It is our understanding that Danny Smith of DEHNR has made a recommendation to qualify a section of the drainage channel on the- west side of the proposed development as an intermittent stream. Although certain characteristics of the site required impacts to this channel, we believe that our design minimizes these impacts and provides storm water quality (retention) and quantity (detention) benefits, through the addition of two ponds to the site. As you can see on the attached excerpt from the grading plan, this site has extreme topography. We have attempted to minimize the impact of our project on the land forms by winding the access roads to create length and reduce road grades and associated slopes. We are required to access the site at the existing traffic signal on Highway 54 (Chapel Hill Road) at the Morrisville Parkway intersection. As our entrance is fixed and crossing the drainage is a functional necessity, we believe that we have designed an optimal location and elevation for our main access (spine) road crossing (Impact No. 3). The elevation of this road has been minimized and the fill slopes steepened to 3:1 to minimize impact. Even so, we still have approximately 30 feet of fill to the downstream toe of slope. At 3:1 this equates to 90 feet (in the horizontal dimension) of impact to what you have identified as Impact No. 1. Upstream (Impact No. 2), the 3:1 road fill creates an infill to the area Danny Smith has identified as the beginning of the intermittent stream. Page 2 November 20, 1997 Mr. Steve Roberts Although not required by the Town for control of post-development storm water runoff or water quality, our design also incorporates two ponds. A pond was originally requested by the developer, Security Capital Atlantic Incorporated, for aesthetic benefits. From an engineering perspective, we believe that a pond would provide significant water quantity and quality benefits. Again, the topographic relief of this property caused us to have to use two ponds to maximize storage volume. The location of these ponds allowed us to drain much of the site storm water through them. Some off-site water is planned to be routed through the ponds, however, the tributary area is small, approximately 12.86 acres. A topographic survey, with the off-site tributary area delineated, is enclosed for your reference. The plan is to connect the ponds with a waterfall feature (Impact No. 5). Water will be recirculated from the lower pond to the upper pond, creating a constant flow of water over the waterfall. In actuality, Impact No. 5 is not the waterfall but rather the dam creating the upper pond (Impact No. 6). We expect the waterfall to aerate the ponds and enhance aquatic life. Overall, we believe the ponds, although not a requirement, will provide significant benefits in terms of storm water management and improved water quality. According to the Clean Water Act, the 404 Permit is not valid until a 401 Certification is also issued. If DWQ staff observe impacts which are not allowable, you will be required to remove the fill and restore the site to its original condition. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. These mechanisms shall be put in place within 30 days of the date of this letter or the issuanc., of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
