PROJECT SUMMARY: The applicant proposes to install a sewer line across Lewis Branch, install 270' of bulkhead, replace 2 finger docks and drive 2 mooring pilings. NARRATIVE DESCRIPTION: Project Setting The applicant owns a one-story framed house on a lot at the end of SR 1123 in Minnesott Beach, adjacent the Neuse River and Lewis Branch in Pamlico County. The .30-acre lot is bound by the Neuse River to the south, Lewis Branch to the west, a manmade canal to the north and another residential developed lot to the east. The existing septic system has failed and the owner has purchased an approximately 80' X 375' lot across Lewis Branch in hopes of installing a new septic system drainfield. An experimental septic system was recently approved by the Health Department on the old lot but the applicant felt the system was too risky and it had to be monitored closely. And given the possibility of future failure, the applicant decided to proceed with an offsite location since it was currently available. Lewis Branch is approximately 30' in width and 400' in length. It serves as an overflow discharge point for the main lake at Minnesott Beach Golf and Country Club. An existing 30' X 45' high ground basin exist on the newly purchased lot. And approximately 180' of the shoreline adjacent to the basin is bulkheaded but in poor condition. The Neuse River side of the main lot is protected by rip rap and a high ground bulkhead. The recent storms have damaged the integrity of the rock wall. There are narrow fringes of Coastal Wetlands along the point of the propoerty but none where the development is being proposed. The back side of the main lot along the manmade canal is also bulkheaded. Water depths along Lewis Branch is approximately -3' below NWL and at the proposed crossing the bottom is sandy. With only two docks located along the short canal, there is very limited boat traffic. Both this stretch of the Neuse River and Lewis Branch are SB Sw NSW waters, are closed to shellfishing, and are not PNAs. Project Description The applicant proposes to excavate a 30' long X 4' wide X -5' deep trench across Lewis Branch and install a 2" scheduled 80 PVC pipe encased in a 5" scheduled 80 PVC pipe and backfill back to grade. Also, the applicant proposes to construct two 3'-wide X 15'-long finger docks, essentially creating 3 slips (previously existed on site- -based on 1989 aerial photographs) and install two mooring pilings within the existing high ground basin. In addition, the applicant proposes to replace 180' of deteriorating bulkhead within and adjacent to the basin along the existing alignment. Finally, the applicant proposes to construct approximately 90' of bulkhead at the NWL adjacent the Neuse River (previously protected by rip rap). FIELD INVESTIGATION REPORT: ROBERT McDONALD/PAMLICO COUNTY PAGE #3 Anticipated Impacts The excavation of the trench would temporarily disturb approximately 120 ft2 of shallow water habitat within Lewis Branch during the installation process. And since the bottom near the mouth is of a sandy material, there should be neglible impact to the estuarine system after installation. Removal of a failing septic system as well as replacing a permitted but experimental system would be a positive point of the project. The dock construction would shade approximately 90 ft2 of shallow habitat and usurp another 1,125 ft2 of Public Trust Waters after the mooring pilings/tie poles are installed (if three boats stay moored at the dock). Approximately 9,897 ft2 of high ground disturbance within the Estuarine Shoreline would occur. This involves 472 ft2 associated. with the trench for the sewer line, 5,375 ft2 for the new drainfield, and 4,050 ft2 associated with installation of the tie-backs for the bulkhead. No wetlands would be impacted by the project. All aspects of this project except for the sewer line crossing and drain field location fall within the guidelines of a General Permit from DCM. M. D. Existing septic system has failed and lot across canal has been purchased for an offsite sewer system. Our plan is to install a 2" scheduled 40 PVC pipe (scheduled 80 across canal) from the house tank, across the canal to the septic system site. We will dig a trench across the bottom of the canal with a backhoe on each side of the canal simultaneously installing the weighted pipe approximately 5' below the bottom of the canal. The owner chose to apply for the Canal Crossing since there was resistance met when he approached the Town of Minnesott Beach asking to follow the street R/W to the new septic site. The improvement permit will be issued by the county only after we get the CAMA Permit to cross the canal.The septic area 50' x 125' +/- shown on page 1 of the drawing is approximate, but should be adequate for any system. A General Permit was issued for an innovative septic system at this same site. Mr. & Mrs. McDonald decided this new system was some what a risk since the health department was to monitor the system, and with the possibility of failure, would still have to go offsite. 2 1997 44 ..l ! k.. i_' . After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
