The total area of Jurisdictional Waters on the site is ± 7.25 acres based on my site evaluation and USACE verification. As depicted on the attached plan the developer has made an exceptional effort to avoid and minimize impacts to jurisdictional waters including wetlands and small streams. The developer will maintain the hydrology to the wetlands to the extent possible with the stormwater drainage system on the project. The majority of the site is a slightly sloped to flat with no well defined drainageway or stream. The soils according to NRCS Soil Survey on site are made up of Iredell fine sandy loam (IrA), Mecklenburg fine sandy loam (MeB2), and Chewacla (ChA) in the floodplain. Vegetation includes mixed hardwoods forest ranging from mature xeric hardpan forest to mature mesic hardpan forest and areas in secondary succession. Areas in former agricultural fields include old field succession and dense scrub/shrub overgrowth. Large areas of the woodlands were impacted by Hurricane Hugo. The developer will require strict adherence to an approved Sediment and Erosion Control Plan and I have informed my client that a preconstruction application to the USACE and the NCDWQ will be required if the development area changes and impacts of 1/3 acre to wetlands and over 150 1f to streams area required. 46P, S i r Please let me know if you have any questions or require additional information. Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification Mr. Jim Medall Rhine Interests, Inc. 5250 77 Center Drive Suite 350 Charlotte, NC 28217 Dear Mr. Medall: Y1.9;WA IT 4 ae [D EHNR August 20, 1997 Union County DWQ Project # 970714 You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.2 acres of wetlands or waters for the purpose of constructing a residential subdivision at Tom Short and Rea Roads, as you described in your application dated August 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this protect (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final add binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
