Dear Sirs.
The purpose of this letter is to request Nationwide Permit 26 for the construction of Lakeview
Point Subdivision. Proposed wetland impacts total 0.731 acres. The project, which is owned by
Joseph H. Lewis, is located in Knightdale, Wake County, N.C., west of Smithfield Road (see the
Site Vicinity Map).
An application for Nationwide Permits 13 & 14 was sent to the USACOE and NCDWQ on
4/24/97 to impact 900 sq. ft. of wetlands (300 linear feet of Waters of the U.S.). Mr. Eric
Alsmeyer and myself visited the site on 5/14/97 for the purpose of wetland delineation verification.
Mr..Alsmeyer, approved the delineation. Mr. Danny Smith and myself visited the site on 5/29/97 to
-review the proposed impacts. Section 401 Water Quality Certification approval was sent on
6/27/97. Section 404 Nationwide Permit verification was sent on 7/30/97.
The final site plan has since been altered. The revised plan will not impact the previously
permitted wetland impacts. Instead, the revised plan proposes to fill an existing low quality
drained pond for the creation of required usable open space. Filling of the drained pond will, comply with all the general conditions stated under Nationwide Permit 26.

any measures taken to minimize wetland impacts): The low quality wetlands associated
within the drained pond exist in the most practicable location for the construction
of the required open space. The final site plan has been revised so as not to
impact the previously permitted channel and linear wetland located along the
southwestern boundary of the property.

should be 1 inch equals 5.0 feet or 1 inch equals 100 feet or their equivalent.

placement of the delineation line.
d. Attach a copy of the stormwater management plan, if required.

Descrintion of Activi
Nationwide Permit number 14 authorizes 300 square feet of impacts to stream channels (bank
to bank) due to road crossings required for development of property. Nationwide Permit
number 13 authorizes impacts to 600 square feet of channel by bank stabilization
activities associated with the development.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear M. Lewis:
You have our approval, in accordance with the attached conditions and those listed below, to impact 900 square feet of
wetlands or waters for the purpose of constructing homes and roads at Lakeview subdivision, as you described in your
application dated 24 April 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 3102 and 3103. These certifications allow you to use Nationwide Permit Numbers
13 and 14 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms
shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall
be put in place within 30 days of the date of this letter.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

within the drained pond exist in the most practicable location for the construction
of the required open space. The final site plan has been revised so as not to
impact the previously permitted channel and linear wetland located along the
southwestern boundary of the property.

Description of Activity:
Nationwide Permit number 14 authorizes 300 square feet of impacts to stream channels (bank
to bank) due to road crossings required for development of property. Nationwide Permit
number 13 authorizes impacts to 600 square feet of channel by bank stabilization
activities associated with the development.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Lewis:
You have our approval, in accordance with the attached conditions and those listed below, to impact 900 square feet of
wetlands or waters for the purpose of constructing homes and roads at Lakeview subdivision, as you described in your
application dated 24 April 1997. After reviewing your application, we have decided that this flu is covered by General
Water Quality Certification Numbers 3102 and 3103. These certifications allow you to use Nationwide Permit Numbers
13 and 14 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms
shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall
be put in place within 30 days of the date of this letter.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Bolt 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

The purpose of this letter is to request Nationwide Permit 26 for the construction of Lakeview
Point Subdivision. Proposed wetland impacts total 0.731 acres. The project, which is owned by
Joseph H. Lewis, is located in Knightdale, Wake County, N.C., west of Smithfield Road (see the
Site Vicinity Map).
An application for Nationwide Permits 13 & 14 was sent to the USACOE and NCDWQ on
4/24/97 to impact 900 sq. ft. of wetlands (300 linear feet of waters of the U. S.). Mr. Eric
Alsmeyer and myself visited the site on 5/14/97 for the purpose of wetland delineation verification.
Mr. Alsmeyer approved the delineation. Mr. Danny Smith and myself visited the site on 5/29/97 to
review the proposed impacts. Section 401 Water Quality Certification approval was sent' on
6/27/97. Section 404 Nationwide Permit verification was sent on 7/30/97.
The final site plan has since been altered. The revised plan will not impact the previously
permitted wetland impacts. Instead, the revised plan proposes to fill an existing low quality
drained pond for the creation of required usable open space. Filling of the drained pond will
comply with all the general conditions stated under Nationwide Permit: 26.

Dear Mr. Lewis:
You have our approval, in accordance with the attached conditions and those listed below, to impact 900 square feet of
wetlands or waters for the purpose of constructing homes and roads at Lakeview subdivision, as you described in your
application dated 24 April 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 3102 and 3103. These certifications allow you to use Nationwide Permit Numbers
13 and 14 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms
shall be placed in all lots with remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall
be put in place within 30 days of the date of this letter.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150E of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Boil 227447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.

