I'm writing to you in reference to DWQ#970334. The project calls for impacting 0.256
acres of wetlands and 470 linear feet of waters for the Knights Play Golf Center in Apex.
It is our belief that no mitigation will be necessary for the impacts proposed with this
project. If required to mitigate however, there will not be a mitigation plan provided.
Instead payment to the mitigation bank will be chosen. Therefore, do not consider the
permit application incomplete and delay processing time. A site visit with a
representative of DWQ has been tentatively scheduled.

On 17 April 1997, you applied to the N.C. Division of Water Quality (DWQ) for a 401 Water
Quality Certification to impact 0.256 acres of wetlands (and 470 linear feet of waters) for your project
Knights Play Golf Center located at Ten Ten and Penny Road in Apex, Wake County. Your project has
been forwarded to Mr. Danny Smith (919) 571-4700 of DWQ Raleigh Regional Office for review. This
review will likely require an on-site inspection prior to the approval, modification or denial of your project
site. If you have sent additional information to the U.S. Army Corps of Engineers concerning this project,
please be certain that our staff have copies of this material so we can use it in our process in making a
decision. This letter replaces one sent on 25 April 1997 which had a typographical error.
According to our preliminary, in-house review since you propose to disturb greater than 150 feet of
streams, it is likely that compensatory mitigation will be required by DWQ for this project as described in
15A NCAC 2H.0506 (h). Our Regional Office staff can make this decision during their site visit. If
adequate mitigation is required but not provided, this project will likely have to be denied. Also if a
mitigation plan is required, we will place this project on hold until its receipt in our Central Office.
Enclosed are materials describing compensatory mitigation requirements for this program. Please call me at
919-733-1786 to discuss these matters if necessary. Until a mitigation plan is provided, this application is
considered to be incomplete and our processing time will not start.
We recommend that you not impact any wetlands or waters on your project site until a 401 Water
Quality Certification has been issued from Raleigh, The issuance of a Corps of Engineers 404 Permit does
not mean that your project can proceed. According to the Clean Water Act, the 404 Permit is not valid
until a 401 Certification is also issued. If DWQ staff observe impacts which are not allowable, you will be

The purpose of this letter is to notify the Corps of Engineers our intention to utilize Nationwide Permit 26
and request a 401 Water Quality Certification for a total of 0.256 acres of wetlands impacts resulting from
construction of Knights Play Golf Center. The project is located near Apex, NC near the intersection of
Ten Ten and Penny roads east of U. S. 1(see attached map).
The filling of 0.256 acres of wetlands will result from the construction of a driving range see attached plan.
Additionally, 470 linear feet of non-meandering channel will also be impacted. The site designers laid out
the golf course in an effort to minimize wetland impacts. Some golf holes allow for playing over and
around wetlands. According to the course designer no land disturbing activity in wetlands will be required
to accommodate play.

fill material in 0.584 acres of wetlands or waters for the purpose of constructing the Knight's Play Golf
Center at SR 1010 and Penny Road, as you described in your application dated June 2, 1997 and July
29,1997. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3108 This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified
in the General Certification. This certification replaces ones issued on July 10, 1997 and August 28,
1997.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be required to
send us a new application. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall be put in
place within 30 days of the date of this letter. Stormwater shall not be allowed to directly discharge
into stream channels.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The purpose of this letter is to request additional impacts under Nationwide
Permit 26 and a Section 401 Water Quality Certification for the project known as
Knights' Play Golf Center. The project is DWQ#970334 and USACOE#1997-
00595.
Additional impacts are required due to the fact that four cart path crossings were

0.034 acres of wetlands is requested to accommodate the landowners objectives
of constructing a Par-3 golf course (see attached map).
Mr. Eric Fleek of the Division of Water Quality visited the site on May 20, 1997.
Mr. Fleek viewed areas adjacent to the impact areas currently requested and felt
mitigation was not required for the first application. The impacts proposed in
the first application included 0.55 acres of wetlands and no "significant" stream
channels. The client has placed the cart path crossings so that they cross at the
narrowest possible jurisdictional areas. The maximum width of each crossing is
20 feet. If another site visit is requested please contact S&EC regarding a time
and date.

