Dear Mr. Overman:
You have our approval, in accordance with the attached conditions, to place fill material in 7,480 feet of
waters for the purpose of constructing a bulkhead at Charles Creek Park, as you described in your application
dated October 30, 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

existing bulkhead and will be stabilized with riprap.

PROJECT SETTING
Charles Creek Park is located along Charles Creek adjacent to Riverside Avenue in Elizabeth City,
Pasqoutank County. The park is approximately two acres in size and comprises thirteen small parcels. The
south and west sides of the property are bounded by Charles Creek, a tributary of the Pasquotank River. The
northen end of the park is adjacent to Riverside Avenue and the eastern side is bounded entirely by developed
residential lots.
The park was originally established in 1971 through the Land Water Conservation Fund, and serves as a
recreational day use area. Structures in the park include a covered picnic shelter with bathroom facilities, a
playground, a grass volleyball court, and a failing wooden bulkhead. The 784' shoreline has an existing
bulkhead that begins at the Charles Creek Bridge on Riverside Avenue, and extends 661.5' in a southerly
direction along Charles Creek. The remaining 140' of shoreline has no protection system in place and shows
little erosion. The existing bulkhead appears to be sinking and is submerged below normal water level in
several places. Water depths just landward of the bulkhead average three to six inches and is not navigable.
The normal water line along the shore extends as much as 41' landward of the old bulkhead as a result of the
sinking shoreline. A variety of ducks and geese use the shallow area along the bulkhead, resulting in a high
concentration of animal waste in the water.
Vegetation found on the property includes lawn grass (Bermuda) and penny wort. Primary trees on the site
are black gum and cypress. Charles Creek is classified as inland waters by agreement between the Marine
Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's
water quality classification for Charles Creek is SC (fish propagation). There are no known archeological
sites or geological formations associated with Charles Creek Park.
PROJECT DESCRIPTION
The City of Elizabeth City proposes to construct a 661.5' bulkhead two feet waterward of an existing
bulkhead along Charles Creek. In its current state of disrepair the existing bulkhead affords little protection
from over wash from storms and boats. The proposed bulkhead will be constructed approximately one foot
above normal water level, backfilled and sloped back to a line of existing light poles (See Enclosed Site
Plan). Approximately 7,480 square feet of Public Trust water will be filled, of that 1,323 square feet of fill
will be placed in the area between the remnant bulkhead and the proposed bulkhead. The remaining 6,157
square feet will be placed in the area between the remnant bulkhead and normal water level.
Landward of the remaining 140' of shoreline, and a small fringe of freshwater wetlands, the applicant
proposes to place a 6' x 114' x 2' riprap structure. The alignment will not follow the shoreline, which
accounts for the shorter distance. The total area of high ground to be covered by riprap will be 1,368 square
feet. The riprap will allow water to flow from the higher ground fill back along the bulkhead back into
Charles Creek.
ANTICIPATED IMPACTS
1) The loss of approximately 7,480 square feet of public trust will occur.

2) Approximately 25,125 square feet of the high ground will be filled (including the riprap
alignment).
3) Some localized short-term turbidity will occur during the construction of the bulkhead.
4) Reduced concentrations of animal waste in the water directly behind the existing bulkhead.
5) Reduced flooding in the park during times of normal water level and increase use along the
waterfront by the public.
CAMA REVIEW
The project appears to be consistent with the general and specific standards of 07H .0208 (b)(7) of the North
Carolina Administrative Code. The problem with the bulkhead sinking is a direct result of unstable land, a
geologic feature (wetland fill). Whether this geologic feature is unusual is questionable, but the historic
filling was clearly permitted under previous programs. According to the applicant, the City of Elizabeth City
received a grant from the Division of Coastal Management to undertake the proposed improvements. A Land
Use Plan Consistency will be submitted under a separate letter by John Thayer.

PROJECT NARRATIVE
The City of Elizabeth City built this park project with LWCF funds
in 1971. Since that time there have been several additions to the
park including expanded open space with new playground
The park services this area as a regional facility attrracttingmman
school picnics, family reunions and local visitors. The f g
bulkhead and intrusion of water has made the park along the waters
edge unusable at normal water level.
Bulkhead construction is purposed along a line on the water side of
the existing bulkhead. The existing bulkhead is at or below normal
water level. The new bulkhead will be ± 18 inches above the
existing material. Vinyl or aluminum sheeting will be used as the
retaining wall with treated wood for pilings and headers.

would then be added during the winter or spring with Bermuda grass
being planted in earl summer.

Please reference the application of the City of Elizabeth City for Department of the Army
(DA) authorization and a State Water Quality Certification to construct a bulkhead and place
riprap along the shoreline, on property located at Charles Creek Park, off Riverside Drive,
adjacent to Charles Creek, in Elizabeth City, Pasquotank County, North Carolina. Your receipt
of this letter verifies your acceptance ofa valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the
Clean Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after
receipt of a request for certification is a reasonable time for State action. Therefore, if you
have not acted on the request, or asked for an extension of time, by December 27, 1997, the
District Engineer will deem that waiver has occurred.
