Troutman for Department of the Army authorization and a State Water Quality Certification to install a new 50-foot-long bulkhead 15 feet waterward from an existing bulkhead to line up with existing neighbors, bulkheads, and the placement of approximately 30 cubic yards of sandy backfill in 750 square feet of unvegetated shallow bottom of Myrtle Grove Sound, at 404 Canal Drive, Carolina Beach, New Hanover County, North Carolina. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by January 25, 1998, the District Engineer will deem that waiver has occurred. PROJECT SUMMARY: The applicant proposes to construct a new bulkhead, approximately 15 feet waterward of the existing bulkhead, or mean high water (MHW). 4 Lee R. Troutman Page 2 9. PROJECT DESCRIPTION The project site is located at 505 Canal Drive, in Carolina Beach, NC, in New Hanover County. The property is an undeveloped residential lot on the east side of Carolina Beach Yacht Basin. The lot is 50 feet wide and approximately 80 feet deep from Canal Drive. The highground is cleared and maintained as a lawn. There is an old wooden bulkhead stabilizing the waterward side of the lot, and an existing pier and floating dock extending from the center of the bulkhead. The waterfronts of both adjacent residential properties are both stabilized by an existing bulkheads, approximately 15 feet waterward of the applicant's property. The shallow bottom in front of the applicant's bulkhead is sandy and unvegetated. The elevation of the lot is 8 feet above mean sea level. The Carolina Beach Yacht Basin is approximately 450 feet wide in the project area. It is classified as SB by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The basin is not a designated primary nursery area (PNA) by the NC Division of Marine Fisheries. The applicant proposes to construct a new bulkhead along the west side of the property and position it to align with the two existing bulkheads on adjacent property. The proposed bulkhead placement would be located 15 feet waterward of the old existing bulkhead. Backfill material for the proposed wall would be imported from an upland source new bulkhead. 10. ANTICIPATED IMPACTS The construction of the bulkhead would incorporate 750 square feet of Estuarine Waters, Public Trust Area, and shallow water bottom. The project would align the stabilized shoreline in the immediate area and eliminate the accumulation of trash and debris within the currently recessed area between the adjacent . bulkheads, allowing the applicant equal use of his property.
