You have our approval, in accordance with the attached conditions, to place fill material and excavate
waters for the purpose of reconfiguring a dock and add a boat ramp at Topsail Sound Pier, as you described in
your application dated 10 June 1997. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3112. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

9. PROTECT DESCRIPTION
The existing Topsail Sound Pier is located at 1520 Carolina Boulevard, Topsail Beach, Pender County.
The project is on Banks Channel off of the Atlantic Intracoastal Waterway just north of New Topsail
Inlet. Presently there is a commercial building, parking, and pier structures on the site. The building
and pier were significantly damaged by Hurricane Fran. The building is presently being repaired and
will house a store and restaurant. The owner wishes to make some changes in configuration and use
when the pier/dock facilities are fixed. Under the proposed plan there will be 10 boat slips for rent
to the general public. Historically the pier structure has been principally used for fishing.
The high ground portion of the development consists of 4 lots that have been developed for a number
of years. Presently there is a building, parking lot and a septic system on these contiguous, bulkheaded
lots. The building and pier structure show on the aerial photography from 1978. Only slight
modifications have been made to the pier since that time.
The proposed docking structure will not offer sewage pump-out nor sell fuel. A total of 10 boat slips
are planned. The Pre-Hurricane Site Map and Marina Plan Map show the differences between what
is existing (though damaged) and what is proposed. The Pre-Hurricane Site Map does not show that
the existing, damaged structure is over into the adjacent riparian corridor. That should be resolved as
the "Tee" head is reduced in size. The most significant change in the pier structures is that the size of
the waterward-most "Tee" will be decreased by 300 linear feet and will be 8' wide instead of 16' wide.
The pier extending toward the tee is to be decreased to 8' in width from the present 16' and the overall
length would remain the same. All portions of the damaged structure should be removed as a part of
the re-building efforts (since it poses a hazard to navigation). No dredging is being proposed in
conjunction with this proposal.
The proposed boat ramp is totally new. A portion of the bulkhead would be removed to make way for
the ramp. It will be used commercially in connection with this marina facility. The proposed ramp is
shown on the Marina Plan and labeled as New Concrete Boat Ramp. The proposed ramp would be 15'
wide and extend less than 20' below mean high water, which is in keeping with Coastal Management
Rules 7H. 1300. Excavated material from the boat ramp construction will be used to fill ruts and holes
in the parking lot that were created during the last hurricane.
The waters of Banks Channel in this area are classified as SA by the Division of Water Quality. They
are not Primary Nursery Areas as determined by the Division of Marine Fisheries. They are open to
the taking of shellfish. The Topsail Beach Land Use Plan classifies the high ground portion of this
property as "Developed".
10. ANTICIPATED IMPACTS
No impacts to coastal marsh or federal wetlands are expected. A small amount of shallow bottom will
be affected by the installation of the boat ramp. The amount of public trust waters taken up by the
proposed development will be similar to that being used by the existing fishing pier. An increase of
boating usage would be expected with the leasing of the slips and installation of the public boatramp.

Attached is a CAMA Major Permit application for Kip & Annette Oppegaard formerly d.b.a. Topsail
Sound Fishing Pier. This letter serves as a narrative description of the project and is therefore an integral part
of the permit application. Please include a copy of this letter with all copies of the permit application.
As you know the Oppegaards' pier was practically completely destroyed by Hurricane Fran. All that
remains undamaged are the pilings and certain small sections of the pier close to the shore.
The Oppegaards plan to rebuild portions of the pier and construct boat docks connected to the pier.
The docks will be rented or leased to private boat owners for mooring their boats. The typical size of
boats to be moored is expected to be 20' to 30' in length. Two slips are presently available that can
accommodate larger boats, up to about 50' in length. No utilities or facilities will be provided for live
aboard dockage. No sewage pump out service is immediately planned although such service may be
provided in the future.
In addition to the private boat slips, public dockage will be available. A "tee" at the end of the pier
will accommodate public docking for boaters in Banks Channel. The proximity of the marina to New
Topsail Inlet will also make the marina easily accessible to boaters from the Atlantic Ocean. The
public dockage will give public boaters access to the restaurant and store that presently exists where
the fishing pier meets the shore. The restaurant and store are housed in a two-story building that
covers approximately 4,000 square feet of ground. The building existed long before Hurricane Fran
hit, and survived the Hurricane in relatively good condition.. No significant structural damage was
done, and no structural repairs will be required to resume business in the building.
The only on-shore construction planned for the marina is the construction of a boat ramp for
launching and retrieving boats via trailer. The boat rampp will be 15' wide and approximately 30' long to
the water line. A section of the existing bulkhead will be removed to construct the boat ramp. The
boat ramp will be located 20' from the property line of the adjacent lot.
All other facilities including the building, parking lot, storm drains, walkways, landscaping, septic
system, and utilities were in existence prior to Hurricane Fran and no modifications are planned.
