After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103, 3106 and 3127. These Certifications allow you to use Nationwide Permit Numbers 14, 25 and 18 when they are issued by the Corps of Engineers. This Certification replaces the one issued on 13 May 1997. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Subsequently, CP&L applied for and received permits from the Corps of Engineers (Corps) and the North Carolina Division of Water Quality (NCDWQ) for those portions of the project which involved minor crossings of wetlands. In the previous discussions and correspondence, CP&L indicated that plans for the crossings of Hyco Lake and the Dan River were still in preparation, and that these would be forwarded to you for approval upon completion. These plan and, profile drawings are completed and attached (Enclosure 1), and CP&L is seeking your approval of: - demolition of an existing concrete transmission tower foundation under Nationwide Pe 't #18 t form a fish attractor; and 2) the crossing of the Dan River under Section 10 of the Rive Harbors Act. We would also refer you to the previous correspondence dated April 17, 1997 which contains additional site maps. As you will recall from our discussions, the crossing of Hyco Lake (which we understand is not Section 10 waters) involves replacing one transmission tower within the lake. All other crossings of the lake will extend from high ground to high ground. CP&L intends to remove the existing lattice steel tower from the lake, and then demolish the tower's concrete base in-place to serve as a fish attractor. We are asking that the Corps approve this project under Nationwide Permit #18. Enclosure 2 is the Pre-Construction Notification in support of this request. This plan was approved by the NC Wildlife Resources Commission in a letter to you dated April 23, 1997. The new replacement structure in Hyco Lake will include a foundation consisting of a single eight-foot diameter cylindrical concrete pier, and a single-pole steel tower. The foundation will be constructed of concrete poured in a sealed casing. No fresh cQricrete will be allowed to Messrs. Thomas and Dorney 2 contact the waters of Hyco Lake. CP&L understands this activity is permitted under Nationwide Permit No. 25 and NCDWQ General Water Quality Certification #3127, neither of which require specific notification as long as the listed conditions are adhered to. The Dan River crossing involves removing an existing double-circuit 138kV steel-tower line and replacing it with a new double-circuit 230kV steel H-frame line. The Dan River crossing will be from high ground to high ground; no structures will be placed within the river. CP&L understands that the Dan River is navigable water, and is requesting approval to install the overhead transmission line in accordance with the conditions of Corps Regional General Permit No. 198100049. CP&L understands that specific notification of the Division of Water Quality is not required as long as the conditions of General Water Quality Certification #3101 are adhered to. Thomas and Dorney: CP&L is reconstructing a portion of the existing Roxboro - East Danville 138kV Transmission Line for 230 kV operation. The reconstruction extends from the Roxboro Steam Electric Plant near Roxboro, NC to an interconnection with American Electric Power Company at the North Carolina-Virginia state line near Danville, VA. The reconstruction will require widening the right-of-way in certain areas from 50 feet to 100 feet. CP&L previously submitted and obtained approval of a sedimentation and erosion control plan for the right-of-way clearing from the NC Land Quality Section. In the final design of this line, CP&L has determined that a permanent access road crossing of a small wetland area on company property is needed to facilitate construction and future maintenance activities. Please refer to the attached USGS topographic map sheet no. 1 of 7 showing the location of this crossing. The wetland area is a manmade canal which was originally dug during construction of the Roxboro Plant. The canal is no longer in use and the area normally contains no standing water but has reverted to wetlands. The wetland area to be impacted is less than 0.1 acre. Additionally, CP&L is currently upgrading the existing Yanceyville 138kV Tap Line for 230 kV operation in a separate but concurrent project. The existing 70-foot-wide right-of-way is IL . Thomas and Dorney 2 April 17, 1997 sufficient for this upgrade and no additional right-of-way is needed. However, CP&L must access this right-of-way across private property. One of the land owners has required that we only access the right-of-way at one location across his property and then travel along the right-of- way corridor. This will require permanent access road crossings of two small creeks within CP&L's existing right-of-way. Constructing permanent access road crossings at these two creeks will satisfy requirements of the land owner and facilitate construction and future maintenance activities. Please refer to the attached USGS topographic map sheet no. 4 of 7 showing the location of these two crossings. Together, both crossings will impact about 60 linear feet of creek and less than 0.1 acre of wetlands. CP&L requests your concurrence to install permanent access road crossings of the wetland area on the Roxboro Plant - East Danville 230kV Line and of the two creek crossings on the Yanceyville Tap Line under Nationwide Permit #14. The total amount of fill in wetlands and waters of the United States will be limited to the minimum needed for the actual crossings which will be less than 1/3 acre. The project will be designed and constructed to meet or exceed all other conditions of the permit.
