Preston Howard, Jr., P.E., Director November 6, 1997 Onslow County WQC 401 Project #970924 APPROVAL of 401 Water Quality Certification Mr. Dave McNally Escoba Bay Homeowners Association 401 Preakness Lane Sneads Ferry, NC 28460 Dear Mr. McNally: You have our approval, in accordance with the attached conditions, to place fill material in 0.02 acres of wetlands or waters for the purpose of constructing a community boat ramp and parking area at Meridian Drive, Escoba Bay Subdivision as you described in your application dated October 24, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h)(6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notices, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater from this project shall be directed to sheet flow at non erosive velocities into the remaining wetlands. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUNEWARY: The applicant proposes to construct a community boat ramp and pier with a small parking area for an existing residential subdivision. ESCOBA BAY HOMEOWNERS ASSOCIATION Page 2 9. PROJECT DESCRIPTION The proposed project is located off of State Road 1518 at Escoba Bay Subdivision in Sneads Ferry, Onslow County on Charles Creek. Escoba Bay is an existing subdivision that has all utilities and streets in place. Homes are under construction as lots are sold. The homeowners association is proposing to build a community boat ramp and day dock/pier on a 65' x 160' lot off of Meridian Drive within the subdivision. A small gravel parking area may also be installed, depending upon the need. The shoreline abutting Charles Creek is natural with a 14' fringe of Spartina alterniflora marsh with a 16' wide strip of federal wetlands landward of the marsh. The applicant is asking to fill an area 30' x 20' or 600 square feet of wetlands to construct the proposed boat ramp. The land has a natural slope from the high ground down to the water and will require very little alteration as far as cut and fill. The boat ramp will be finished in concrete and will extend approximately 18' - 20' below mean high water. All parking would be on high ground outside of the 75' Area Of Environmental Concern. The proposed pier, 4' x 50', will be used as an accessory structure to the boat ramp. The structure would be set back at least 15' from the adjacent riparian corridor line and does not exceed the 1/3 width of the waterbody requirement. The pier is not intended to provide mooring slips. The waters of Charles Creek have been classified as SA by the Division of Water Quality. They have been designated as Primary Nursery Area by the Division of Marine Fisheries and are open to the taking of shellfish. There are existing shellfish leases within the creek, however, to the writers knowledge this project will not be located within a leased area. The Onslow County Land Use Plan has classified this upland area as Limited Transition and the waters as Conservation. Water depths within Charles Creek are relatively shallow. No dredging is being proposed in connection with this project. 10. ANTICIPATED IMPACTS Probable impacts include loss of approximately 600 square feet of federal and coastal wetlands, disruption of 400 square feet of shallow bottom and shading of 185 square feet of public trust waters. Impervious surfaces on the high ground and through the wetlands may result in more surface runoff to the waters of Charles Creek. Temporary impacts may include turbidity associated with installation of mooring pilings and installation of concrete slabs for the boatramp. Natural drainage patterns should not be affected by the proposed development. No negative impacts to navigation would be expected. ESCOBA BAY HOMEOWNERS ASSOCIATION Page 2 9. PROTECT DESCRIPTION The proposed project is located off of State Road 1518 at Escoba Bay Subdivision in Sneads Ferry, Onslow County on Charles Creek. Escoba Bay is an existing subdivision that has all utilities and streets in place. Homes are under construction as lots are sold. The homeowners association is proposing to build a community boat ramp and day dock/pier on a 65' x 160' lot off of Meridian Drive within the subdivision. A small gravel parking area may also be installed, depending upon the need. The shoreline abutting Charles Creek is natural with a 14' fringe of Spartina alterniflora marsh with a 16' wide strip of federal wetlands landward of the marsh. The applicant is asking to fill an area 30' x 20' or 600 square feet of wetlands to construct the proposed boat ramp. The land has a natural slope from the high ground down to the water and will require very little alteration as far as cut and fill. The boat ramp will be finished in concrete and will extend approximately 18' - 20' below mean high water. All parking would be on high ground outside of the 75' Area Of Environmental Concern. The proposed pier, 4' x 50', will be used as an accessory structure to the boat ramp. The structure would be set back at least 15' from the adjacent riparian corridor line and does not exceed the 1/3 width of the waterbody requirement. The pier is not intended to provide mooring slips. The waters of Charles Creek have been classified as SA by the Division of Water Quality. They have been designated as Primary Nursery Area by the Division of Marine Fisheries and are open to the taking of shellfish. There are existing shellfish leases within the creek, however, to the writers knowledge this project will not be located within a leased area. The Onslow County Land Use Plan has classified this upland area as Limited Transition and the waters as Conservation. Water depths within Charles Creek are relatively shallow. No dredging is being proposed in connection with this project. 10. ANTICIPATED IlVIPACTS Probable impacts include loss of approximately 600 square feet of federal and coastal wetlands, disruption of 400 square feet of shallow bottom and shading of 185 square feet of public trust waters. Impervious surfaces on the high ground and through the wetlands may result in more surface runoff to the waters of Charles Creek. Temporary impacts may include turbidity associated with installation of mooring pilings and installation of concrete slabs for the boatramp. Natural drainage patterns should not be affected by the proposed development. No negative impacts to navigation would be expected.
