You have our approval, in accordance with the attached conditions, to remove sediment by backhoe or
cutterhead dredge at the Cliffside Steam Station on the Broad River, as you described in your application dated
28 February 1997. After reviewing your application, we have decided that this fill is covered by a
modification to the Water Quality Certification Number 2947 issued on 28 November 1994. This
Certification allows you to use the associated Individual Permit when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Dorney:
Duke Power Company is applying for a modification to the existing Corps of
Engineer (COE) permit 199404527 issued March 10, 1995. The request for this
permit modification is based on the desire to have a backup method of intake
sediment removal, a routine maintenance activity necessary to keep Cliffside
Steam Station operational.
Duke Power would like 401 certification for the permit modification. The
modification would allow Duke Power e a long reach backhoe for sediment
removal, should the cutterhead dredg by available. The long reach backhoe
would be positioned on the intake d access to the 150' by 75' dredge area
already approved under COE permit 199404527.
The existing intake dike will also be modified to provide the long reach backhoe a
stable working platform. This will include widening and lowering the top of the
intake dike to just above river level (3" to 6") by pushing the existing stone from
the top of the dike into the upstream side of the jetty. Additionally, crusher run
will be added to the widened area, in sufficient depth, to provide a consistent
working platform for the backhoe and dump truck to operate upon. A dump truck
will be positioned on the intake dike to receive the sediment removed by the long
reach backhoe.

The removed sediment will be transported to the ash basin (sediment from
cutterhead dredge discharges here under current permit) by the dump truck and off
loaded.
Concurrent with this letter, we are applying to the Army Corps of Engineers for a
modification to COE permit 199404527 and we are notifying the State Historic
Preservation Office and Fish and Wildlife Services of the requested modification
as well. Please fmd enclosed seven copies of the completed application and

4c. DISCHARGE OF DREDGED OR FILL MATERIAL
Approximately 25000 cubic yards of bottom sand will be removed yearly from the intake using
a cutterhead dredge. The material will be pumped to the ash basin and return water will be
discharged through a NPDES permitted outfall (NC#0005088, outfall 002). When the cutterhea
dredge is unavailable, a long reach backhoe will be positioned on top of the existing intak
dike to access the dredge area. The dike will be lowered and widened by pushing existing
rock into the upstream side of the dike. The removed sediment will be transported to the
ash basin and handled in the same manner above.
