This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. This Certification replaces one issued on 17 July 1997. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Applicant is encouraged to allow wetlands to develop in the basin to enhance its water quality functioning. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. July 13, 1997 SuBjF.cT: Prc-Construction Notification Application for Nationwide Permit for City of Edon, Rockingham County, North Carolina DWQ 97-0509 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject document. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) The applicant proposes to construct a dry detention pond on an unnamed tributary to Lary Creek. The purpose of the dry detention pond is to serve as a watershed control structure to protect downstream areas from flooding. Construction of the pond will include placement of a dam across the creek channel and flooding 475-feet of the unnamed tributary. We prefer that stormwater ponds not be constructed irtstream but be placed in adjacent upland areas off the tributary. If a permit is issued for this structure, we would prefer that it be designed as a wet detention pond so that in addition to reducing flooding that pond could provide greater water duality functions. The purpose of the proposed project is to provide flood protection to the residents of the Dry Creek watershed. The flooding problems within this watershed are severe, causing substantial property damage on an annual basis and causing public safety problems due to roadway overtopping at culverts and flood waters in and around houses. The City commisioned Woolpert, LLP of Charlotte, North Carolina to perform hydrologic and hydraulic modelling of the watershed and recommend alternative solutions. Based on the findings of the study, and an extensive public involvement program, The City elected to proceed with the design of the proposed detention basin. The following items have been enclosed: • Vicinity map to the project site (USGS Quadrangle Northeast Eden, 1 "=2000') • Sketch of the proposed detention basin, including limits of clearing and preliminary grading plan. • Summary of design specifics and flood reduction benfits provided by the detention basin • Information concerning National Wetlands Inventory research results (overlay to quad map) Seven copies of the Joint Application Form and attached materials are hereby submitted to obtain written concurrence regarding the Section 401 Water Quality Certification.
