APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material in 0.64 acres of wetlands or waters for the purpose of developing a residential
subdivision called Belvedere Plantation, LLC at Hampstead, NC, as you described in your
application dated August 28, 1997. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3103. This certification allows you to
use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Watershed regulations. This approval will expire when the accompanying 404
or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be
required to send us a new application. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with
remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever is later).
2. We suggest that wetlands located on lots should be included in the adjacent open space.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask
for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the

RE: Bleeder Plantation 401
This project demonstrates good avoidance and minimization. No lot fill is requested. The only fill requested
are for two road crossings and a very small amount for driveway access on lots #34 and #35. A great deal
of unfilled wetland will comprise the sides and backs of many lots in this subdivision. In the application,
there is mention of the use of wetland easements to protect these remaining wetlands. Onsite, I spoke to Mr.
Steve Rice (consultant) about the possibility of deeding the wetland areas out of the lots. In this way, the
property owner does not own the wetland area and is less likely to impact what he or she does not own.
'This "deeding out" of the wetlands should be made a condition of the 401. Other conditions should be
made to ensure that stormwater from lots adjacent to wetland areas be directed to sheetflow into the /
wetlands. This should be a condition for the following lots: #35, #34, #62-#72, #79, #80, #107, #108, #170,
#169, #188, #189, #141, and #140.

around the Belvedere Plantation golf course. Standard earth moving and construction
equipment will be used to develop the 191 single family lots. No commercial or
non-residential uses are proposed on the subject area. Undisturbed wetlands located
in lots will be protected by easements.

The purpose of this project is to expand the residential area around the existing
Belvedere Plantation golf course. The proposed development is a revision to the
original Belvedere Plantation planned development.

Belvedere Plantation, LLC is submitting the following Pre-Construction Notification for
construction of the ±64.42 acre, 191 unit single-family housing residential development in
Pender County, North Carolina. This development is an expansion of the already existing
Belvedere Plantation residential community and golf course.
A total of ±4.2 acres of freshwater wetlands are located on the project site. The wetland
boundaries were delineated, surveyed and then approved by Mr. Mickey of the U. S.
Army Corps of Engineers. Of the ±42 acres of wetlands, approximat y 0.6 acre will be
impacted during project activities. The Master Plan was designed to minimize and avoid
wetland impacts to the extent possible. The unavoidable wetland impacts proposed are
associated with the installation of Azalea Drive and North Belvedere Drive. These roads are
necessary to provide access to the remainder of the site. It should be noted that no homes will
be placed within wetland boundaries. Any wetland areas extending onto residential lots will
be protected through the implementation of wetland easements.
The entire 64.42 acre development will be constructed in four phases. The first phase will
consist of lots 1 - 68 and model home lots 174 - 176. Wetland impacts associated with this
phase consist of driveway crossings on lots 34 and 35. It is anticipated that development of
this phase will begin in September, 1997 with work in wetland areas beginning in October,
1997, or as soon as all required permits and authorizations have been obtained. The
remaining three phases will be developed as dictated by the rate of housing sales.
