The project occurs adjacent to Duraleigh Rd near the intersection of Ebenezer Church Rd. in Raleigh (see attached). The jurisdictional areas proposed for impact are of little value (aquatic life, flood reduction, etc.). A stormwater drain outlet is responsible for an insignificant intermittent channel proposed for impact. Small linear wetlands makeup the remaining impact areas. Fill in the wetlands will be required to accommodate the landowners objectives of residential construction (see attached map). It will be necessary to impact a total of .08 acres of jurisdictional waters and wetlands. A Nationwide Permit 26 is requested due to channel impacts totaling 390 linear feet. Channel impacts will be in the form of relocation and piping. The piped channel will flow into an existing pond that allows for stormwater retention and settling of sediments. If a site visit is required please notify S&EC to set up a date and time. The wetlands to be impacted are of low quality and are highly linear - in shape and very narrow. Considering the low quality and low amount of acreage impacted the RRO recommends issuing the certification for the fill of these - wetlands. In terms of the stream impacts, the RRO believes that the impacts will occur in an intermittent 7Q10/30Q2 stream. Although there was flow on the day of the site visit (6/20/97) and the last previous rainfall event in this area was on 6/17/97, the RRO still believes that this channel likely does not have a positive 7Q10/30Q2. In addition, the RRO believes that there was not a - "significant" aquatic life use present. This channel showed evidence of high," stormwater flows (high wrack lines and deeply incised bed) and the use of the existing pond for wet detention seems to be the best option given the narrow and low quality nature of the wetlands on site. In the application, S&EC states that "wetlands along the eastern property edge will remain as is". During the site - visit, Wendell Overby stated that all of this area (eastern property edge) was' channel and that there were no plans to disturb the riparian along this channel. - The Central Office may wish to include language in the 401 limiting future = impacts to these areas located on lots #4 and #6. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
