The proposed Poplar Grove Point Subdivision is located on Live Oak Lane Off of Scotts Hill Loop Road
in Ponder County. Scotts Mill Loop Road is off of Highway 17 at Poplar Grove Plantation. The property
borders the Atlantic Intracoastal Waterway and an un-named tributary just north of Futch Greek, The
tract of land is approximately 7 acres in size. The majority of the tract is high in elevation and is mostly
wooded. There was one house located on the site that has recently been demolished. Also, pilings from
an existing pier remain in the water. The pier was heavily damaged by Hurricane Fran, 1996. The
proposed location of the new community structure approximates the location of these existing pilings.
The applicant is proposing the development of a 9-lot residential subdivision with water amenities. A
gravel road with cul-de-sac has already been installed. The bulkheading of the entire shoreline adjacent
to the waterway Is also being propmed, There is a coastal marsh fringe that borders the waterway against
it 10'-15' high bluff. The mush fringe is an approximate 40' wide area that
continues south w the mouth of the tributary where Distichlis-sp"ta and Saliwruia become ntixed with
the Spartina 411crniftnra, Mixed marsh is prolific all the way up this small tributary. There is some
Spartlna_patens and Distichlis spicata landward of the Spardna marsh along the edge of the erosion
escarpment bordering the waterway,
The waters of the Atlantic Intracoastal Waterway have been classified as SA, Outstanding Resource
Waters by the Division of Water Quality. They have been designated as Primary Nursery Area by the
Division of Marine Fisheries and are open to the taking of shellfish. The Pander County Land Use Plan
classifies this area as limited Transition.
The entire tract of land appears to fall within the 575' ORW Area of Environmental Concern. The
development of the tract will be limited to 25 % impervious surface coverage as is required under T15A:
07H.0209 (9) (f).
A community pier with 8 boat slips is proposed on an easement between 2 of the waterfront lots. The
proposed structure would be 106' long with a 16' x 16' gazebo, a 150' long floating dock with 4 floating
finger piers extending off of it. The float and the fingers are proposed to be 6' wide. The proposed
layout would provide 8 boat slips. Water depths in the area of the pier range from 1'- 5' according to
the information submitted with the application. In addition, the applicant is requesting 2 private piers -
one on Lot #a and one on Lot #5. Each pier would have a 28' x 12' dock, partially covered, and an 8'
x 20' floating dock that would provide access to an uncovered boat lift. These proposed features are
outlined on the project drawings. No dredging has been proposed in conjunction with this project.
Ponder County considers any facility that provides docking for more than five boats a marina. Marinas
are prohibited in waters classified as Outstanding Resources Waters. However, the Ponder County
Planning Board voted to issue a Special Use Permit for the project on September 15, 1997.

Impacts associated with the proposed project include increased impervious surface on the high ground,
and the shading of public trust waters by the water amenities. The proposed bulkheading will create an
artificial barrier that may alter the coastal wetlands waterward of the structure. Installation of the
bulkhead will increase the chances of temporary sedimentation into the surrounding waters and wetlands.
Construction of the docks, as presented, appears to conform with the 113 rule ad the required 15'
setbacks from adjacent riparian corridor lines. The community dock facility is approximately 80' from
the AIWW channel. Construction of these docking structures will result in the shading of 13,300 square
feet of public trust waters. Construction of these facilities will also increase the number of boat slips
within waters that are open to the taking of shellfish.
The project site is locatcd in an area having a high probability of containing cultural resources such as
artifacts.