Got a revision for this project. WE issued 401 on 6/27/97 to fill 0.02 acres of wetland for NW13
and NW 14. Now they want to drop those impacts but fill 0.71 acres of drained pond. What say

I don't remember this project.... But, the 401 is only valid if the project proceeds as proposed in
the application. Accordingly, they do not have a 401 (if they go with 0.71 ac.) and thus the project
is subject to the rules.. As per Jill and Greg, they are not vested if they don't have a 401.
Having said that, site specificly the question then becomes, is there forested vegetation around
an intermitent stream within the drained pond's foot print?

The purpose of this letter is to request Nationwide Permits 13 and 14 for a total of 900 square feet
of wetland impacts resulting from construction of Lakeview Point Subdivision. The project which
is owned by Joseph H. Lewis is located near Knightdale, NC (Wake County) west of Smithfield
Road (see vicinity map).
The wetland delineation has not been reviewed in the field and approved by Eric Alsmeyer ofthe
U.S. Army Corps of Engineers. Mr. Alsmeyer has made field determination that excavated ponds
are in some cases not jurisdictional. We contend that two on-site ponds are not jurisdictional
because they have been excavated in highground.
The construction of road crossings will result in impacts totaling 300 square feet; a total of 1001f
of intermittent channel type impacts will result (see site plan). In order to minimize impact, the
orientation of the road crossing will be perpendicular to the channel. Bank stabilization will
account for the balance of impacts.

Dear Mr. Lewis:
You have our approval, in accordance with the attached conditions and those listed below, to impact 900 square feet of
wetlands or waters for the purpose of constructing homes and roads at Lakeview subdivision, as you described in your
application dated 24 April 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 3102 and 3103. These certifications allow you to use Nationwide Permit Numbers
13 and 14 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stonnwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA pd mit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms
shall be placed in all lots with remaining jurisdictional wetlands and water; to prevent future fill. These mechanisms shall
be put in place within 30 days of the date of this letter.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

This project consists of less than a third of an acre of proposed
wetland impacts. The impacts noted in the application are only for
(what appears to be) one first order stream channel. The subject
stream receives stormwater (at significant though episodic
velocities) from an adjacent railroad right-of-way. S&EC (chris
huysman) has differentiated this stream with both NW 13 and NW14
(whatever).
The linear stream footage issue is academic in this instance. That
is, as per my current understanding of in-house policy this stream
is an inappropriate stream to require mitigation. This stream is
deeply incised, with notable impacts from scour and sedimentation.
Please note: the ponds that are located on site do not have any
impacts currently proposed (in the application). However, contrary
to the information in the application it is my understanding that
the ponds are Jurisdictional. Also, the plans indicate a sewerline
bisects one of the ponds (as per the plans provided in this
application). ? Do we want to issue this 401 Certification when it
is clearly likely that additional impacts are forth coming?
Anyway, the RRO recommends issuance of the proposed impacts with
the requirement of deed restrictions on the remaining wetlands on
the tract.

rate any of the wetlands on this site. The only wetlands proposed
to be impacted is a stream channel.

The site is located in the Neuse Basin but the proposed drainage pathway to be impacted by fill
consists of an old pond (dam has failed/breached). Although a small area of water is still ponded
in this depression there is no channel located in the pond footprint. Accordingly, no intermittent
streams or lakes containing forested vegetation pursuant to the Neuse Rules are proposed to
impacted by fill (vegetation: Carax, Juncus, Polygonum spp., Eleocharis spp. a few Salix nigra).
Having said that, I recommend that a deed restriction be placed on the remaining wetlands and
that the language be include in the 401 Certification indicating the requirements to maintain a 50
foot riparian buffer on intermittent streams, perennial streams, and lakes (note: this tract has
streams and another pond).
The RRO recommends issuance.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Lewis:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material in 0.731 acres of wetlands or waters for the purpose of filling a drained pond to
create open space at Lake Pointe, Phase I, as you described in your revised application dated
October 16, 1997. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Watershed regulations. This approval will expire when the accompanying 404
or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be
required to send us a new application. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed in aall lots with
remaining jurisdictional wetlands and waters ro restrict future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit(whichever is later).
2. An undisturbed 50 foot buffer must be left adjacent to all intermittent streams, permanent
streams and lakes (including ponds) in the subdivision. This warning must be placed on all
deeded lots within 50 feet of these waters.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask
for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the
