APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Clifton:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material
in 0.5 acres of wetlands or waters for the purpose of constructing a spray irrigation field at your farm near Kerr on
SR 1007, as you described in your application dated 29 April 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you
to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment
and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below. A berm shall be constructed across the
bottom of the fill to prevent off-site drainage. Applicant is reminded that waste shall not be sprayed into remaining
wetlands and that buffers as specked in DWQ's animal waste rules shall be maintained.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

SUBJECT: 401 Water Quality Cart cation request for Pwstage Farms, Inc. near Kerr,
Sainapson County, North Carolina. DEM IU 970370.
North Carolina Wildlifb Resources Co iseion staff have reviewed the subject request- A
site --Asit wits made on March 9, 1997. Our comments are provided in accordance with, provisions
of the National. Environmental Policy Act (42 U. S.C. 4332(2)(e)) and the Fish and Wildlife
Coordination, Aot (48 Stat. 401, as amended; ib U.S.C. 661-667d).
The applicant is seekius authorization to fill 0.5 acres of jurisdictional wetlands to
accommodate a circular livertock waste irrigation system- The wetlands contain ephemeral pools
and appear to be associated with the South River floodplain. It is our understanding tks :reach of
South River is. designated Outstanding Resource Waters. Wetland vegetation at the site includes
red maple, loblolly pine, wax myrtle, blueberry, and uft poplar. Habitat suitable fox use by
raccoon, opossrnn, amphibians, and a variety of songbirds is provided.
Wetlands were in the process of being Mod by a bulldozer during our site visit. The
bulldozer operator said he ki ew nothing about pending Water Quality Certification In short,
wetlands were being filled prior to the applicant receiving authorization from tho Division of
Water Quality. For this reason in addition to the obvious impacts to wildfh habitat, water quatity
protection f motions, and risk associated with applying waste next to a floodplain, we recommend
that after-the-fact certification be conditioned as follows.
1. Filled wetlands will be adequately mitigated fur. Mitigation ratios should be:
restoration (2:1), creation (3:1), or preservation (10:1).
