Project (970832).
Dear Mr. Dorney:
Per your request, I am providing a letter from Howard Flemming of the John R. McAdams Co.
which further describes and justifies the impacts requested on September 23, 1997 for the Cameron
Chase Apartment project (970832). Copies of the grading plan that correspond with the impacts in
question and a topographic map have also been attached.
This letter has been sent via facsimile and regular mail. We would greatly appreciate a prompt
response, and we will assume that the processing period begins on the date that you receive the
faxed copy.
Please call if you have questions.

Re: Cameron Chase Apartments
NC 54 at Morrisville Parkway
Morrisville, NC
Dear Steve:
Per your request, the purpose of this letter is to describe the design features, and
rationale used in engineering the subject project. It is our understanding that
Danny Smith of DEHNR has made a recommendation to qualify a section of the
drainage channel on the- west side of the proposed development as an intermittent
stream. Although certain characteristics of the site required impacts to this
channel, we believe that our design minimizes these impacts and provides storm
water quality (retention) and quantity (detention) benefits, through the addition of
two ponds to the site.
As you can see on the attached excerpt from the grading plan, this site has
extreme topography. We have attempted to minimize the impact of our project on
the land forms by winding the access roads to create length and reduce road
grades and associated slopes. We are required to access the site at the existing
traffic signal on Highway 54 (Chapel Hill Road) at the Morrisville Parkway
intersection. As our entrance is fixed and crossing the drainage is a functional
necessity, we believe that we have designed an optimal location and elevation for
our main access (spine) road crossing (Impact No. 3). The elevation of this road
has been minimized and the fill slopes steepened to 3:1 to minimize impact. Even
so, we still have approximately 30 feet of fill to the downstream toe of slope. At
3:1 this equates to 90 feet (in the horizontal dimension) of impact to what you
have identified as Impact No. 1. Upstream (Impact No. 2), the 3:1 road fill creates
an infill to the area Danny Smith has identified as the beginning of the intermittent
stream. Impacts 1, 2 & 3 together comprise the dam for the lower pond (Impact
No. 4).

Mr. Steve Roberts
Although not required by the Town for control of post-development storm water
runoff or water quality, our design also incorporates two ponds. A pond was
originally requested by the developer, Security Capital Atlantic Incorporated, for
aesthetic benefits. From an engineering perspective, we believe that a pond would
provide significant water quantity and quality benefits. Again, the topographic
relief of this property caused us to have to use two ponds to maximize storage
volume. The location of these ponds allowed us to drain much of the site storm
water through them. Some off-site water is planned to be routed through the
ponds, however, the tributary area is small, approximately 12.86 acres. A
topographic survey, with the off-site tributary area delineated, is enclosed for your
reference. The plan is to connect the ponds with a waterfall feature (Impact
No. 5). Water will be recirculated from the lower pond to the upper pond,
creating a constant flow of water over the waterfall. In actuality, Impact No. 5 is
not the waterfall but rather the dam creating the upper pond (Impact No. 6). We
expect the waterfall to aerate the ponds and enhance aquatic life. Overall, we
believe the ponds, although not a requirement, will provide significant benefits in
terms of storm water management and improved water quality.
I trust that you will find this information helpful in understanding our design and
the evolution of decisions precipitated by the project constraints. Please call me,
should any clarification be necessary.
Sincerely,

Dear Mr. Westbrook:

DWQ 970832
Wake County
On September 26,1997 you applied to the N.C. Division of Water Quality (DWQ)
for a 401 Water Quality Certification to impact 550 linear feet of streams for your
project Cameron Chase Apartment Complex located at US 54 about 1.1 miles south of
Morrisville in Wake County. Your project has been forwarded to Mr. Danny Smith (919-
) 571-4700 of DWQ Raleigh Regional Office for review. This review will likely require
an on-site inspection prior to the approval, modification or denial of your project site. If
you send additional information to the U.S. Army Corps of Engineers concerning this
project, please be certain that our staff have copies of this material so we can use it in our
process in making a decision.
According to our preliminary, in-house review since you propose to disturb 550
linear feet of streams, it is likely that the temporary Neuse Rules (15A NCAC 2B .0233)
will apply. This determination will be made.
Please call me at 919-733-1786 to discuss these matters if necessary. Until this
determination is made, this application is considered to be incomplete and our processing
time will not start.
We recommend that you not impact any wetlands or waters on your project site until
a 401 Water Quality Certification has been issued from Raleigh, The issuance of a Corps
of Engineers 404 Permit does not mean that your project can proceed. According to the
Clean Water Act, the 404 Permit is not valid until a 401 Certification is also issued. If
DWQ staff observe impacts which are not allowable, you will be required to remove the
fill and restore the site to its original condition. I can be reached at 919-733-1786 if you
have any questions about the 401 Certification process.

Dear Mr. Dorney and Mr. Alsmeyer:
The purpose of this letter is to request the authorization of Nationwide Permit 26 for a
total of 550 linear feet (0.04 acre) of channel/wetland impact resulting from the
construction of Cameron Chase Apartment Complex. The project is owned by Mr. Carl

Note that all channels/wetlands within the tract have been evaluated by Mr. Alsmeyer
of the USACE with regard to the "minimum impact test" and that the proposed impacts
will only be counted toward the acreage thresholds.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS
Mr. Carl Westbrook
6610 Folger Drive
Charlotte, NC 28270
Dear W. Westbrook:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material and flood in 0.04 acres of waters for the purpose of constructing a road
crossing and ponds at Cameron Chase Apartments, as you described in your application dated
November 20,1997. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Watershed regulations. This approval will expire when the accompanying 404
or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be
required to send us a new application. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed notices, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional waters to restrict future wetland and/or water impact to assure compliance
with the 50 foot buffer requirements of the Neuse rules (15 A NCAC 213 .0233). These
mechanisms shall be put in place within 30 days of the date of this letter or the issuanc., of the 404
Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask
for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the
Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.
