Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification Northampton County c/o Mr. Kevin Martin 244 West Millbrook Road Raleigh, NC 27609 Dear Mr. Martin: A4 ?EHNR August 1, 1997 Northampton County WQC 401 Project #970408 You have our approval, in accordance with the attached conditions, to temporarily fill in 0.3574 acres of wetlands or waters for the purpose of waterline at SR 1108, as you described in your application dated 7 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. We have determined that the only jurisdictional areas currently within the construction corridor are swamp forests immediately adjacent to state roads and unvegetated channels along drainageways (see attached maps). These are shown as approximations on the attached maps. The waterline will be installed within the existing road shoulder except where it must cross a stream. However, temporary impacts within the construction corridor will also occur as shown on the plans. Findings The site was closely evaluated for evidence of hydrology and vegetation. In this area, the hydrologic proof would be in the existence of hydric soils, water borne deposits, sulfidic odor, stained leaves, drift lines, scour marks, regional indicators of soil saturation, etc. After close examination of the soil borings, we found hydrology indicators present that indicate hydrology exists for wetlands designation in the areas identified. Toe of fill is,& 25' from CL except at culverts where it is 15' so impacts are 5' times length plus 15'x12'x 3 culverts. H20 is at surface and dominant vegetation is Smilax, Red maple, Swamp rose, Arundanaria. From last culvert north, toe of fill is 30' or more from C /L of road. 2 Swamp Forest Everything outside toe of fill slope is an upland wetland mix. Toe of fill is 25' from C/L except at culvert where it is 20', so impacts are 5' times length plus 10'x30'x 1 culvert. H2O at surface, Dominant vegetation is Red maple, Woodwardia, Jewelweed, Lizard's tail, and Poplar. 1 Swamp Forest Everything beyond fill slope within study area is wet. Toe of fill is >30' from CL except at bridge abutment where it is 20', mostly water. Impacts are 70' x 10' if stay within 30' of CL of road with construction and clearing limits. H20 in pockets was 6" above surface. Dominant vegetation is Microstigium, Cypress, Red maple, Willow oak, Black gum, Carex, Lizard's tail & Woodwardia, and River birch.
