Project setting
The project site is located off SR 1228 on the Scuppernong River near Columbia in Tyrrell
County, North Carolina. The proposed site is approximately 6.46 acres and is the Sawyers
Marina property owned by Luitgard H. Dietrich. Mr. Dawkins and Ms. Dietrich have entered
into an agreement which will allow Mr. Dawkins to install a 2 inch PVC sewer discharge pipe
across Ms. Dietrich Property through the existing bulkhead and into the Scuppernong River.
Sawyers Marina is a full service facility with a boat basin with ±60 wet slips, dry storage, several
showrooms and service buildings, a boat ramp and a fixed crane for boat launching and retrieval.
Access into the basin is via an ±30' wide canal which connects to an ±30' wide channel into the
Scuppernong River to a connecting depth of -8'.
Scuppernong River is classified as SC by the Environmental Management Commission.
Scuppernong River is not open to shell fishing. The Division of Water Quality has authorized the
discharge under WWTP Permit No. 0085081.
Project description
The applicant proposes to lay a 2 inch PVC sewage discharge line on the bottom of the
Scuppernong River. The line will project through the existing bulkhead above the normal water
level, turn 90 degrees and extend to the river bottom which is ±2.5' deep at this point. A second
90 degree turn will allow the line to run along the river bottom out to the green day marker which
marks the edge of the access channel into Sawyers Marina. The water depth at the proposed
terminal end of the pipe is ±4.5' and the access channel depth is ±8'. The sewage discharge pipe
will be ± 180' long and will terminate with a diffuser. The pipe sections are 20' and each
connection will be anchored with a formed concrete collar. An additional anchor collar is
proposed at the diffuser. The applicant proposes to mark the line with permanent floating buoys
every 20' and mark the diffuser end.
Anticipated impacts

The project as proposed will result in filling of ±90 ft2 of river bottom as a result of the
placement of the sewer discharge line. The proposed terminus of the discharge pipe will not
encroach into the access channel for Sawyers Marina and should not pose a navigation impedance
to the vessels entering the marina. The placement of the pipe on the river bottom with the
concrete collars could cause potential problems with recreational fishing boats crossing over it.
The project will result in localized turbidity as a result of the filling and construction activities.

prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger

requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

APPROVAL of 401 Water Quality Certification

Dear Mr. Dietrich:
You have our approval, in accordance with the attached conditions, to place fill material in 90 square feet
of waters for the purpose of constructing a sub aqueous wastewater line at SR 1228 on the Scuppernong
River, as you described in your application dated 2 May 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. ff total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919-733-1786.