Dear Mr. Jones:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.55 acres of wetlands or waters for the purpose of constructing the Knight's Play Golf Center
at SR 1010 and Penny Road, as you described in your application dated 2 June 1997. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number 3108.
This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404
or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application tsd except a new
modified below. If you change your project, you must notify us and you may be required end us
application. If total wetland fills for this project (now or in the future) exceed one acre, to be
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For approval
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional wetlands and waters to prevent future fill. These mechanisms shall be put in place
within 30 days of the date of this letter. Stormwater shall not be allowed to directly discharge into stream
channels.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The purpose of this letter is to notify you of a revision to our previously submitted
application for Nationwide Permit 26 and a Section 401 Water Quality Certification for
the project known as Knights' Play Golf Center. The project is labeled DWQ#970334
and USACOE#1997-00595 with the regulatory agencies.
A revision to the previous application is being made due to an additional proposed
impact. A wetland pocket missed by S&EC during delineation has been claimed by the
Corps of Engineers. The wetland is an isolated pocket approximately 0.26 acres in size
occurring in a cutover drainageway. Hydrology of the feature is non-riparian resulting in
an ephemeral wetland. Vegetation in and around the pocket is dominantly Arundinaria
gigantea. The filling of this additional 0.26 acres of wetlands is requested to
accommodate the landowners objectives of constructing a Par-3 golf course (see attached
map). It is desired that 0.55 acres total of jurisdictional waters and wetlands be filled. A
Nationwide Permit 26 is requested due to channel impacts totaling 470 linear feet and
filling of 0.55 acres of wetlands. Channel impacts will be in the form of piping.

Requested wetland impacts are .55 acres (.26 acres of which rated 38, the
remaining .29 was not rated as the project was resubmitted after initial
inspection-SEE S&EC letter). Total estimated wetland acreage on tract is 3.695
acres. Consequently, the RRO believes this project exhibits good
avoidance/minimization in terms of wetland impact. Requested stream channel
impacts are 470 linear feet. During the site visit the RRO determined that the
proposed channel impacts (pipe in channel) will occur in an intermittent and
(likely) a negative 7Q10/30Q2 stream. Therefore, (as per current DWQ policy) no
stream channel mitigation should be required for this project. However, it is the
opinion of the RRO that impacts to the stream could be reduced. This area (and
the corresponding wetland) must be impacted (as per the consultant) because
mechanical ball retrieval will be conducted in these areas. Consequently, the RRO
would recommend issuing the 401 with the following conditions: 1) It seems
feasible to the RRO that a small culverted crossing of the stream combined with
a small-mesh fence placed near the channel bank could serve to exclude balls from
_ the stream channel while allowing mechanized ball-retrieving equipment access to
further points on the range. This condition would minimize the amount of
macro invertebrate-impairing pipe placed in channel and the RRO believes that this
condition should be included in the 401. 2) In addition, during the site visit
the consultants (Wendell Overby and Kevin Martin) stated that all remaining
wetlands on the property not currently proposed for impact would be left intact.
To ensure this intent the RRO believes language in the 401 should be included to
prohibit future wetland impacts in these areas (highlighted on enclosed map).

The purpose of this letter is to notify you of a revision to our previously submitted
application for Nationwide Permit 26 and a Section 401 Water Quality Certification for
the project known as Knights' Play Golf Center. The project is labeled DWQ#970334
and USACOE#1997-00595 with the regulatory agencies.
A revision to the previous application is being made due to an additional proposed
impact. A wetland pocket missed by S&EC during delineation has been claimed by the
Corps of Engineers., The wetland is an isolated pocket approximately 0.26 acres in size
occurring in a cutover drainageway. Hydrology of the feature is non-riparian resulting in
an ephemeral wetland. Vegetation in and around the pocket is dominantly Arundinaria
gigantea. The filling of this additional 0.26 acres of wetlands is requested to
accommodate the landowners objectives of constructing a Par-3 golf course (see attached
map). It is desired that 0.55 acres total of jurisdictional waters and wetlands be filled. A
Nationwide Permit 26 is requested due to channel impacts totaling 470 linear feet and
filling of 0.55 acres of wetlands. Channel impacts will be in the form of piping.
Mr. Eric Fleek of the Division of Water Quality visited the site on May 20, 1997. Mr.
Fleek viewed the impact areas requested in the first permit application and felt mitigation
was not required. The impacts proposed in the first application included 470 linear feet
of channel and 0.28 acres'of wetlands. If another site visit is requested please contact
S&EC regarding a time and date.
