After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: The applicant proposes to construct two rock jetties on the Neuse River at the mouth of Alligator Creek in Minnesott Beach. One jetty would be 410' long and the other would extend an existing 166' jetty an additional 170' offshore. Also, the applicant proposes to install 785' of rock rip rap along the shoreline above the NWL. FIELD INVESTIGATION REPORT: MINNESOTT BEACH YACHT BASIN, INC./PAMLICO COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The project site is located adjacent the Neuse River on the west side of Alligator Gut, on Neuse River Drive, off SR 1121, in the Town of Minnesott Beach, Pamlico County. The 22-acre tract is listed under two deeds. One section is adjacent the Neuse River and is where the owner's personal residence is located. The other section is the site of Minnesott Beach Yacht Basin, an "upland" marina with numerous amenities. An 80'-wide access channel leads from the Neuse River into Alligator Gut via an easement from Minnesott Golf and Country Club. The Country Club is located immediately downstream to the east across Alligator Gut, while a private homeowner abuts the project site upstream to the west. Two short rock jetties currently exist along both sides of the channel. The jetty to the west is approximately 200' long but extends only 55' waterward of the NWL, while the jetty to the east is 170' long and extends only 70' waterward of the NWL. A 510' derelict wooden jetty also exists adjacent the western side of the channel and extends some 440' waterward of the NWL. The shoreline adjacent the western side of the channel protrudes out into the Neuse River approximately 125' farther than the eastern shoreline. The shoreline is essentially a sandy beach habitat with an erosion escarpment evident along the upstream section of the beach. The adjacent property to the west is bulkheaded. And according to the applicant, annual erosion since the storms, especially adjacent this property, is between 10' to 15'. Based on my field visit and judging by the number of trees that have recently fallen along the shoreline, I tend to agree with the applicant's assessment. Water depths within the existing access channel appear to have sanded in and range between -4' and -6' below NWL. These depths exist despite the channel being originally excavated and subsequently maintained at its permitted -8' below NWL depth. No wetlands exist along this stretch of shoreline, and no SAVs appear to occur within the project site along the Neuse River. This section of the Neuse is classified SB Sw NSW, while Alligator Gut is classified SC Sw NSW. Neither system is a Primary Nursery Area, and both are closed to shellfishing. Project Description The applicant proposes to install two rock jetties adjacent both sides of the access channel that leads from the Neuse River to the Minnesott Beach Yacht Basin. According to the application, the new rock jetties would be 16' wide at the base and 8' wide at the top (see oversized plat entitled "Channel Stabilization Project"). The applicant proposes to construct the jetties on a 1 to 1 slope, with expected sloping to FIELD INVESTIGATION REPORT: MINNESOTT BEACH YACHT BASIN, INC./PAMLICO COUNTY PAGE #3 reach a 1.5 to 1 slope after settling. The jetties would be some 4' above the NWL. The jetty to the west would extend 315' waterward of the NWL. The jetty to the east would extend the existing jetty another 166' waterward of the NWL for a total distance offshore of 336'. The first 170' of this jetty would be refurbished to the same specifications as the new jetties. NSA No. R-6 marl or better would be used for construction. According to the applicant's contractor, the jetties would be constructed by using a "Trac Loader". Two lines of rock 16' apart would be laid down and the area in between filled as he moves out. The applicant also proposes to install rock rip rap along the shoreline from the proposed jetty on the western side of the access channel to the adjoining bulkhead some 785' upstream (see 8.5" X 14" plat entitled "Beach Stabilization Project"). Marl would be placed above the NWL along the 4' contour and would be constructed on a 1.5 to 1 slope and would be approximately 5' high with a 2' top width. Minimum stone size would be NSA No. R-4. No backfilling is being proposed. Anticipated Impacts The project as proposed would result in the filling/loss of 15,392 ft2 of Estuarine Waters/Public Trust Area and shallow river bottom within the Neuse River. This number is obtained by assuming an average water depth of the jetties of 4', an average height above the NWL of 4' (stated in application), a top width of 8', and an assumed settlement slope of 1.5 to 1. Such assumptions would create a jetty with an average base width of 32'. According to the applicant, approximately 3,050 yds3 of marl rock would be placed below the NWL. The placement of 785' of marl along the shoreline for the revetment, at the 4' contour line, would disturb approximately 13,345 fe of sandy high ground. This is assuming a 5' high structure installed on a 1.5 to 1 slope with a 2' top width and assuming no settling. Likewise, the jetties would extend above the NWL and disturb another 1,600 fe of sandy high ground. This assumes a 4' high structure, installed on a 1 to 1 slope with no settling, an 8' top width for a resultant 16' bottom width. Since there are no SAVs within the project area, adverse affects to shallow bottom habitat should be minimal. It is also assumed that along this section of the Neuse there is a fairly high sediment transport capability. Some erosional impacts can be expected on the downdrift property for an undetermined distance. Although the installation of any structure would have the potential for impact to navigation, any additional impacts should be minimal since the existing wooden jetty already extends some 440' from the NWL, thus restricting the flow of boat traffic immediately adjacent the shore.
