Commission staff have reviewed the subject
document and are familiar with habitat values of the project area. our comments are ovigions of the C 466 provided in accordance with C and the Fish and W dj ppliferCoordination Actl( 8 Stay 40Act 1977 U.S.C. , asfame dead; 6S.C.

Applicant proposes to fill approximately 0.32 acres of wetlands to complete the
oxionsion of Tom Short Road up to the proposed intersection at Rea Road. We reviewed
another project involving the extension of Tom Short Road in Mecklenburg County in
November 1996. That project, by Crosland Land Co, for the Levine property, proposed to
fill l .98 acres of wetlands for the road extension and rosidential development,
approximately 0.65 acres were for Tom Short Road itself. This project, by Frank C.
Cockinos and Assoc., inc. (Owner listed aq Robert C. Rhein Interests, Inc.), extends the
road from STA 24+92.25 to STA 60+33.72, only STA 30+00 to STA 35+00 is detailed on
a map where portions of two wetlands are impacted. It appears, from this map, that if the
road were moved 100 feet, it would not impact one of the wetlands. The road alignment
was determined by NCDOT; however, no txunimization was discussed.
The Tom Short Road extension crosses Six Mile Creek, although it is unknown if
that occurs in this portion of the project. The Carolina darter (Etheartama collie), a
federally and state listed fish species, inhabits small streams in the arcs and may inhabit
Six Mile Creek. 'fherc are also plant species of concern found in the area. The applicant
does not indic:,atc on the application if the U. S. Fish and Wildlife Service or the State
Historic Preservation officer has been contacted, as required.
It appears that a piecemeal approach is being taken to constructing this road project.
This approach already may have led to cumulative destruction of wetlands without

mitigation and may have the potential to lead to further destruction of wetlands. If this is
Foing to serve as a public road and NCDOT has ro mmmended alignment selection, the
impacts for the entire project need to be considered and compensatory mitigation made for
unavoidable impacts.
We have the following recommendations concerning this project:
1. The Tom Short Road extension should be considered as one project to reduce the
cumulative adverse impact to wetlands that is occurring by allowing each developer
to use nationwide 14 or other nationwide permits.
2. Provide justification for the road alignment as the least environmentally damaging
option.
3. Wetland fill should be minimized. Temporarily disturbed wetland areas should be
seeded with annual small grains appropriate for the season (e.g., millet, wheat, rye
annual lespedeza) as soon as possible and then be allowed to revert to natural
wetland vegetation.
4. The applicant should coordinate with ether appropriate agencies, USFWS and
SHPO.
